Theappellantssoleissueforourreviewiswhetherthetrialcourterredbyorderinghimtoserveanexcessivesentence.Weaffirm. Theappellantarguesthatthetrialcourterredbyimposinganexcessivesentence.Hecontendsthatthecourterredinitscharacterizationofhisbehaviorandthatthecourtshouldhaveappliedcertainmitigatingfactors.First,theappellantassertsthatthefollowingstatementbythetrialcourtwasimproper: Peoplehavearighttolivefreeofviolence.Peoplehavethisrighttoknowapersonshouldnotbeabletoterrorizepeople,hurtpeopleandgetawaywithit.TheappellantcontendsthattherewasnoproofthathehadterrorizedanyoneandthatthecourterredbyrelyingonthischaracterizationbecauseitisnotoneofthestatutoryenhancementfactorsprovidedforinTennesseeCodeAnnotated4035114(1997).  Second,theappellantarguesthatseveralmitigatingfactors,specifically4,6,11,and13,underTennesseeCodeAnnotated4035113(1997)wereapplicable:(4)theappellantplayedaminorroleinthecommissionoftheoffense;(6)theappellant,becauseofhisage,lackedsubstantialjudgmentincommittingtheoffense;(11)theappellantcommittedtheoffenseunderunusualcircumstancesthatitisunlikelythatasustainedintenttoviolatethelawmotivatedtheappellantsconduct;and(13)the catchallprovisionwhichprovidesforanyfactorconsistentwiththepurposesofthischapter.Therefore,basedonthesemitigatingfactors,theappellantarguesthatheshouldhavereceivedasentenceofeightyears,nottwelve. Thestatecontendsthatthetrialcourtproperlysentencedtheappellant.Itarguesthatthetrialcourtdeterminedthattherewerenomitigatingfactorsandatleastfiveenhancementfactors.Regardingthetrialcourtsstatementabouttheappellant terrorizingpeople,thestatemaintainsthatthecourtwasreferringtoprobation,notenhancementfactors,whenitmadethestatement.Furthermore,thestatesubmitsthattheappellantfailstociteanylegalauthorityforhispositiononthemitigatingfactors,andtherefore,thisCourtshouldconsidertheissuewaived.Thestatealsonotesthattherecordrevealsthatnoneofthemitigatingfactorscitedbytheappellantwouldbeapplicable. Whenanappellantchallengesthelength,range,ormannerofserviceofasentence,thisCourtconductsadenovoreviewwithapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d)(1997).However,thispresumptionisconditionedonanaffirmativeindicationintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991). Theappellantbearstheburdenofshowingthatthesentencewasimproper.Id.󀀀Indeterminingwhethertheappellanthasmetthisburden,thisCourtmustconsider(a)theevidenceadducedattrialandthesentencinghearing;(b)thepresentencereport;(c)theprinciplesofsentencing;(d)theargumentsofcounsel;(e)thenatureandcharacteristicsoftheoffense;and(f)theappellantspotentialorlackofpotentialforrehabilitationortreatment.Tenn.CodeAnn.4035103(5),210(b)(1997). Thepresentencereportrevealsthattheappellanthasalengthycriminalrecord.Wealsonotethattheappellantcouldhavebeensentencedasamultipleoffender,butbaseduponanagreementwiththestate,hewassentencedasastandardoffender.Withregardtothetrialcourtscharacterizationoftheappellantsbehavior,weagreewiththestatethatthetrialcourtwasreferringtoprobationandnottoanyenhancementoftheappellantssentencewhenitmadethestatement.Thetrialcourtprovidednotonlyoralfindingsatthesentencinghearing,butalsocompletedasentencingformthatindicatesthecourtsfindings.Fromourreviewoftherecord,weconcludethatthetrialcourtfollowedtheprinciplesofsentencinginfindingthatatleastfiveenhancementfactorsandnomitigatingfactorswereapplicable.
