Theappellantssoleissueonappealiswhetherthetrialcourtproperlydeniedjudicialdiversion.Afterareviewoftherecord,werespectfullyreverseandremandthiscausetothetrialcourtforproceedingsconsistentwiththisopinion. AgentsoftheTennesseeHighwayPatrolcaughttheappellantandherhusband,whowasalsohercodefendant,inpossessionofa1991FordMustangthathadbeenstolen.ThatcarsVINtagonthedashboardhadbeenremovedandreplacedwiththeVINtagfroma1987FordMustangthatwasregisteredtotheappellantunderhermaidenname,MicheleLovely.Theappellantandherhusbandboughtthecarknowingthatithadbeenstolen.TheyalsoknewthattheVINhadbeenaltered. Theappellantarguesthatsheshouldhavebeengrantedjudicialdiversion.Sheassertsthatthetrialcourtsreasonfordenyingdiversionwas    insufficient.Indenyingdiversion,thetrialcourtstated: Thatsaprettygoodbreak.Whatyouhavetothe extentyouhaveagreedis,shesnotgoingtojail,shes notgoingtothepenitentiary.YouvegotaClassD felony,ClassEfelony,andmisdemeanorA.I understandwhatyousay,andmayhaveatheryoung age,andnopreviousrecord,andsometimestheyre propertobedeferred.Thatwasallconsidered,I thinkitshouldbedenied.Thiswasashes gettingagoodbreakonCommunityCorrections. However,thestatearguesthatthetrialcourtproperlydeniedjudicialdiversionbecausetheappellantwas awillingparticipantinthecrime.Also,thestatemaintainsthatthetrialcourtsfindingsweresufficientbecauseitdidconsidertheappellantsageandlackofcriminalrecord.However,evenifthetrialcourtsfindingswerenotsufficient,thestatecontendsthatjudicialdiversionfortheappellantshouldstillbedeniedbecausetheappellanthasfailedtoshowthatthetrialcourtabuseditsdiscretion. Whenanappellantchallengesthelength,range,ormannerofserviceofasentence,thisCourtconductsadenovoreviewwithapresumptionthatthedeterminationsmadebythetrialcourtarecorrect.Tenn.CodeAnn.4035401(d)(1990).However,judicialdiversionencompassesnotonlythemannerofservingasentencebutalsotheunderlyingconviction.Thegrantingofjudicialdiversionrestswithinthesounddiscretionofthetrialcourt,subjectonlytothesameconstraintsapplicabletoprosecutorsinthecontextofpretrialdiversion.Statev.Beverly,894S.W.2d292(Tenn.Crim.App.1994).Ifanysubstantialevidenceexiststosupportthedenialofjudicialdiversion,thetrialcourtsdecisionwillbeupheld.Statev.Anderson,857S.W.2d571(Tenn.ϜCrim.App.1992).However,ifthetrialcourtdeniesjudicialdiversiontotheaccused,it shouldclearlyarticulateandplaceintherecordthespecificreasonsforitsdetermination.Statev.Bonestel,871S.W.2d163,168(Tenn.ϜCrim.App.1993). TennesseeCodeAnnotated4035313(Supp.1996)providestheeligibilitycriteria,suchastheapplicableclassesoffelonies,forjudicialdiversion.Indeterminingwhethertograntjudicialdiversion,thetrialcourtshouldconsiderthefollowing:(1)thelikelihoodthatthedefendantwouldbecomearepeatoffender;(2)thecircumstancesoftheoffense;(3)thedefendantscriminalrecord;(4)thedefendantssocialhistory;(5)thedefendantsphysicalandmentalhealth;(6)thelikelihoodthatdiversionwoulddeternotonlythedefendantbutalsoothers.Bonestel,871S.W.2dat168. Theappellantisyoung,employed,andhasnopriorcriminalrecord.Sheapparentlysupportsheryoungchildbyherself.Theappellantdoesnotappeartohaveanysubstanceabuseorpsychologicalproblems.Thetrialcourtdidnotclearlyarticulateandplaceintherecorditsreasonsfordenyingdiversion.Therefore,werespectfullyreverseandremandthiscausetothetrialcourtforahearingtodeterminewhetherjudicialdiversioniswarrantedpursuanttoTenn.CodeAnn.4035313(Supp.1996).                   ________________________       PAULG.SUMMERS,JudgeCONCUR:_______________________________JOSEPHB.JONES,PresidingJudge_______________________________J.CURWOODWITT,JR.,Judge
