OnAugust11,1993,thePetitionerpleadedguiltytoonecountofaggravatedburglary,fivecountsofburglary,onecountoftheftover$1000,onecountoftheftover$500,andonemisdemeanorcountoftheftunder$500.HewassentencedasaRangeII,multipleoffendertosixyearsforaggravatedburglary,fouryearsforeachburglaryconviction,fouryearsfortheftover$1000,twoyearsfortheftover$500,andelevenmonthsandtwentyninedaysforthetheftunder$500conviction.Thesentenceswereorderedtorunconcurrentlywitheachother,buttheaggravatedburglaryconvictionandthefiveburglaryconvictionswereorderedtobeservedconsecutivelytoseveralpriorconvictions.ϜThePetitionerwaivedhisrighttoappeal.̀ OnJune11,1996,thePetitionerfiledtheprosepetitionforpostconvictionreliefwhichisthesubjectofthisappeal.Inthepetition,hearguedthathistrialcounselrenderedineffectiveassistanceduringtheguiltypleaproceedingsandthathisguiltypleaswerenotenteredknowinglyorvoluntarilybecausehedidnotunderstandtheconsequencesofthepleashewasentering.ThetrialcourtreviewedthepetitionandreviewedtheaudiotapedrecordingofthehearingontheguiltypleasconductedonAugust11,1993.ThetrialcourtdismissedthePetitionwithoutconductinganevidentiaryhearing,concludingthatthepetitionwasbasedon blatentliesandmisrepresentationsthatwerewithoutmerit.Weaffirmthejudgmentofthetrialcourtnotonthisreasoning,butbecausethePetitionersclaimsaretimebarred. AlthoughthePetitionerhasarguedthemeritsofhispetitioninthisappeal,theStatecountersthatthepetitionwasproperlydismissedbecauseitwastimebarred.ThePetitioneracknowledgesinhispetitionthatitwasfiledbeyondtheoneyearstatuteoflimitations,butarguesthatitshouldbegovernedbythepriorPostConvictionProcedureActthatprovidedathreeyearstatuteoflimitations.Wedisagree.AtthetimethePetitionersconvictionsbecamefinal,thestatuteoflimitationsapplicabletopostconvictionproceedingswasthreeyears.Tenn.CodeAnn.4030102(repealed1995).ThethreeyearstatuteoflimitationswassubsequentlyshortenedtooneyearbythenewPostConvictionProcedureAct,whichtookeffectonMay10,1995.SeeTenn.CodeAnn.4030201etseq.(Supp.1996).AtthetimethenewActtookeffect,thepreviousthreeyearstatuteoflimitationshadnotexpiredforthePetitioner. Ofcourse,thenewPostConvictionProcedureActgovernsthispetitionandallpetitionsfiledafterMay10,1995.SeeTenn.CodeAnn.4030201etseq.(Supp.1996).ThisActprovides,inpertinentpart,that notwithstandinganyotherprovisionofthisparttothecontrary,anypersonhavinggroundforreliefrecognizedunderthispartshallhaveatleastone(1)yearfromMay10,1995,tofileapetitionoramotiontoreopenapetitionunderthispart.CompilersNotestoTenn.CodeAnn.4030201(Supp.1996)(referringtoActs1995,ch.207,3).BecausethepreviousthreeyearstatuteoflimitationshadnotexpiredforthePetitioneratthetimethenewActtookeffect,hisrighttopetitionforpostconvictionreliefsurvivedunderthenewAct.Statev.Carter,___S.W.2d___(Tenn.1997). Asaresult,thePetitionerhadoneyearfromtheeffectivedateofthenewAct,May10,1995,tofileforpostconvictionrelief.SeeCompilersNotestoTenn.CodeAnn.4030201(Supp.1996)(referringtoActs1995,ch.207,3);Tenn.CodeAnn.4030202(a)(Supp.1996).HefiledhispetitionforpostconvictionreliefonJune11,1996,aboutonemonthaftertheexpirationoftheoneyearperiod.ThePetitionerhasnotallegedthathefitswithinoneoftheenumeratedexceptionstotheoneyearstatuteoflimitations.SeeTenn.CodeAnn.4030202(b)and202(c)(Supp.1996).Accordingly,weconcludethatthepetitionisbarredbythestatuteoflimitations.Furthermore,thetrialcourtmaysummarilydismissapetitionthatwasnotfiledwithintheapplicablestatuteoflimitations.SeeTenn.CodeAnn.4030206(b).
