Statev.Cabbage,571S.W.2d832,835(Tenn.1978)).Thecourtmaynot re 8^/0 weighorreevaluatetheevidenceintherecordbelow.Evans,838S.W.2dat `  191(citingCabbage,571S.W.2dat836).Likewise,shouldthereviewingcourt P  findparticularconflictsinthetrialtestimony,thecourtmustresolvetheminfavorofthejuryverdictortrialcourtjudgment.Tuggle,639S.W.2dat914. 0  ` In1995,theoffenseofDUIrequiredproofthat(a)anypersonorpersonswasdrivingorϜinphysicalcontrolofavehicle;(b)onanypublicroad,highway,street,oralley,oronthepremisesofanyshoppingcenter,trailerpark,apartmentcomplex,orotherplacegenerallyfrequentedbythepublicatlarge;(c)whileundertheinfluenceofanyintoxicant,marijuana,narcoticdrug,ordrugproducingstimulatingeffectsonthecentralnervoussystem.Tenn.CodeAnn.5510401.TheproofpresentedbytheStateattrialclearlyfulfillstheseelements. ` DefendantsconvictionarosefrompoliceinvestigationofacollisionbetweenhisvehicleandthatofJoeandAnnieBurton.Mr.Burton,driveroftheothervehicle,testifiedfirstfortheState.Hestatedthat,whileheadingsouthboundonafourlaneroadinMemphis(ThirdStreet),hepreparedtomakealeftturnontoacrossstreet(WeaverRoad).Hemovedintothelefthandlane,turnedonhisturnsignal,andwaitedforthegreenlight.Afterthelightturnedgreen,henoticedthatavehicleheadingnorthboundonthesamestreetattemptedtomakealeftturnontothecrossstreetfromtherightmostlaneoftheroad.Mr.Burtonnoticedtheactionofthisvehicle,drivenbyDefendant,becausehewaswaitingonthenorthboundtrafficmovingstraightaheadbeforehecouldexecutehisleftturn.  7.0  ` AsMr.Burtonwaited,heobservedDefendantsvehiclecrossovertheleft handlaneofnorthboundtraffic,entertheintersection,andcollidewiththeleftsideofthefrontofMr.Burtonscar.Hestatedthatalthoughheknewacollisionwasinevitable,hecouldnotmovehisvehiclefromDefendantspath.Mr.BurtontestifiedthatDefendantremainedinhiscarforafewminutestofinishdrinkingaϜbeer.Defendantthenbeforehe񛀜exitedthecarandstated, Isurehateyoutoreupmycar.Mr.Burtonthenwalkedtoastoretotelephoneforthepolice,butthestorekeeperhadalreadycalled.InMr.Burtonsopinion,Defendantwasnot inshapetodriveduetointoxication":hewas goodandhigh:,not fallingdowndrunk,butstaggering. ` TheStatenextcalledMrs.Burtontotestify.Mrs.Burton,thepassenger,providedthesamedescriptionoftheaccidentandalsostatedthatsheobservedDefendantdrinkingabeeraftercollidingwiththeircar.ShetestifiedthatDefendantstaggeredwhenheexitedhisvehicleandthat,baseduponherexperienceseeingotherintoxicatedpersons,shebelievedDefendantwasdrunk. ` OfficerVernonVanBurenoftheMemphisPoliceDepartmentarrivedfirstatthesceneoftheaccident.BecauseDefendantacted irateandangry,theofficerplacedhiminthebackseatofthepatrolcar.Atthattime,VanBurensmelleda strongodorofalcoholcomingfromDefendantandnoticedthathehadbeenstumbling.VanBurenthencalledforaDUIofficertoconductsobrietytestsandlaterwitnessedthesetests,allofwhichDefendantfailedtoperformsatisfactorily.  7.0  ` OfficerVanBurenspartner,OfficerA.W.Rudolph,heardtheinitialcalland arrivedonthesceneshortlyafterVanBuren.RudolphsatdowninsidethepatrolcarwithDefendantandimmediatelynoticedsmelleda strongobvioussmellofalcohol.HeknewconclusivelythattheodorwascomingfromDefendantsmouth,notmerelyhisclothing.OfficerRudolphalsowitnessedDefendantattempttoexecutethefieldsobrietytests,andinhisopinion,Defendantperformedunsatisfactorilyduetointoxication. ` ThefinalwitnessfortheStatewasDUIOfficerE.W.White,whoadministeredthefieldsobrietytests.Duringhistestimony,thejuryviewedavideotapeofthosetests,inwhichDefendantattemptedrecitationofthealphabet,thefingertonosetest,theheeltotoewalk,andtheoneleggedstand.Wehavereviewedthevideotape;andweobservedthatDefendantcouldnotrecitethealphabetinorder,hesitatedtoperformthefingertonosetestandrequestedrepetitionofinstructions,steppedawayfromtheimaginarylineseveraltimesduringtheheeltotoewalk,andcouldnotperformtheoneleggedstandforanysignificantlengthoftime.OfficerWhitetestifiedthatDefendantswayedandweavedwhenhewalked,thathisspeechwasslurred,andthathehadamoderateodorofalcoholabouthisperson.Intheofficersopinion,Defendantwasimpairedasaresultofintoxication. ` JohnShelton,Defendantspassengeronthedayoftheaccidentandfriendoftwentyyears,testifiedforthedefense.SheltonstatedthatDefendantdrankaCokeshortlybeforethecollision,thathedidnotcrossoverlanesoftraffic,that hedidnotsmellofalcoholpriortotheaccident,andthathedidnotseemtohave 7.0 anyproblemperformingthefieldsobrietytests.TheStatequiteeffectivelyimpeachedϜSheltonscredibilityduetobiasbaseduponhisfriendshipwiththeDefendant.  ` Basedupontheforegoingproofpresentedattrial,wefindtheevidenceclearlysufficienttopermitthejurytoconvictDefendantofdrivingundertheinfluenceofanintoxicant.Thejudgmentofthetrialcourtisaccordinglyaffirmed.Ӏ `     h     ____________________________    `     h     DAVIDH.WELLES,JUDGECONCUR:______________________________PAULG.SUMMERS,JUDGE______________________________JOEG.RILEY,JUDGE
