ðsaw€[the€victim]€come€up€theÐ `° Ðhill€in€the€projects.ðð€€Carey€testified€that€he€knew€that€the€Petitioner€and€the€victim€had€been€in€aÐ 8 ˆ Ðprior€altercation,€so€he€told€the€Petitioner€that€they€should€leave.€€He€testified€that€they€stopped€atÐ  ` ÐBassðð€house€and€he€and€the€Petitioner€went€inside€so€Carey€could€get€a€jacket€and€a€ð ðcold€drink.ðð€Ð è 8  ÐCarey€testified€that€when€they€came€out€of€the€house,€he€ð ðheard€Kendra€saying€something,ðð€so€he€toldÐ À  Ðthe€Petitioner€to€ð ðget€in€the€car€and€donððt€even€worry€about€it.ðð€€He€recalled€that€the€ð ðwhole€timeððÐ ˜è  Ðthey€were€getting€in€the€car,€Bass€ð ðwas€doing€some€arguing€or€some€talking€to€somebody€down€theÐ pÀ Ðstreet.ðð€€Ð H˜ ÐÌà  àCarey€testified€that€as€he€was€trying€to€get€in€the€car,€the€victimððs€mother€ð ðwalked€up€theÐ øH Ðstreetðð€and€Bass€and€Cason€go€inside€the€house.€€He€stated€that€the€next€thing€he€knew,€the€PetitionerÐ Ð  Ðand€the€victim€were€arguing.€€Carey€testified€that€the€victim€appeared€to€be€ð ðreaching€for€somethingÐ ¨ø Ðor€trying€to€grab€[the€Petitioner]€or€something€like€that.ðð€€Carey€testified€that€prior€to€the€altercation,Ð €Ð Ðhe€had€seen€the€victim€in€his€car€possibly€looking€for€something.€€Carey€stated€that€he€heard€a€shotÐ X ¨ Ðand€looked€up€to€see€the€victim€walking€down€the€sidewalk€and€the€Petitioner€and€his€uncle€ð ðfightingÐ 0"€  Ðover€the€gun.ðð€€Ð $X" ÐÌà  àCarey€testified€that€the€Petitioner€did€not€appear€to€be€the€aggressor€in€the€situation.€€HeÐ ¸'#& Ðstated€that€they€ð ðasked€[the€victim]€nicely€not€to€come€up€the€street€and€when€he€came€up€the€streetÐ )à$( Ðthatððs€when€[the€Petitioner€and€the€victim]€started€arguing,€and€all€this.ðð€€Carey€noted€that€the€victimÐ h+¸&* Ðwas€bigger€than€the€Petitioner€and€that€the€Petitioner€was€ð ðscaredðð€of€the€victim.€€On€cross„Ð ° Ðexamination,€he€testified€that€he€never€saw€the€victim€with€a€weapon.€€Ð ˆØ ÐÌà  àKendra€Bass€testified€that€she€had€known€the€Petitioner€for€most€of€her€life.€€She€stated€thatÐ 8 ˆ Ðshe€lived€with€her€husband€Marcus€Carey.€€Bass€testified€that€on€the€night€of€the€offense,€she,€theÐ  ` ÐPetitioner,€Carey,€and€Cason€were€all€getting€ready€to€go€out€to€eat.€€She€recalled€that€the€foursomeÐ è 8  Ðstopped€at€her€house€ð ðto€get€a€coke.ðð€€Bass€reported€that€as€they€were€entering€the€house,€ð ðwordsÐ À  Ðstarted€going€back€and€forth.ðð€€She€testified€that€the€Petitioner€and€the€victim€were€arguing€and€thatÐ ˜è  Ðshe€said,€ð ðjust€leave€us€alone,€donððt€nobody€start€shooting€or€whatever€.€.€.€.ðð€€Bass€testified€that€sheÐ pÀ Ðwas€unlocking€the€door€to€her€house€when€she€observed€the€victim€walk€to€his€car€and€go€throughÐ H˜ Ðhis€trunk.€€She€reported€that€she€went€into€the€house€and€called€911.€€Bass€testified€that€she€did€notÐ  p Ðgo€back€outside.€€Ð øH ÐÌà  àBass€testified€that€she€gave€a€statement€to€police.€€However,€she€stated€that€she€was€neverÐ ¨ø Ðcontacted€by€anyone€else€for€information€about€the€incident.€€Bass€testified€that€she€would€have€beenÐ €Ð Ðwilling€to€talk€about€what€she€had€observed.€€On€cross„examination,€Bass€acknowledged€that€she€didÐ X ¨ Ðnot€witness€the€actual€shooting.€€She€also€stated€that€she€did€not€see€the€victim€with€a€gun.€€Ð 0"€  ÐÌà  àLaShelta€Cason€testified€that€on€the€night€of€the€offense,€she,€the€Petitioner,€Carey,€and€BassÐ à%0!$ Ðwere€all€about€to€go€out.€€She€testified€that€she€was€dating€the€Petitioner€at€the€time.€€According€toÐ ¸'#& ÐCason,€before€going€out,€they€stopped€at€Bassðð€house€to€get€something€to€drink.€€She€stated,€ð ðWe€allÐ )à$( Ðgot€out€of€the€car,€[and]€a€conflict€got€started€between€[the€Petitioner]€and€[the€victim].ðð€€CasonÐ h+¸&* Ðtestified€that€Bass€went€inside€the€house€to€call€the€police,€and€Cason€followed€her.€€She€reported€thatÐ ° Ðit€did€not€appear€as€if€the€Petitioner€wanted€to€ð ðstart€somethingðð€with€the€victim.€€CasonÐ ˆØ Ðacknowledged€that€the€victim€was€quite€a€bit€bigger€than€the€Petitioner.€€Ð `° ÐÌà  àCason€testified€that€the€gave€a€statement€to€police,€but€was€not€contacted€by€defense€counsel.€Ð  ` ÐShe€stated€that€she€would€have€been€willing€to€provide€defense€counsel€with€information€about€theÐ è 8  Ðincident.€€On€cross„examination,€Cason€acknowledged€that€she€did€not€actually€see€the€shooting€andÐ À  Ðthat€she€did€not€see€the€victim€with€a€weapon.€€She€also€stated€that€she€did€not€see€the€Petitioner€withÐ ˜è  Ða€weapon.€€Cason€testified€that€before€the€shooting,€she€saw€the€victim€looking€through€his€car.€€Ð pÀ ÐÌà  àThe€Petitioner€testified€that€he€was€twenty„three„years„old€at€the€time€of€the€post„convictionÐ  p Ðhearing.€€He€testified€that€another€attorney€represented€him€at€the€general€sessions€level.€€He€statedÐ øH Ðthat€the€first€time€he€met€counsel€was€while€he€was€in€River€Bend.€€The€Petitioner€recalled€that€a€manÐ Ð  Ðaccompanied€counsel€to€the€prison.€€He€testified€that€he€tried€to€ask€counsel€about€his€case€and€theÐ ¨ø Ðpossibility€of€a€self„defense€argument.€€The€Petitioner€stated,€the€ð ðonly€thing€they€kept€telling€me€ifÐ €Ð ÐI€go€to€trial€Iððm€going€to€get€a€life€sentence€and€so€I€needed€to€take€fifteen€years€at€eighty„fiveÐ X ¨ Ðpercent.€€He€recalled€that€he€met€with€counsel€for€approximately€an€hour€on€that€day.€€The€PetitionerÐ 0"€  Ðtestified€that€he€told€counsel€about€potential€witnesses€and€told€her€about€a€prior€incident€where€theÐ $X" Ðvictim€allegedly€hit€the€Petitioner€with€brass€knuckles.Ð à%0!$ ÐÌà  àThe€Petitioner€testified€that€he€also€talked€to€counsel€on€the€day€that€he€accepted€the€pleaÐ )à$( Ðagreement.€€He€stated€that€the€first€time€he€appeared€in€court€before€Judge€Bond€was€when€heÐ h+¸&* Ðaccepted€the€plea€agreement.€€The€Petitioner€reported€that€the€first€time€he€heard€of€the€offer€was€Ð ° Ðthe€day€he€accepted€the€plea€agreement.€€He€maintained€that€he€did€not€meet€with€counsel€betweenÐ ˆØ Ðthe€visit€at€River€Bend€and€when€he€pled€guilty.€€The€Petitioner€stated€that€before€he€accepted€theÐ `° Ðplea,€counsel€talked€to€him€about€the€offer.€€However,€he€contends€that€he€did€not€understandÐ 8 ˆ Ðð ðbecause€the€only€thing€that€was€on€[his]€mindðð€was€the€thought€that€if€he€went€to€trial€he€was€goingÐ  ` Ðto€get€a€life€sentence.€€The€Petitioner€testified€that€he€continued€to€ask€counsel€about€the€possibilityÐ è 8  Ðof€a€self„defense€argument.€€He€testified€that€on€the€day€he€pled€guilty,€he€spoke€to€counsel€for€aboutÐ À  Ðthirty€minutes.€€Ð ˜è  ÐÌà  àThe€Petitioner€testified€that€he€never€saw€the€indictment.€€He€stated€that€counsel€did€notÐ H˜ Ðexplain€to€him€how€self„defense€would€work€or€the€elements€of€voluntary€manslaughter.€€TheÐ  p ÐPetitioner€maintains€that€he€was€never€told€that€he€could€be€convicted€of€a€lesser€offense€if€heÐ øH Ðproceeded€to€trial.€€He€maintains€that€he€would€not€have€pled€guilty€if€he€had€been€informed€that€heÐ Ð  Ðmight€have€been€convicted€of€a€lesser€offense€at€trial.€€He€stated€that€he€did€not€believe€he€had€anyÐ ¨ø Ðother€options€other€than€accepting€the€fifteen€year€plea€agreement.€€Ð €Ð ÐÌà $X" Ðhouse€when€they€saw€the€victim€drive€ð ðup€the€hill.ðð€€The€Petitioner€stated€that€the€foursome€went€toÐ à%0!$ ÐBassðð€house€to€get€something€to€drink.€€According€to€the€Petitioner,€when€they€came€outside,€theÐ ¸'#& Ðvictimððs€mother€began€telling€the€Petitioner€that€he€should€have€left€her€son€alone.€€The€PetitionerÐ )à$( Ðtestified€that€Carey€told€him€to€get€in€the€car.€€He€stated€that€he€was€going€to€get€in€the€car,€but€theÐ h+¸&* Ðvictim€and€his€mother€kept€walking€towards€him.€€The€Petitioner€reported€that€he€said€something€toÐ ° Ðthe€victim€which€ð ðgot€him€hot.ðð€€He€reported€that€he€stepped€out€into€the€street€and€was€surroundedÐ ˆØ Ðby€the€victim,€the€victimððs€mother,€and€the€victimððs€uncle.€€Ð `° ÐÌà  àThe€Petitioner€testified€that€they€were€ð ðhaving€wordsðð€when€he€saw€the€victim€ð ðreach€for€aÐ  ` Ðgun.ðð€€He€stated€that€he€believed€that€his€actions€were€taken€in€self„defense.€€The€Petitioner€testifiedÐ è 8  Ðthat€he€saw€the€victimððs€nephew€ð Ðregarding€lesser„included€offenses€and€what€the€State€had€to€prove€in€his€case.€€He€also€stated€thatÐ pÀ Ðcounsel€did€not€review€the€range€of€punishment€that€he€could€face.€€When€asked€if€he€made€aÐ H˜ Ðknowledgeable€choice€to€plead€guilty,€the€Petitioner€stated,€ð ðI€was€scared,€sir.€€I€was€scared€becauseÐ  p ÐI€didnððt€want€to€get€no€life€sentence.€€I€had€two€kids€I€had€to€get€home€to,€so€I€took€the€fifteen,€whatÐ øH Ðthey€was€telling€me€to€take.ðð€€He€testified€that€he€did€not€feel€like€counsel€properly€represented€him.€Ð Ð  ÐThe€Petitioner€reported€that€he€did€not€have€the€benefit€of€knowing€what€the€witnesses€would€testifyÐ ¨ø Ðto€at€trial€or€the€benefit€of€any€investigation€by€the€defense.€€Ð €Ð ÐÌà à%0!$ Ðacknowledged€that€it€was€signed€on€January€15,€1999.€€He€also€acknowledged€that€he€pled€guilty€onÐ ¸'#& ÐJanuary€22,€1999.€€The€Petitioner€then€tried€to€say€that€he€pled€guilty€on€the€same€day€that€he€signedÐ )à$( Ðthe€agreement.€€He€stated€that€if€he€did€sign€on€a€different€day,€he€did€ð ðnot€remember€seeing€it.ðð€€Ð h+¸&* Їà  àThe€Petitioner€admitted€that€when€he€pled€guilty,€he€told€the€trial€court€that€he€understoodÐ °
