Beforemakingitsfinding,thetrialcourtreviewedtheDefendantsrecord,notingthatthe   Defendanthadbeenarrestedeleventimesfordrivingonarevokedorsuspendedlicenseandthat   eachtimetheoffensewasreducedto NoDriversLicenseandfinedonly$25.00.Additionally, p thetrialcourtnotedthattheDefendanthadaseatbeltviolationandaviolationforoperatingan \ unregisteredvehicle,forwhichtherewasstilla capiasoutonhim.Further,thetrialcourtnoted H thattheDefendanthadmultipleconvictionsforwritingbadchecks,includingoneonFebruary5, 4 2001,forwhichhestillowed$1,876.17.OnFebruary23,2001,theDefendantcommitted  p vandalism,andheneverpaidthe$173.48incourtcoststhatheowed.Onthatsamedate,the  \ Defendantcommittedadomesticassaultandwas,asaresultoftheassault,orderedtoservesix H monthsofsupervisedprobation.Twomonthslater,onApril11,2001,theDefendantagainwrote 4 badcheckstotaling$835.65,andtheDefendantpaidnorestitutiononthatcharge.Whileon   probationforthedomesticassaultandbadchecks,theDefendantcommittedthreerobberiesbetween   August17andAugust31,2001.OnAugust29,2001,theDefendantcommittedtheoffenseof  PossessionofDrugParaphernaliaandwasgivenafineof$150.00,whichisstillunpaid.Onthe  samedate,theDefendantwasinPossessionofScheduleVIdrugs,andthecourtorderedthathe  attenddrugandalcoholcounseling.Whileonbondfortherobberies,onJune8,2002,theDefendant l committedtheftofpropertyvaluedover$500. X    ThetrialcourtstatedthattheDefendanthadonlymadeonepaymenttothecourt,andthat 0"  wasinJuneof2002,for$40.00.TheDefendantowedGeneralSessionsCourt$9,158.86,noneof #l! whichhehadpaid,despitethefactthathewasearning$1,000permonthathisjob. $X"   Thetrialcourtincludedintherecordthevictimsimpactstatement.Onevictimsaid,ina %0!$ lettertothecourt, Ijustsitandcry.Ihadabadknee.Icouldhardlywalk.Amansawhimgetmy &"% purseandmypolicefriendsbroughtmehome.Hedidnottrytohurtme,justgrabbedmypurseand '#& jumpedinhiscar.Hetookallmymoney,whichisthepaymentonmyloan.Beforemakingits (#' holding,thetrialcourtreviewedthesentencingfactors,stating:  8  AndwhatIsee...istimeaftertimeaftertime[thecharges]...arereducedand  reducedandreduced.Itdoesntdoanygood.Heservessometimeinjailfrom t November,Ithink,tillFebruary,getsout,and...hegoesrightbacktohisoldways ` andstealsagain....[Whenyoulookatthestatute]itsaysyoushouldrestrain L  defendantswithalengthycriminalhistoryorcriminalconduct.Hedoeshavea 8  historyofcriminalconductanditislengthyforhisage. Measureslessrestrictivethan 4 confinementhavefrequentlyorrecentlybeenappliedunsuccessfullytothe  p defendant.Thatstrue.Therecordshowsit.Itsalsotruewhenyoulookatthe  \ three(3)pursedeals,therobberies.Thatsconfinement.Thatdidntdohimabitof H good.Hegotoutandwentrightbacktohisoldwayswithinaheartbeat. The 4 potentialorlackofpotentialfortherehabilitationortreatmentofthedefendant   shouldbeconsideredindeterminingthesentencealternative.....[W]henits   ordered[forthedefendanttoattendrehabilitation],whilehesonprobation,hesstill  [using]drugs.
