Wereversethejudgmentofthetrialcourtandremandthiscasetothetrialcourtforfurtherproceedings. Threedaysafterthedefendantassaultedaguard,adisciplinaryhearingwasheld.Thehearingofficersuspendedthedefendantscanteenprivilegesforsixweeks,tookaway56daysofsentencereductioncredits,andorderedpaymentof$100.00inrestitutionfortheguardsuniform. Thetrialjudgefoundtheordertopay$100.00restitutionamountedtoafinewhichwasimposedforthepurposeofvindicatingpublicjusticeandbarredtheprosecutionofthedefendantundertheprohibitionagainstdoublejeopardy. InStatev.Conley,639S.W.2d435(Tenn.1982),theSupremeCourtheldpriorpunishmentfordoublejeopardypurposesconsistsofdeprivationoflibertyinapriorproceedingortheimpositionofafineleviedforthepurposeofvindicatingpublicjustice.Eitherorbothwillconstituteabartoasubsequentprosecution. Thequestionhereiswhethertherestitutionorderof$100.00issuchapunishment.Wethinknot. Itisclearthatdisciplinaryactionbyprisonauthoritiesdoesnotbarprosecutionforthecommissionofthecrimefromwhichtheprisonimposeddisciplinarysanctions.Rayv.State,577S.W.2d681(Tenn.Crim.App.1978).TheRaycase,however,didnotencompassthesanctionofforfeitureofmoneyasdoesthiscase.   Wedonotbelieve,onthebasisofthefactsinthiscase,thatrequiringthepaymentof$100.00restitutionfordamagestotheuniformoftheguardcanbesaidtobeanimpositionofafineforthepurposeofvindicatingpublicjustice.Althoughtheevidenceofthevalueoftheuniformvisavistheimpositionof$100.00inrestitutionisnotshown,weareunabletoconcludethattheamountissodisproportionatetotheactualdamagetobeconstruedasbeingafineforthepurposeofpunishmentfortheunderlyingcrimeaswasfoundinU.S.v.Halper,109S.Ct.1892,490U.S.435(1989).Wefindtheimpositionofrestitutionbyprisonauthoritiesisnotgrosslydisproportionatetotheremedialinterestinmaintainingdisclipinarycontroloftheprisons.SeeHernandezv.Fundora,58F.3d802(2dCir.1995).Infact,itappearsanassessmentof$100.00ismadeagainstanyinmatewhosemisconductcausesdamagetoaguardsuniformwithoutregardtotheactualdamage.Wefindthisisapartofinstitutionaldiscipline. Thetrialjudgesconclusionthatrestitutionisonlytobeconsideredbythetrialjudgeis,inourview,broaderthanthesentencingactprovidesandgivesnobasisfordismissingtheindictmentinthiscase.
