àThe€Petitioner€was€indicted€by€a€Shelby€County€Grand€œJury;›€and€onÏOctober€10,€1994,€he€pleaded€guilty€to€attempted€first€degree€murder,€especiallyÏaggravated€robbery,€aggravated€robbery,€and€aggravated€rape.€€The€PetitionerÏwas€sentenced€as€a€Range€I€standard€offender.€€He€received€a€twelve„yearÏsentence€for€aggravated€robbery€and€fifteen„year€sentences€for€aggravated€rape,Ïespecially€aggravated€œrobbery,›€and€attempted€first€degree€murder.€€TheÏaggravated€robbery€and€aggravated€rape€sentences€were€ordered€to€runÏconcurrent€with€each€other,€but€consecutive€to€the€especially€aggravated€robberyÏand€attempted€first€degree€murder€sentences.€€The€especially€aggravatedÏrobbery€and€attempted€first€degree€murder€sentences€were€ordered€to€runÏconcurrent€with€each€œother.€€Therefore,€the€Petitionerððs€effective€sentence€wasÏthirty€years€as€a€Range€I€standard€offender.Ìà Ðand€both€the€sentencing€ranges€for€his€crimes€and€the€sentence€to€be€imposedÏupon€him€by€the€trial€court.€€He€stated€that€he€understood€he€was€giving€up€hisÏright€to€a€trial€by€jury.€€He€indicated€that€his€legal€representation€had€beenÏadequate€and€reported€that€he€had€no€complaints€concerning€the›€representationÏhe€had€received.€€He€stated€that€his€attorney€adequately€interviewed€witnessesÏor€discussed€with€him€testimony€of€witnesses€the€Petitioner€wished€œñ/ñto€call€ñ/ññ/ñ›ñ/ñon›€hisÏbehalf.€€He€also€reported€that€he€had€not€been€forced€or€coerced€to€make€hisÏplea.€€€€€ÌÌà Ðwas€appointed€to€represent€the€Petitioner.€€The€amended€petition€alleged€that€theÏPetitionerððs€plea€was€involuntary€due€to€ineffective€assistance€of€counsel.€ÏSpecifically,€the€Petitioner€claimed€that€his€attorney€had€a€conflict€of€interest€atÏthe€time€of€his€representation€and€that€his€attorney€allowed€the€prosecutor€toÏintimidate€the€Petitioner€in€the€attorneyððs€presence,€which€resulted€in€a€coercedÏguilty€plea.€€Evidentiary€hearings€were€conducted€on€March€20,€1997€and€May€23,Ï1997.€€Ô‡Š3ZŠŠŠ3ZÔThe€trial€court€denied€Petitionerððs€petition€for€post„conviction€relief€byÐ P*ð " Ðwritten€order€filed€July€25,€1997.Ô#†Š3ZŠŠŠ3Z¨#Ô€€Ð @,à"$ ÐÌà ` àAt€the€evidentiary€hearing€conducted€on€March€20,€1997,€the€PetitionerÏtestified€that€Marvin€Ballin€was€appointed€to€represent€him€in€œJuly›€1994.€€He€saidÏthat€prior€to€the€appointment€of€Marvin€Ballin€as€his€attorney,€he€sought€theÏrepresentation€of€Leslie€Ballin,€Marvin€Ballinððs€œson,›€with€whom€Marvin€BallinÐ ð5,. Ðpracticed€œlaw.›€€The€Petitioner€stated€that€Leslie€Ballin€accepted€two€hundredÏdollars€for€Petitionerððs€representation,€subsequently€withdrew€from€the€case,€andÏthen€refused€to€refund€the€money.€€Although€the€Petitioner€claimed€to€have€filedÏa€complaint€against€Leslie€Ballin€with€the€disciplinary€board,€the€PetitionerÏproduced€no€proof€of€the€complaint€at€the€hearing.€€He€maintained€that€he€did€notÏknow€that€Leslie€and€Marvin€Ballin€practiced€law€together€until€after€MarvinÏBallinððs€appointment€as€his€attorney.€€He€also€admitted€that€he€never€discussedÏwith€Marvin€Ballin€the€alleged€fee€dispute€or€his€previous€dealings€with€LeslieÏBallin,€but€he€claimed€not€to€have€done€so€because€he€did€not€realize€initially€thatÏLeslie€Ballin€was€Marvin€Ballinððs€son€and€partner€in€practice.€€In€addition,€contraryÏto€his€statements€at€the€guilty€plea€proceeding,€the€Petitioner€testified€thatÏalthough€he€had€given€his€attorney€the€names€of€witnesses,€his€attorney€failed€toÏinterview€those€witnesses,€excepting€only€the€Petitionerððs€mother.€€ÌÌà ` àThe€Petitioner€further€testified€that€on€October€7,€1994,€during€hisÏincarceration€pending€disposition€of€this€case,€he€was€brought€to€court€to€meetÏwith€his€attorney€and€discuss€a€guilty€plea.€€He€testified€that€his€attorney,€of€hisÏown€accord,€brought€the€prosecutor€œto›€the€holding€room€for€prisoners€in€theÏcourthouse.€€He€stated€that€his€attorney€allowed€the€prosecutor€to€ð ðbadgerðð€him.€ÏHe€testified€that€the€prosecutor€told€him€that€the€judge€handling€his€case€enjoyedÏprosecuting€people€like€the€Petitioner.€€The€Petitioner€testified€that€theÏconversation€left€him€ð ðsomewhat€rattled„shakenðð€and€that€when€the€prosecutorÏð ðtalked€about€Judge€Blackwood,€I€already€knew€based€on€what€[the€prosecutor]Ïhad€stated€that€it€wasnððt€going€to€be€anything€fair€going€on€that€day.ðð€€PetitionerÏalso€reported€that€on€October€10,€1994,€the€day€of€his€plea,€his€attorney€told€himÏhe€needed€to€take€the€offer€from€the€prosecution€because€he€ð ðdidnððt€give€a€s__t,ððÐ Ð9p02 Ðwhich€the€Petitioner€interpreted€to€mean€that€his€attorney€ð ðdidnððt€care€about€meÏor€the€case.ðð€ÌÌà ` àThe€Petitioner€maintained€that€as€a€result€of€these€conversations,€heÏpleaded€guilty.€€He€explained,€œÌñ2ñÓÓñ2ññ3ñÌñ3ñà8 ` àñ0ñð ðñ0ñfor›€the€most€part,€it€was€more€or€less€of€me€tired€of€seeing€my€familyÏdragged€down€here.€€I€got€tired€of€being€dragged€down.€€It€was€oneÏbig€circus€act€after€another.€€And€I€was€just€basically€tired€andÏdrained.€.€.€.€€I€was€just€looking€for€some€relief.€€Not€necessarily€forÏme€but€for€my€family€œalso.ñ1ñðð€›€›ñ1ñÐ ` ü!` ü! Ðñ4ñÌñ4ñÌñ5ñÓÓñ5ñà ` àWhen›€asked€at€the€post„conviction€hearing€why€he€told€the€judge€at€hisÏplea€hearing€that€his€plea€had€not€been€forced€or€coerced,€the€Petitioner€statedÏthat€his€answer€to€the€question€was€ð ða€very,€very€uneducated€statement.ðð€€He€alsoÏtold€the€post„conviction€court€that€in€response€to€other€questions€posed€by€theÏjudge€at€his€guilty€plea€proceeding,€he€entered€ð ðunwilling€statements.ðð€€HeÏadmitted€that€when€the€trial€judge€asked€whether€he€had€chosen€to€plead€guiltyÏfreely€and€voluntarily,€he€answered€yes,€but€he€stated€at€the€post„convictionÏproceeding€that€his€answer€was€ð ðsort€of€withdrawn.ððÌ€€Ìà ` àThe€Petitioner€testified€that€he€œdecided€to€plead›€guilty€and€that€he€knew€heÏwas€pleading€guilty€to€thirty€years.€€However,€he€stated€that€he€pleaded€guiltyÏafter€he€ð ðhad€seen€how€everything€went.ðð€€He€indicated€that€although€he€came€toÏcourt€on€the€day€of€his€plea€fully€prepared€to€go€to€trial,€he€pleaded€guilty€becauseÏð ðI€was€really€just€afraid,€really,€of€the€worse€[sic]€happening,€which€was€[a€possibleÏsentence€of]€eighty„seven€years.ðð€€He€stated€that€he€ð ðmade€a€very€uncalculatedÏdecision.ððÔ‡Š3ZŠŠŠ3ZÔ€€He€explained€that€the€judge€told€him€he€ð ðwould€have€to€acceptÐ à7€.0 ÐAttorney€Ballinððs€services€or€represent€[himself],ððÔ#†Š3ZŠŠŠ3Z&+#Ô€which€he€did€not€feel€preparedÐ Ð9p02 Ðto€œdoñ2ñ›ñ2ñ;›€and€he€indicated€that€he€was€afraid€his€attorney€might€not€adequatelyÏrepresent€him€at€trial.ÌÌà ` àMarvin€Ballin,€the€Petitionerððs€œattorney,›€who€had€practiced€criminal€law€forÏapproximately€thirty€years,€also€testified€at€the€post„conviction€proceeding.€€HeÏtestified€that€initially€he€and€the€Petitioner€ð ðhad€our€difficulties,ðð€which€they€Ïð ðironed€out.ðð€€Ballin€testified,€ð ðrealizing€that€Mr.€Wells€was€going€to€be€a€mostÏdifficult€client,€I€prepared€for€that€case€as€best€any€lawyer€could.ðð€€He€reportedÏthat€prior€to€the€Petitionerððs€plea,€he€spent€ð ðliterally€hours€at€home€on€theÏtelephone€at€nightðð€with€the€Petitionerððs€mother€discussing€the€case.€€Although€theÏPetitioner€insisted€that€his€mother€never€wanted€him€to€plead€guilty,€Ballin€Ïtestified€that€to€the€best€of€his€recollection,€the€Petitionerððs€mother€advised€himÏto€plead€guilty.ÌÌà ` àWith€regard€to€the€Petitionerððs€conflict€of€interest€claim,€Ballin€testified€thatÏhe€first€became€aware€of€the€Petitionerððs€complaint€when€he€read€about€theÏalleged€fee€dispute€in€the€petition€for€post„conviction€relief.€€He€stated€that€theÏPetitioner€never€mentioned€to€him€that€Leslie€Ballin€had€once€represented€him€orÏthat€Leslie€Ballin€owed€him€money.€€He€reported€that€when€he€discussed€theÏPetitionerððs€allegations€with€his€son,€his€son€told€him,€ð ðyeah,€he€was€up€here,€butÏI€didnððt€take€the€case,€and€thatððs€about€all€I€know.ðð€€€With€regard€to€the€twoÏhundred€dollars,€Ballin€identified€a€receipt€provided€by€the€Petitioner€signifyingÏthat€his€office€received€the€sum€of€two€hundred€dollars€from€the€Petitioner€on€MayÏ27,€1992.€€However,€he€œstated,€ðð[the›€Petitioner€has]€made€an€accusation€that€I€didÐ ð5,. Ðsomething€about€a€lousy€$200€that€affected€his€life,€and€that€is€a€consummateÏlie.ðð€Ð Ð9p02 Їà ` àBallin€also€testified€that€he€conducted€extensive€discovery€in€theÏPetitionerððs€case.€€In€addition,€he€testified€that€he€filed€a€number€of€motions€toÏsuppress€evidence,€which€were€denied€by€the€trial€court.€€He€testified€that€to€theÏbest€of€his€recollection,€there€were€no€alibi€witnesses€in€the€Petitionerððs€case€andÏthe€Petitionerððs€defense€was€mistaken€identity.€€€ÌÌà ` àBallin€reported€that€on€the€day€that€the€Petitionerððs€trial€was€to€be€held,€theÏPetitioner€ð ðwanted€to€go€in€the€back€and€talk€and€discuss€the€possibilities€of€aÏplea.ðð€€He€testified€that€although€he€told€the€Petitioner€the€State€was€adamantÏabout€its€offer,׃×Ý ƒª¥ÝÔ€Š3ZŠŠŠ3ZÔÔ€Š3ZŠŠŠ3ZÔòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×€the€Petitioner€was€insistent€in€his€belief€that€Ballin€could€procureÐ Ðp Ða€better€offer€for€him.€€He€testified€he€told€the€Petitioner,€ð ðlook,€if€you€want€to,€IððllÏgo€ask€[the€prosecutor],€and€you€can€see€that€Iððm€doing€my€job,€that€I€have€triedÏto€get€you€the€best€thing€going,€and€you€can€either€plead€or€go€to€trial.€€TheyððreÏnot€going€to€come€off€that€offer.ðð€€He€reported€that€the€prosecutor€did€talk€to€theÏPetitioner,€and€although€he€was€unsure,€he€believed€that€the€prosecutor€did€soÏat€the€Petitionerððs€insistence.€He€testified€that€the€prosecutor€ð ðmay€have€raisedÏhis€voice,€but€it€was€at€me€rather€than€Mr.€Wells.ðð€€He€stated€that€the€prosecutorÏdid€not€threaten€the€Petitioner€but€ð ðtold€me€that€if€[the€Petitioner]€got€convicted,Ïhe€sure€as€heck€was€going€to€max€him€out€or€that€the€judge€was€going€to€max€himÏout,€and€the€chances€were€there€to€get€consecutive€[sentences]€to€where€heððd€beÏlooking€at€fifty€[years].€.€.€.€This€case€was€not€a€very€nice€case.ðð€€He€also€testifiedÏthat€he€was€present€the€entire€time€the€prosecutor€remained€in€the€room€with€hisÏclient,€which€was€approximately€two€to€three€minutes.€ÌÐ ð5,. Ðà ` àBallin€testified€that€it€was€his€opinion€that€the€Petitioner€pleaded€guiltyÏbecause€Ballin€told€him€ð ðthere€was€every€possibility€that€[his]€cases€could€runÏconsecutiveðð€due€to€the€heinous€nature€of€the€crimes€with€which€the€PetitionerÏwas€charged.€€He€stated€he€told€the€Petitioner€that€based€upon€what€he€knew€ofÏthe€trial€judgeððs€reputation,€the€trial€judge€would€likely€ð ðmax€him€every€way€heÏcould.ðð€€He€also€testified€that€he€believed€the€Petitioner€decided€to€plead€guiltyÏbecause€he€told€the€Petitioner€ð ðthat€once€the€evidence€went€in,€we€were€inÏœtrouble.ñ4ñ›ñ4ñðð›ÌÌà ` àIn€determining€whether€counsel€provided€effective€assistance€at€trial,€theÏCourt€must€decide€whether€counselððs€performance€was€within€the€range€ofÏcompetence€demanded€of€attorneys€in€criminal€cases.€€òòBaxter€v.€Roseóó,€523Ð °P ÐS.W.2d€930,€936€(Tenn.€1975).€€To€succeed€on€a€claim€that€œcounsel›€wasÏineffective€at€trial,€a€petitioner€bears€the€burden€of€showing€that€œcounsel›€madeÏerrors€so€serious€that€œñ6ñhe€ñ6ñwas›€not€functioning€as€counsel€as€guaranteed€under€theÏSixth€Amendment€and€that€the€deficient€representation€prejudiced€the€petitioner,Ïresulting€in€a€failure€to€produce€a€reliable€result.€€òòStrickland€v.€Washingtonóó,€466€Ð `(  ÐU.S.€668,€687€(1984);€òòCooper€v.€Stateóó,€849€S.W.2d€744,€747€(Tenn.€1993);€òòButleróóÐ P*ð " Ðòòv.€Stateóó,€789€œS.W.2d›€898,€899€(Tenn.€1990).€€To€satisfy€the€second€prong,€theÐ @,à"$ Ðpetitioner€must€show€a€reasonable€probability€that,€but€for€counselððsÏunreasonable€error,€the€œfact„finder›€would€have€had€reasonable€doubt€regardingÏthe€petitionerððs€guilt.€€òòStricklandóó,€466€S.W.2d€at€695.€€This€reasonable€probabilityÐ 2°(* Ðmust€be€ð ðsufficient€to€undermine€confidence€in€the€outcome.ðð€€òòHarris€v.€Stateóó,€875Ð 4 *, ÐS.W.2d€662,€665€(Tenn.€1994).Ìâ âÐ à7€.0 Ðà ` àWhen€reviewing€trial€counselððs€actions,€this€Court€should€not€use€theÏâ âbenefit€of€hindsight€to€second„guess€trial€strategy€and€criticize€counselððs€tactics.€ÏòòHellard€v.€Stateóó,€629€S.W.2d€4,€9€(Tenn.€1982).€€Counselððs€alleged€errors€shouldÐ @ à Ðbe€judged€at€the€time€they€were€made€in€light€of€all€facts€and€circumstances.€ÏòòStricklandóó,€466€U.S.€at€690;€òòseeóó€òòCooperóó,€849€S.W.2d€at€746.Ð  À ÐÌà ` àThis€two„part€standard€of€measuring€ineffective€assistance€of€counsel€alsoÏapplies€to€claims€arising€out€of€the€plea€process.€€òòHill€v.€Lockartóó,€474€U.S.€52Ð ð  Ð(1985);€òòBankston€v.€Stateóó,€815€S.W.2d€213,€215€(Tenn.€Crim.€App.€1991).€€TheÐ à€ Ðprejudice€requirement€is€modified€so€the€petitioner€ð ðmust€show€that€there€is€aÏreasonable€probability€that,€but€for€counselððs€errors,€he€would€not€have€pleadedÏguilty€and€would€have€insisted€on€going€to€trial.ðð€€òòHillóó,€474€U.S.€at€59.Ð °P ÐÌà ` àTurning€now€to€the€case€before€us€and€the€Petitionerððs€claim€of€a€conflictÏof€interest,€the€trial€court€stated:Ìœñ4ñÓÓñ4ñ›ñ7ñÓÓñ7ñà8 ` àà ¸ àThis€Court€finds€that€no€conflict€of€interest€existed€betweenÏPetitioner€and€his€attorney,€Marvin€Ballin,€because€Petitioner€did€notÏdemonstrate€that€counsel€actively€represented€conflicting€interestÏ[sic],€nor€did€Petitioner€demonstrate€that€an€actual€conflict€of€interestÏadversely€affected€his€lawyers€[sic]€performance.€€PetitionerÏprovided€no€evidence€that€counsel€was€conflicted€due€to€a€priorÏdispute€between€Petitioner€and€Leslie€Ballin.€€Petitioner€did€not€evenÏprovide€any€evidence€that€his€counsel€was€even€aware€of€the€priorÏdispute€between€Petitioner€and€Leslie€Ballin.€€Furthermore,€Ballin,Ïhimself,€did€not€even€consider€the€prior€dispute€to€be€a€conflict€ofÏinterest€until€well€after€he€entered€his€guilty€plea.Ð ` ü!` ü! Ðà8 ` àà ¸ àBecause€this€Court€finds€that€no€conflict€of€interest€existed,Ïthe€Petitioner€must€demonstrate€(1)€that€counselððs€performance€wasÏdeficient€and,€(2)€that€there€is€a€reasonable€probability€that€but€forÏcounselððs€deficient€performance,€Petitioner€would€not€have€pleadedÏguilty.€€In€the€case€at€hand,€Petitioner€has€failed€to€meet€the€burden.€Ð ` ü!` ü! ÐÌÓÓWe€agree€that€the€Petitioner€has€failed€to€provide€sufficient€proof€of€a€conflict€of€Ïinterest€to€support€his€allegations.€€In€fact,€in€his€brief,€the€Petitioner€concedes:€Ð Ø8x/1 Ðð ðWhile€the€proof€at€the€evidentiary€hearings€in€this€case€did€not€show€an€actualÏconflict€it€does€shed€light€on€the€nature€of€the€relationship€between€Marvin€BallinÏand€œPetitioner€.›€.€.€.ðð€€This€issue€is€without€merit.ÌÌà ` àThe€Petitioner€next€argues€that€he€received€ineffective€assistance€ofÏcounsel€because€his€attorney€allowed€the€prosecutor€to€threaten€him,€whichÏresulted€in€a€coerced€and€involuntary€guilty€plea.€€In€reviewing€this€issue,€the€trialÏcourt€concluded€that€ð ðPetitioner€entered€his€guilty€pleas€freely€and€voluntarily.ðð€ÏBased€upon€a€thorough€review€of€the€facts,€we€are€unable€to€conclude€that€theÏPetitioner€received€ineffective€assistance€of€counsel€or€that€the€Petitionerððs€pleasÏwere€made€involuntarily.€€The€meeting€between€the€Petitioner€and€the€prosecutorÏtook€place€in€the€presence€of€the€Petitionerððs€attorney.€€While€the€PetitionerððsÏattorney€confirmed€the€Petitionerððs€allegations€that€the€prosecutor€stronglyÏadvised€the€Petitioner€he€would€seek€the€maximum€penalty€should€the€PetitionerÏproceed€to€trial€and€that€he€believed€the€trial€judge€would€grant€the€maximumÏpenalty€in€Petitionerððs€case,€we€conclude€that€the€Petitioner€has€not€carried€hisÏburden€of€showing€that€this€incident€forced€him€to€enter€a€guilty€plea.€€PetitionerððsÏattorney€arranged€this€confrontation€because€Petitioner€was€unconvinced€that€theÏplea€agreement€offered€was€the€most€favorable€one€the€State€would€consider.€ÏThe€incident€took€place€on€a€Friday,€and€the€Petitioner€had€a€full€weekend€toÏconsider€his€options€before€deciding€to€plead€guilty€the€following€Monday.€€HeÏwas€also€granted€ample€opportunities€by€the€trial€judge€to€voice€his€concerns€atÏthe€guilty€plea€proceeding€and€did€not€do€so.€€We€therefore€agree€with€theÏconclusion€of€œthe›€trial€court.׃×Ý ƒª¥ÝÔ€Š3ZŠŠŠ3ZÔÔ€Š3ZŠŠŠ3ZÔòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×Ð ð5,.
