ThepetitionerwasconvictedonJanuary26,1982,ofaggravatedrapeandsentencedtoninetynineyears.Theconvictionwasaffirmedbythiscourt.Statev. ph Wendall[sic]GeneWatts,No.8272III,MauryCounty(Tenn.Crim.App.Oct.6,1982), < 4 app.denied(Tenn.Jan.31,1983). "  ThepetitionerfiledapetitionforpostconvictionreliefonFebruary28,1996,andsubsequentlyfiledthreeamendments.Thestaterespondedthatthepetitionwasbarredbythestatuteoflimitations. Thepostconvictioncourtgrantedahearingtodeterminewhetherthepetitionwastimebarred,andonOctober30,1997,orderedthepetitiondismissedduetothefailuretofilewithinthestatuteoflimitations.
