Thisprotractedcaseoriginatedin1992,followingatragicautomobileaccidentwhichtookthelivesofWymondLove,Sr.,andNicoletteAmoroso.Accordingtoeyewitnesstestimony,theappellantwasdrivingatanexcessiverateofspeedonJamesRoadinShelbyCountywhenhiscarsuddenlymadea UturnandslammedintoanoncomingtruckdrivenbyMr.Love.Thestreetswerewetfromrainyweatheronthedayoftheaccident.TheviolentcollisioncausedMr.Lovetobethrownfromhistruckandhediedalmostinstantly.Oneofappellantspassengers,Ms.Amoroso,alsodiedasaresultofthecollision. TheShelbyCountyGrandJuryindictedtheappellantontwocountsofvehicularhomicide.Appellantinitiallyplednotguiltyandsoughtpretrialdiversion.HesubmittedawrittenapplicationforpretrialdiversiononFebruary24,1993.TheDistrictAttorneyGeneraldeniedtheapplicationandthatdenialwasaffirmedbythetrialcourt.Thereafter,theappellantfiledaRule10appealtothisCourt. ThisCourtreversedandremandedthecasetothetrialcourtwithinstructionsonhowtoproperlyaddresspretrialdiversionunderTennesseeCodeAnnotatedsection4015105(1990).Statev.Winsett,882S.W.2d806(Tenn.Crim.App.1993), *#( perm.app.denied(June13,1994).Uponremand,theappellantresubmittedhis ,%* applicationforpretrialdiversion,whichwasagaindeniedbytheDistrictAttorney.ThetrialcourtaffirmedthedenialfollowinganevidentiaryhearingandgrantedpermissionfortheappellanttoseekaRule9interlocutoryappealtothisCourt. PermissiontofiletheinterlocutoryappealwasgrantedbythisCourtonOctober13,1994.Inthatappeal,apanelofthisCourtdeterminedthattheDistrictAttorney 5.4 hadabusedhisdiscretionindenyingpretrialdiversionwithoutconsideringtheappropriatefactorsandwithoutarticulatinginawrittenreportthereasonsforthedenial.Statev.JeremyWinsett,No.02C019409CR00223(Tenn.Crim.App.at   Jackson,Feb.29,1996),perm.app.denied(Tenn.Mar.3,1997).Accordingtothe l d Court,theevidencereflectedthattheappellantwasamenabletocorrectionandwasnotlikelytocommitsubsequentcrimes.Slipop.at2.TheCourt,therefore,reversed   andremandedthecasetothetrialcourtwithinstructionstograntpretrialdiversion.Id.    Theappellantwasarrestedforthetheftofpropertyunder$500whilehisinterlocutoryappealwaspendingbeforethisCourt.  %  1      ׀Hepledguiltytothetheftcharge 80 andservedtwodaysinjail.Consequently,whenhisvehicularhomicidecasewasremandedtothetrialcourt,thetrialcourtdeterminedthatappellantwasnolongerentitledtopretrialdiversion.Theappellant,therefore,changedhispleastoguiltyandagreedtoathree(3)yearsentence,withthemannerofservicetobedeterminedbythetrialcourt.
