àThe€record€indicates€that€on€May€8,€1986,€Doaneððs€Market€in€Knoxville,ÏTennessee€was€being€monitored€by€Sonitrol€Security€Company€to€the€extentÐ \8ü.0 Ðthat€sound€from€inside€the€market€was€audible€at€Sonitrolððs€monitoringÏlocation.€€Rebecca€Lenear,€the€Sonitrol€employee€€who€was€monitoring€theÏsecurity€system€on€that€date,€heard€some€glass€breaking€at€2:22€a.m.€€LenearÏthen€called€the€police€and€the€owner€of€the€market€to€report€what€she€hadÏheard.€€At€2:25€a.m.,€Lenear€called€the€police€again€to€report€that€at€least€twoÏpeople€were€in€the€market.€ÌÌà ` àShortly€thereafter,€Officer€Steve€Griffin€of€the€Knoxville€PoliceÏDepartment€arrived€at€the€market€and€saw€Appellant€come€out€of€the€marketÏwith€some€cigarettes€and€saw€another€individual€walking€away€from€theÏmarket.€€Appellant€then€dropped€the€cigarettes€and€ran.€€Officer€GriffinÏpursued€Appellant€and€found€him€hiding€under€a€car.ÌÌà ` àA€subsequent€inspection€revealed€that€the€door€of€the€market€had€beenÏbattered€to€allow€for€entry.€€The€police€also€discovered€that€some€food€stampsÏhad€been€taken€and€that€several€items€had€been€stacked€outside€the€market.€ÌÌà@üü(®àò ðthat€in€allÏcriminal€prosecutions,€the€accused€hath€the€right€to€be€heard€by€himself€andÏhis€counsel.ðð€€Tenn.€Const.€art€I,€ðð€9.€€Similarly,€the€Sixth€Amendment€to€theÏUnited€States€Constitution€guarantees€that€ð ð[i]n€all€criminal€prosecutions,€theÏaccused€shall€enjoy€the€right€.€.€.€to€have€the€assistance€of€counsel€for€hisÏâ âdefense.ðð€€U.S.€Const.€amend.€VI.€€ð ðThese€constitutional€provisions€afford€toÐ ð7.0 Ðthe€accused€in€a€criminal€prosecution€the€right€to€effective€assistance€ofÏcounsel.ðð€€òòHenley€v.€Stateóó,€960€S.W.2d€572,€579€(Tenn.€1997).€€Ð P ð Ðâ âÌà ` àWhen€a€petitioner€seeks€post-conviction€relief€on€the€basis€of€ineffectiveÏassistance€of€counsel,€he€or€she€must€first€establish€that€the€services€renderedÏor€the€œadviñKñsñKññLñcñLñe›€given€was€below€ð ðthe€range€of€competence€demanded€ofÏattorneys€in€criminal€cases.ðð€€òòBaxter€v.€Roseóó,€523€S.W.2d€930,€936€(Tenn.Ð    Ð1975).€€Second,€he€or€she€must€show€that€the€deficiencies€ð ðactually€had€anÏadverse€effect€on€the€defense.ðð€€òòStrickland€v.€Washingtonóó,€466€U.S.€668,€693,Ð à€ Ð104€S.Ct.€2052,€2067ð!ð68,€80€L.Ed.2d€674€(1984).€€ð ðBecause€a€petitioner€mustÏestablish€both€prongs€of€the€test€to€prevail€on€a€claim€of€ineffective€assistanceÏof€counsel,€failure€to€prove€either€deficient€performance€or€resulting€prejudiceÏprovides€a€sufficient€basis€to€deny€relief€on€the€claim.ðð€€òòHenleyóó,€960€S.W.2d€atÐ   @ Ð580.€€ð ðIndeed,€a€court€need€not€address€the€components€in€any€particularÏorder€or€even€address€both€if€the€defendant€makes€an€insufficient€showing€ofÏone€component.ðð€€òòId.óó€€ð ðMoreover,€on€appeal,€the€findings€of€fact€made€by€theÐ p& Ðtrial€court€are€conclusive€and€will€not€be€disturbed€unless€the€evidenceÏcontained€in€the€record€preponderates€against€them.ðð€€òòAdkins€v.€Stateóó,€911Ð P*ð " ÐS.W.2d€334,€347€(Tenn.€Crim.€App.€1994).€€ð ðThe€burden€is€on€the€petitioner€toÏshow€that€the€evidence€preponderated€against€those€findings.ðð€€òòId.óóÐ 0.Ð$& ÐÌà@ÀÀ'®àò òA.€€Audio€Tapeó óˆÐ 2°(* ÐÌà ` àAppellant€first€contends€that€his€trial€counsel€was€ineffective€in€failing€toÏtake€action€to€preserve€an€audio€tape€of€the€break„in€at€the€market€that€mightÏhave€contained€exculpatory€evidence.€€Specifically,€Appellant€argues€thatÐ à9€02 Ðbecause€he€has€maintained€all€along€that€he€did€not€break€into€the€market,€butÏmerely€entered€the€market€after€it€had€already€been€broken€into,€an€audio€tapeÏof€the€break„in€might€have€contained€evidence€that€would€have€exoneratedÏhim€as€the€person€who€broke€into€the€market.ÌÌà ` àIn€its€order€denying€Appellantððs€petition,€the€post„conviction€court€foundÏthat€the€only€voice€Lenear€heard€on€the€night€of€the€break„in€was€someone€yellÏð ðTake€that.ðð€€The€post„conviction€court€also€found€that€because€LenearÏtestified€at€trial€that€she€was€unsure€whether€the€incident€at€the€market€hadÏbeen€recorded,€it€was€not€clear€that€any€audio€tape€of€the€event€ever€existed.€ÏThe€post„conviction€court€also€found€that€because€Lenear€testified€that€if€theÏincident€had€been€recorded,€it€would€not€have€been€recorded€until€after€theÏglass€had€broken,€the€only€thing€on€an€audio€tape€would€have€been€the€singleÏverbal€statement€ð ðTake€that.ðð€€Thus,€the€lower€court€found€that€if€the€audioÏtape€had€ever€existed,€it€would€not€have€contained€anything€that€would€haveÏbeen€helpful€to€Appellant.ÌÌà ` àIn€this€case,€the€evidence€simply€does€not€preponderate€against€theÏpost„conviction€courtððs€findings€of€fact.€€Indeed,€Appellant€concedes€in€his€briefÏthat€the€alleged€audio€tape€may€have€never€existed.€€Further,€Appellant€alsoÏconcedes€that€there€is€no€evidence€that€the€alleged€tape€would€have€containedÏany€exculpatory€material.€€Rather,€Appellant€claims€only€that€it€might€have.€ÏBecause€Appellant€has€obviously€failed€to€demonstrate€that€his€counselððsÏalleged€deficiency€in€failing€to€secure€the€alleged€tape€€ð ðactually€had€anÏâ âadverse€effect€on€the€defense,ðð€the€post„conviction€court€was€correct€inÐ à7€.0 Ðdetermining€that€Appellant€was€not€entitled€to€relief€on€this€basis.€€òòSeeóó€òòHenleyóó,Ð `  Ð960€S.W.2d€at€580.€€This€issue€has€no€merit.Ìâ âÌà@ðð(®àò òB.€€Witnessesó óˆÐ 0Ð ÐÌà ` àAppellant€also€contends€that€his€trial€counsel€was€ineffective€in€failing€toÏfile€a€motion€asking€the€trial€court€to€prohibit€the€State€from€directing€witnessesÏnot€to€talk€about€the€case€without€prior€approval€by€the€prosecutor.€€ÌÌà ` àThe€record€indicates€that€shortly€before€trial,€Appellantððs€trial€counselÏinformed€the€trial€court€that€two€of€the€Stateððs€witness€had€declined€to€talk€toÏhim€and€stated€that€they€would€have€to€clear€it€with€the€district€attorneyððs€officeÏfirst.€€The€trial€court€then€stated€that€it€would€have€a€recess€so€that€AppellantððsÏtrial€counsel€could€talk€to€both€of€the€witnesses€before€they€testified.€At€theÏpost„conviction€hearing,€Appellant€stipulated€that,€if€called,€the€prosecutorÏwould€testify€that€he€merely€told€the€witnesses€ð ðthat€they€had€the€right€to€talk€orÏnot€to€talk€to€the€defense€attorney€as€it€is€their€wish.ðð€ÌÌà ` àThe€post„conviction€court€found€that€although€the€witnesses€had€initiallyÏdeclined€to€talk€to€Appellantððs€trial€counsel,€trial€counsel€did€have€theÏopportunity€to€talk€to€both€witnesses€before€they€testified.€€Thus,€the€post„¼conviction€court€concluded€that€Appellant€had€not€been€prejudiced€by€the€factÏthat€trial€counselððs€initial€efforts€to€interview€the€witnesses€had€beenÏunsuccessful.€ò Ðâ âó óÐ ð7.0 Ðà ` àAlthough€Appellant€maintains€that€his€trial€counsel€was€deficient€inÏâ âfailing€to€take€action€that€may€have€induced€the€witnesses€to€talk€to€himÏsooner,€Appellant€has€failed€to€indicate€how€he€was€prejudiced€by€this€allegedÏdeficiency.€€Indeed,€assuming€that€the€witnesses€would€have€agreed€to€talk€toÏAppellantððs€trial€counsel€if€he€had€taken€the€desired€action,€Appellant€hasÏfailed€to€indicate€what€his€counsel€could€or€would€have€done€differently€thanÏhe€did€after€interviewing€the€witnesses€shortly€before€trial.€€In€fact,€AppellantððsÏonly€complaint€is€that€by€having€to€interview€the€witnesses€right€before€trial,€hisÏtrial€counsel€did€not€have€ð ¸  ÐCourt€held€that€a€trial€court€did€not€err€when€it€made€the€following€comment€toÏthe€jury€after€the€jury€announced€that€it€was€unable€to€reach€a€verdict:ÌñHñÓÓñHñà0 ` àWell,€you€havenððt€been€out€that€long€really.€€€We€donððt€need€to€knowÏhow€youððre€individually€split,€guilty€or€innocent,€but€if€youððre€stillÏdiscussing€the€case,€and€you€need€to€discuss€it,€and€if€you€reach€a€pointÏthat€you€just€absolutely€know€that€youððre€not€going€to€be€able€to€doÏanything,€thatððs€when€you€need€to€let€us€know.€€€You€need€to€get€to€thatÏpoint,€or€to€the€point€where€youððve€reached€a€verdict,€then€you€need€toÏcome€back,€either€way.€€€But,€itððs€only€4€oððclock,€and€weððve€got€a€coupleÏor€three€good€hours€here€that€we€can€work€on€this,€and€have€plenty€ofÏtime€today.€€€So€you€all€take€your€time€and€go€through€it€and€discuss€it,Ïlook€at€the€charge€we€have€given€you€and€work€with€it,€because€that'sÏwhat€youððre€supposed€to€do.€€€Youððre€supposed€to€discuss€it,€take€votesÏand€that€type€thing.€€€If€you€all€will€do€that.€€€Go€back€and€haveÏrefreshments;€€are€there€cokes€and€œthings?ñIñÐ
