" !  #" Inconsideringthefirstfactor,whetherthedefendantcommittedthedelinquentact,thetrial $# courtreliedontheundisputedtestimonyofthevictimtomakeanaffirmativefinding.Thevictim t% $ testifiedatthetransferhearingthatthedefendantforcedheratgunpointtoperformoralsexandthen ]&!% vaginallyrapedher.Thejuvenilecourtjudgewascorrectinholdingthatreasonablegrounds F'"& existedtobelievethedefendantcommittedtheoffenses. /(#'  )h$( Thejuvenilecourtfoundthatthedefendant isnotdevelopmentallydisabledormentallyill *Q%)  andthatthedefendantwasnotcommittable.Thisfindingwasbasedonanevaluationdoneat *:&* TimberSprings,wherepsychological,forensic,andpsychosexualassessmentswereperformed. #  1      ׀   Thedefendantsownwitnessesgaveglowingreportsonthedefendantsconductwiththeexception  ofthatwhichconstitutedtheoffenses.Therecordsupportedthejuvenilecourtsdecision,andthe  factorofcommitmentwasspecificallyaddressed. k  T Thejuvenilecourtalsoconsideredthethirdcriteriafortransfer, [t]heinterestsofthe =  communityrequirethatthechildbeputunderlegalrestraintordiscipline.Tenn.CodeAnn.37 & v 1134(a)(4)(C)(2000).Thejuvenilecourtjudgecharacterizedthedefendantsactionsasthatofa  _ manandemphasizedtheneedtoprotectthecommunity.Thedefendant,inhisappeal,correctly  H pointsoutthathehadnopriorrecord.Thejuvenilejudgeacknowledgedthisbutjustifiably  1  emphasizedtheneedforcommunityprotection.TennesseeCodeAnnotatedsection371134(b)sets    forthanonexclusivelistofconsiderationstojustifytransfer.Notallofthese,notablyaprior   juvenilerecord,arepresentinthiscase.However,thereisnorequirementthatallconsiderations   bepresent.ThosecontainedinTennesseeCodeAnnotatedsection371134(b)(3)and(4)strongly   supportedthejuvenilecourtsconclusion.Theoffenseswerepatentlypersonalasopposedtoa n  propertyoffenseandwereaggressiveandpremeditated.Thedefendantfirstascertainedthatthe W  victimshusbandwasnotathome.Thedefendantleftandreturnedarmedandforcedhiswayinto @ thehome.Thedefendantthenrapedthevictimrepeatedlyandthreatenedtodothesametothe )y victimsthirteenyearolddaughter.Further,thedefendantthreatenedharmtothevictimifshe b reportedtheincident.
