(   כ̀ Afterreview,weaffirm.@ BACKGROUND  Atapproximately3:45p.m.onAugust17,1996,theappellant,whiledrivingthrougharesidentialneighborhood,leftthepavedportionofthestreet,strikingmailboxesandfinallyhittinganeighborsparkedcar.Numerouschildrenlivedinthisareaandroutinelyrodetheirbicyclesuponthestreets.Followingtheappellantsarrestonthisdate,herbloodalcoholcontentlevelwas.30percent. OnOctober29,1996,beforeenteringguiltypleas,theappellantvoluntarilyenteredtheNewLifeLodge,aresidentialalcoholanddrugtreatmentcenterinBurns,Tennessee.Shesuccessfullycompletedtheinpatientprogramandwasdischargedapproximatelythreeweekslater.TheseoffensesoccurredapproximatelyonemonthaftertheprobationaryperiodforherpreviousDUIconvictionhadexpired.Onthedateoftheseoffenses,theappellantwasdrivingonarestrictedmotorvehicleoperatorslicense. )   כTheproofatthehearingestablishedthattheappellantwasfiftyfiveyearsoldandawidow.Baseduponthesefacts,thetrialcourtimposedconcurrentsentencesofsixmonthsforbothsecondoffenseconvictionsforDUIanddrivingonarevokedlicense,withalltimesuspendedexceptforsixtydayswhichwastobeservedintheWilliamsonCountyWorkhouse.Thecourtfurtherorderedtheappellanttobeplacedonsupervisedprobationfor11months29days,revokedtheappellantsdriverslicensefortwoyears,andfinedtheappellant$600forthechargeofdrivingundertheinfluence,secondoffense. +@ # AnalysisHKK1KHKK1KHKK1K  Theappellantfirstcontendsthatsheshouldbegivenjailcreditfortimevoluntarilyspentinanalcoholtreatmentfacility.Shearguesthat thepublicpolicyoftheStateofTennesseeshouldbesuchthatitwouldencourageadefendanttoimmediatelyseektreatmentforthewelfareoftheDefendant,aswellas,thecitizensoftheStateofTennessee.ThisidenticalissuewasaddressedinStatev.Morrow,778S.W.2d63,65(Tenn.Crim.App.1989).InMorrow,thiscourtfoundthat nostatuteauthoriz[es]jailcreditwhenthedefendantvoluntarilyentersaprivatelyoperatedresidentialalcoholtreatmentfacility....[T]hedefendantsargumentthatjailcreditsforanytimespentinaninhousetreatmentfacilityismoreappropriatelyaddressedtothelegislature.SeealsoStatev.Green,No.03C019502CR00057(Tenn.Crim.App.atKnoxville,Oct.26,1995),perm.toappealdenied,(Tenn.Apr.8,1996);Statev.Johnson,No.02C019103CR00048(Tenn.Crim.App.atJackson,Dec.12,1991).Becausetheappellantsparticipationintheinpatienttreatmentprogramwasnot courtordered,theappellantcannotreceivecreditforthetimeshespentatNewLifeLodge.Tenn.CodeAnn.5510403(a)(4)(A).Thisissueiswithoutmerit. Theappellantnextassertsthatthetrialcourtimposedexcessivesentencesforherconvictions.Shestatesthatshe simplywantstobeallowedtoservetheminimum[45day]sentence.Whenanappellantcomplainsoftheirsentenceonappeal,thiscourtconductsadenovoreviewcoupledwithapresumptionthatthetrialcourtssentencingdeterminationsarecorrect.Tenn.CodeAnn.4035210(d)(1995Supp.).However,thispresumptionisconditioneduponanaffirmativeshowingthatthetrialcourtconsideredtherelevantsentencingprinciplesandallpertinentfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).Regardlessofwhetherthepresumptionofcorrectnessisapplied,theburdenofshowingtheimproprietyofthesentenceisontheappealingparty.SentencingCommissionComments,Tenn.CodeAnn.4035401(1990). MisdemeanorsentencingisgovernedbyTenn.CodeAnn.4035302Ϝ(1996Supp.).AlthoughotherwiseentitledtothesameconsiderationsundertheSentencingReformActof1989,unlikeafelon,amisdemeanantisnotentitledtothepresumptionofaminimumsentence.SeeStatev.Seaton,914S.W.2d129,133(Tenn.Crim.App.1995)(citationomitted);Statev.Warren,No.01C019605CC00218(Tenn.Crim.App.atNashville,May21,1997)(citationomitted).Moreover,asasentencinghearingisnotmandatory,seeTenn.CodeAnn.4035202(1990),trialcourtsarenotrequiredtoexplicitlyplacetheirfindingsontheϜrecord.SeeStatev.McKnight,No.01C019509CC00313(Tenn.Crim.App.atNashville,June11,1996),perm.toappealdenied,(Tenn.Jan.6,1997);seealsoStatev.Troutman,No.03C019509CC00287(Tenn.Crim.App.atKnoxville,Nov.6,1996),perm.toappealgranted,(Tenn.May5,1997)(Hayes,J.dissenting).ϜAdditionally,werecognizethatamisdemeanorsentence,asopposedtoafelonysentence,containsnosentencerange.SeeTroutman,No.03C019509CC00287(Hayes,J.dissenting).Accordingly,inmisdemeanorcases,thetrialjudge,whoisabletoobservefirsthandthedemeanorandresponsesofthedefendantwhiletestifyingmustbegranteddiscretioninarrivingattheappropriatesentence.Insum,thesentencingcourtshouldexaminethemisdemeanoroffenseinthelightandcharacterofthecircumstancesoftheoffenseaswellasunderthemandatedsentencingprinciples.Statev.Brannon,No.03C019508CR00233(Tenn.Crim.App.atKnoxville,Apr.3,1996),perm.toappealdenied,(Tenn.Nov.4,1996)(citingStatev.Gilboy,857S.W.2d884,889(Tenn.Crim.App.1993)).
