ÐÌÓ  Óà ` àAccording€to€testimony€presented€at€trial,€Appellant€and€his€brother,ÏRandy€Wilson,€the€victim,€had€a€strained€relationship€for€many€years.€TheÏvictim€threatened€Appellantððs€life€on€many€occasions.€On€the€morning€of€theÏhomicide,€around€4:30€in€the€morning,€the€victim€and€his€girlfriend,€RockyÏWard€showed€up€unannounced€at€Appellantððs€door.€Appellant€allowed€the€twoÏto€sleep€in€his€home€until€sometime€after€midday.€Appellant€testified€that€theÐ \8ü.0 Ðvictim€and€Ms.€Ward€appeared€to€have€been€under€the€influence€of€drugs€andÏalcohol.€The€pair€left€the€farm€around€two€oððclock€with€Ms.€Ward€goingÏsometime€in€the€evening€to€pick€up€her€son€for€her€summer€visitation€with€him.ÏRandy€Wilson€returned€to€the€farm€late€that€evening,€and€Ms.€Ward€arrivedÏwith€her€fourteen€year€old€son€and€her€five€year€old€daughter€to€meet€himÏaround€11:30.ÌÌà ` àRandy€Wilson€was€reclining€on€the€porch,€and€when€Ms.€Ward€arrived,Ïshe€did€not€immediately€see€him.€So€Ms.€Ward€went€into€the€shed€whereÏAppellant€was€working€and€asked€him€where€Randy€was.€Appellant€pointedÏtoward€the€house.€Ms.€Ward€then€got€her€children€out€of€the€car,€slamming€theÏcar€door€in€the€process.€When€Randy€Wilson€heard€the€car€door€he€sat€up,Ïand€Ms.€Ward€joined€him€on€the€porch.€ÌÌà ` àRandy€Wilson€and€Ms.€Ward€checked€for€the€key€on€the€porch,€and,€notÏfinding€it,€Ms.€Ward€returned€to€the€shed€to€ask€Appellant€for€the€key.€She€gotÏno€response€from€Appellant,€and€returned€to€the€porch€without€the€key.€RandyÏWilson€then€stated€that€he€would€get€the€key€and€went€to€the€shed.€A€fewÏseconds€after€Randy€Wilson€entered€the€shed,€Appellant€shot€him.€€RandyÏWilson€turned€to€leave€the€shed,€holding€his€stomach,€and€Appellant€followedÏhim€out€of€the€shed,€shooting€him€in€the€back.€Ms.€Ward€and€her€two€childrenÏfled€the€property,€hearing€a€third€shot€as€they€ran.€Ms.€Ward€flagged€down€aÏcar€which€took€her€to€call€the€authorities.ÌÐ  :À00 Ðà ` àThe€victimððs€body€was€recovered€at€the€scene€with€three€gunshotÏwounds€to€the€body€(and€an€additional€wound€to€the€hand€which€could€haveÏbeen€from€the€same€shot€as€one€of€the€wounds€to€the€body):€one€shot€to€theÏchest€which€crossed€through€the€chest€wall€and€the€top€of€the€victimððs€liver,Ïanother€shot€to€the€abdomen€which€went€through€the€top€of€the€left€kidney,Ïinjured€the€spleen€and€passed€through€the€victimððs€stomach,€and€a€third€shotÏwhich€entered€high€under€the€victimððs€jaw€and€exited€just€below€his€ear,Ïsevering€the€carotid€artery.€According€to€medical€testimony€at€trial,€either€ofÏthe€first€two€wounds€would€have€been€fatal€had€the€victim€received€extensiveÏmedical€care€within€thirty€minutes€of€receiving€either€wound.€The€third€shotÏcaused€death€instantaneously.ÌÌà ` àAppellant€initially€denied€killing€his€brother,€but€eventually€signed€aÏstatement€admitting€to€shooting€Randy€Wilson€after€his€brother€threatened€toÏð ðblow€his€brains€outðð€if€he€did€not€give€the€victim€the€key€to€his€house.ÏAppellant€was€afraid€of€the€victim€as€a€result€of€the€victimððs€prior€threats€to€killÏhim€and€felt€that,€if€he€did€not€protect€himself,€the€victim€would€shoot€him.ÏAppellant€further€testified€that€when€the€victim€turned€to€leave€the€shed,€heÏfeared€that€the€victim€would€retrieve€a€gun€from€his€car€and€return€to€kill€him.ÏThough€the€victim€was€unarmed€at€the€time€of€the€shooting,€undisputedÏtestimony€was€presented€that€the€victim€always€carried€a€gun,€usually€wore€aÏbullet€proof„vest,€and€had€a€reputation€for€violence.ÌÌò òÓ  ÓI.€Length€of€Sentenceó óÐ 8¸.. ÐÓÓÐ  :À00 Ðà ` à€Appellant€argues€that€the€trial€court€erred€in€imposing€the€maximumÏsentence€for€this€crime.€When€a€defendant€complains€of€his€or€her€sentence,Ïwe€must€conduct€a€òòde€novoóó€review€with€a€presumption€of€correctness.€Tenn.Ð p  ÐCode€Ann.€ðð€40„35„401(d).€The€burden€of€showing€that€the€sentence€isÏimproper€is€upon€the€appealing€party.€Tenn.€Code€Ann.€ðð€40„35„401(d)ÏSentencing€Commission€Comments.€This€presumption,€however,€isÏconditioned€upon€an€affirmative€showing€in€the€record€that€the€trial€courtÏconsidered€the€sentencing€principles€and€all€the€relevant€facts€andÏcircumstances.€òòState€v.€Ashbyóó,€823€S.W.2d€166,€169€(Tenn.€1991).Ð  @ ÐÌà ` àThe€Sentencing€Reform€Act€of€1989€established€specific€proceduresÏwhich€must€be€followed€in€sentencing.€These€procedures,€codified€at€Tenn.ÏCode€Ann.€ðð€40„35„210,€mandated€the€courtððs€consideration€of€the€following:ÌÌÒ` „ÒÒ` ÒÓÓ(1)€The€evidence,€if€any,€received€at€the€trial€and€theÏsentencing€hearing;€(2)€[t]he€presentence€report;€(3)Ï[t]he€principles€of€sentencing€and€arguments€as€toÏsentencing€alternatives;€(4)€[t]he€nature€andÏcharacteristics€of€the€criminal€conduct€involved;€(5)Ï[e]vidence€and€information€offered€by€the€parties€on€theÏenhancement€and€mitigating€factors€in€ðððð€40„35„113Ïand€40„35„114;€and€(6)€[a]ny€statement€the€defendantÏwishes€to€make€in€his€own€behalf€about€sentencing.ÌÒ` "ÒÒ„` "ÒÓ%"ÓÌT.C.A.€ðð€40„35„210.ÌÌà ` àThis€section€further€provides€that€the€minimum€sentence€within€theÏrange€is€the€presumptive€sentence.€The€court€must€begin€with€the€minimumÏsentence€and€enhance€that€sentence€to€appropriately€reflect€any€statutoryÐ 9¼// Ðenhancement€factors€that€the€court€finds€to€be€present.€After€enhancing€theÏsentence,€the€court€must€reduce€the€sentence€giving€consideration€to€theÏweight€of€any€mitigating€factors€that€the€court€finds.€The€weight€to€be€givenÏeach€factor€is€left€to€the€discretion€of€the€trial€judge.€òòState€v.€Sheltonóó,€854Ð x Мñ]ññ[ñÐ  x Ðñ[ññ]ñS.W.2d›€116,€123€(Tenn.€Crim.€App.€1992).€€Because€we€find€the€trial€courtÏerred€in€rejecting€a€number€of€applicable€mitigating€factors€out€of€hand,€ourÏreview€of€the€sentence€in€this€case€is€purely€òòdeóó€œòònovñWñoñWññXñañXñóó.›Ð 0  ÐÌà ` àHaving€been€convicted€of€a€Class€œD›€felony€as€a€Range€I€standardÏoffender€Appellant€is€subject€to€a€minimum€sentence€of€two€years€and€aÏmaximum€sentence€of€four€years.€€The€trial€court€found€that€two€enhancementÏfactors€were€applicable,€i.e.,€Appellant€treated€Randy€Wilson€with€exceptionalÏcruelty,€Tenn.€Code€Ann.€Sec.€40„35„114(5),€and€Appellant€used€a€firearm€inÏthe€commission€of€the€offense,€Tenn.€Code€Ann.€Sec.€40„35„114(9).€€The€trialÏcourt€declined€to€find€that€any€of€the€mitigating€factors€offered€by€AppellantÏwere€applicable€to€the€case.€€œñYñIñYññZñiñZñt›€is€from€the€refusal€on€the€part€of€the€trial€courtÏto€apply€any€of€these€mitigating€factors€that€Appellant€appeals.ÌÌà ` àAppellant€urged€the€trial€court€to€apply€the€following€mitigating€factors€toÏhis€sentence:Ìœñ\ñÌñ\ñ›ÓÓà8 ` àà8¸ ` ü!` ü!à(2)à0¸ ¤¸ ¤àthe€defendant€acted€under€strong€provocation;Ð2 ((¤¤ ÐÌà8 ` àà8¸ ` ü!` ü!à(3)à0¸ ¤¸ ¤àsubstantial€grounds€exist€tending€to€excuse€orÐ 4¨** Ðjustify€the€defendantððs€criminal€conduct,€thoughÏfailing€to€establish€a€defense.Ð ¤¤ ÐÌà8 ` àà8¸ ` ü!` ü!à(8)à0¸ ¤¸ ¤àthe€defendant€was€suffering€from€a€mental€orÐ 8¸.. Ðphysical€condition€that€significantly€reducedÏculpability€for€the€offense;€andÐ :À00¤¤ Їà8 ` àà8¸ ` ü!` ü!à(11)à0¸ ¤¸ ¤àthe€defendant,€although€guilty€of€the€crime,Ð `  Ðcommitted€the€offense€under€such€unusualÏcircumstances€that€is€unlikely€that€a€sustainedÏintent€to€violate€the€law€motivated€the€conduct.Ð ¤¤ ÐÓù*ÓÌTenn.€Code€Ann.€ðð€40„35„113.Ð  :À00 ЇWe€will€address€the€applicability€of€each€factor€in€turn.ÌÌòòStrong€Provocation.Ð p  ÐÌóóà ` àThe€evidence€in€this€record€is€undisputed€that€Appellant€was€a€peacefulÐ €  Ðman€who€had€never€been€in€trouble€before€in€his€life.€€Likewise€it€isÏuncontradicted€that€Randy€Wilson€was€a€violent€man€who€wore€a€bullet€proofÏvest€and€went€armed€virtually€all€the€time.€€Randy€Wilson€œhañ[ñ›ñ[ñd›€intimidated€hisÏbrother,€the€Appellant,€for€years€through€threats€and€belligerent€behavior.€ÏIndeed€the€mother€of€both€Appellant€and€Randy€Wilson€testified€that€the€latterÏwas€so€violent€she€was€scared€of€him€and€actually€slept€with€a€baseball€bat€toÏprotect€herself€from€her€own€son.€€Appellant€testified€that€at€the€time€of€theÏshooting€his€brother€threatened€to€kill€him€as€he€had€many€times€previously.ÌÌà ` àIt€is€obvious€the€jury€believed€that€Appellant€acted€under€some€degreeÏof€provocation€that€reduced€his€culpability€for€the€homicide.€€Although€originallyÏindicted€for€second€degree€murder,€i.e.€a€ð ðknowingðð€killing€the€jury€foundÏAppellant€guilty€of€only€the€ð ðrecklessðð€killing€of€Randy€Wilson.€€We€believe€thatÏunder€the€circumstances€the€trial€court€should€have€found€that€Appellant€whenÏhe€shot€Randy€Wilson€was€acting€under€strong€provocation.ÌÌòòSubstantial€Grounds€Exist€Which€Tend€to€Excuse€Appellantððs€Conduct.óóÐ 4¨** ÐÌà ` àFrom€its€verdict€it€is€clear€that€the€jury€rejected€the€notion€that€AppellantÏacted€in€a€manner€which€would€constitute€the€complete€defense€of€selfÐ  :À00 Ðdefense€thereby€excusing€Appellant€from€criminal€responsibility€altogether.€Ð Ð9p02 ÐHowever,€for€the€reasons€stated€in€the€preceding€section€it€is€also€clear€thatÏthe€jury€did€not€believe€Appellant€to€be€guilty€of€a€murder€or€any€intentionalÏhomicide.€€Since€Appellant€admitted€shooting€his€brother€repeatedly€we€areÏleft€to€conclude€that€the€jury€must€have€believed€that€Randy€Wilsonððs€previousÏthreats€and€his€reputation€for€violence€and€going€armed€tended€to€excuse€theÏAppellantððs€conduct.ñRñœ×ƒ×ñRññRñ׃ ×ñRñÝ ƒ #ÃÝòòÚ  Ú1Ú  ÚóóÝ  Ý×  ×›€€From€the€record€we€agree€and€find€the€trial€court€shouldÐ °  Ðhave€applied€this€mitigating€factor€to€Appellantððs€sentence.ÌÌòòAppellantððs€Mental€Condition.óóÐ à€ ÐÌà ` àExpert€testimony€established€that€Appellant€had€a€low€I.Q.€although€heÏwas€not€retarded.€€œñOñhñOññPñHñPñe›€also€suffered€from€a€form€of€post„traumatic€stressÏsyndrome.€€However,€Appellant€was€a€fully€functioning€individual€who€ran€aÏfarm,€œdatedñQñ,ñQñ›€and€took€care€of€his€elderly€aunt.€€He€had€never€been€treated€forÏmental€or€emotional€problems.€€Under€these€circumstances€the€trial€court€didÏnot€err€in€rejecting€this€mitigating€factor.ÌÌòòSustained€Intent€to€Violate€the€Law.óóÐ P*ð " ÐÌà ` àThe€uncontradicted€proof€in€the€record€revealed€that€Appellant€is€aÏpeaceful€man€who€has€never€crossed€paths€with€the€law€prior€to€this€incident.€ÏBy€all€accounts€he€led€a€quiet€life€on€his€family€farm€where€he€cared€for€anÏelderly€aunt.€€Again,€it€is€apparent€from€its€verdict€that€the€jury€found€the€killingÏof€Randy€Wilson€to€be€at€most€an€isolated€act€motivated€by€fear€andÐ ð5,. Ðintimidation.€€We€find€that€Appellantððs€actions€were€not€motivated€by€aÏsustained€intent€to€violate€the€law.€€This€factor€should€have€been€applied€toÏAppellantððs€sentence.ÌÌà ` àIn€summary€is€it€the€opinion€of€this€Court€that€mitigating€factors€(2),€(3)Ïand€(11)€apply€to€the€sentence€in€this€case.€€In€balancing€these€factors€againstÏthe€substantial€weight€accorded€by€the€trial€court€to€the€applicableÏenhancement€factors€we€modify€the€sentence€of€four€years€to€one€of€threeÏyears€in€length.ÌÌÌÌà ` àÌò òÓ  ÓII.€Alternative€Sentencingó óÐ "0 ÐÓ7>ÓÌà ` àAppellant€further€challenges€the€trial€courtððs€order€that€he€serve€theÏentirety€of€his€sentence€in€confinement.€The€Sentencing€Reform€Act€requiresÏthe€trial€court€to€begin€its€consideration€with€the€presumption€that€the€appellantÏis€subject€to€alternative€sentencing€if€he€meets€the€requirements€of€TennesseeÏCode€Annotated€ðð€40„35„102(6),€which€requires€that€the€appellant€not€fallÏunder€Tennessee€Code€Annotated€ðð€40„35„102(5)€and€that€he€receives€aÏsentence€of€less€than€eight€years.€This€means€that€the€defendant€must€be€aÏstandard€or€mitigated€offender,€convicted€of€a€Class€C,€D,€or€E€felony€whoÏcannot€have€a€criminal€history€evincing€either€ð ðclear€disregard€for€the€laws€andÏmorals€of€societyðð€or€ð ðfailure€of€past€efforts€at€rehabilitation.ðð€Tenn.€Code€Ann.Ïðð€40„35„102(5).€Appellant€clearly€falls€within€the€parameters€of€theÐ à9€02 Ðpresumption€that€he€is€entitled€to€a€sentence€other€than€continuousÏconfinement.ÌÌÓ  Óà ` àThe€presumption€that€Appellant€is€a€candidate€for€alternative€sentencingÏdoes€not€settle€the€matter.€This€presumption€may€be€rebutted€by€ð ðevidence€to€theÏcontrary.ðð€Tenn.€Code€Ann.€ðð€40„35„102(6).€Tennessee€Code€Annotated€ðð€40„35„¼103€gives€guidance€as€to€what€may€be€considered€in€making€this€determination:ÌÒ` @ÒÒ` X„ÒÓÓà ¸ à(1)€Sentences€involving€confinement€should€beÏbased€on€the€following€considerations:Ìà ¸ àà  à(A)€Confinement€is€necessary€to€protectÏsociety€by€restraining€a€defendant€who€has€a€long€historyÏof€criminal€conduct;Ìà ¸ àà  à(B)€Confinement€is€necessary€to€avoidÏdepreciating€the€seriousness€of€the€offense€or€confinementÏis€particularly€suited€to€provide€an€effective€deterrence€toÏothers€likely€to€commit€similar€offenses;€orÌà ¸ àà  à(C)€Measures€less€restrictive€thanÏconfinement€have€frequently€or€recently€been€appliedÏunsuccessfully€to€the€defendant.ÌÒ` ¬CÒÒ„` ¾CÒÓSBÓÓÐCÓÌòòState€v.€Ashbyóó,€823€S.W.2d€166,€169€(Tenn.€1991).€In€this€case,€the€trial€courtÐ €$  Ðfound€that€confinement€was€necessary€to€avoid€depreciating€the€seriousnessÏof€the€offense.€The€trial€court€specifically€based€the€œñTñsentence€of€continuousÏñTñincarceration›€upon€the€lawlessness€of€society€saying,€ð ðso€what€should€theÏmessage€œbe?ñUñðð.€ñUñ›€In€my€opinion,€probation€would€say€that€itððs€okay€to€go€back€toÏlawlessness€in€a€time€when€violence€causes€all€of€us€to€live€in€fear.€What€weÏneed€more€of,€folks,€is€just€plain€old€law€and€order,€and€then€if€you€killÏsomeone€and€itððs€not€in€self„defense,€and€you€know€what€youððre€doing,€andÏyou€do€it€cruelly,€you€go€to€jail.€Those€are€hard€words,€but€theyððre€true.€SoÏthatððs€the€message.ðð€Ìâ âÐ à7€.0 Ðà ` àWe€agree€with€the€trial€court€that€this€case€is€serious€and€that€someÏâ âincarceration€is€necessary€to€avoid€depreciating€this€fact.€€However,€Tenn.ÏCode€Ann.€Sec.€40„35„103(4)€cautions€us€that:ÌÌÓÓà8 ` àà8¸ ` ü!` ü!àThe€sentence€imposed€should€be€the€least€severeÏmeasure€necessary€to€achieve€the€purposes€forÏwhich€the€sentence€is€imposed.Ð ¸ ¤¸ ¤ ÐÓšJÓÌà ` àThe€homicide€in€this€case€is€not€only€serious,€as€is€any€homicide,€but€itÏis€also€tragic.€€Here€one€otherwise€law€abiding€brother€is€apparently€driven€toÏkill€his€violent€sibling€through€threats€and€intimidation€meted€out€by€the€latterÏfor€the€better€part€of€a€lifetime.€€As€stated€previously,€although€AppellantÏcannot€and€should€not€be€completely€relieved€of€criminal€responsibility€for€hisÏactions,€a€sentence€of€continuous€confinement€in€the€penitentiary€does€notÏappear€to€be€the€least€severe€measure€œñVñnecessary€ñVñto›€avoid€depreciating€theÏseriousness€of€the€offense.€€It€is€our€opinion€that€pursuant€to€Tenn.€Code€Ann.ÏSec.€40„35„306,€Appellant€should€serve€a€sentence€of€one€year€in€the€countyÏjail€or€workhouse€followed€by€a€period€of€two€years€supervised€probation€uponÏsuch€terms€and€conditions€as€the€trial€court€may€deem€appropriate.ÌÌà ` àThe€judgment€of€the€trial€court€is€modified€to€reflect€a€sentence€of€threeÏyears€to€be€served€as€set€forth€hereinabove.€€This€case€is€remanded€to€theÏtrial€court€for€further€proceedings€consistent€with€this€opinion.ÌñUñœñUñœÌ›ÌÓÓà ` àà ¸ àà  àà h àà À à____________________________________Ìà ` àà ¸ àà  àà h àà À àJERRY€L.€SMITH,€JUDGEÌÌÐ Ð9p02 ЇCONCUR:ÌÌÌÌ___________________________________ÌTHOMAS€T.€WOODALL,€JUDGEÌÌÌ___________________________________ÌWILLIAM€B.€ACREE,€SPECIAL€JUDGE
