Thecourtalsobaseditsdecisiontodenyfullprobationonthedeterrenteffect,aswellastheneedtoavoiddepreciatingtheseriousnessofthecrimes.Therecordmustcontainsomeevidencethatthesentenceimposedwillhaveadeterrenteffectwithinthejurisdictionbeforeatrialcourtcandenyalternativesentencingbasedonthisground.Statev.Bonestel,871S.W.2d163,169 D  (Tenn.Crim.App.1993).Furthermore,conclusorystatementsareinsufficient,andonlywhenthereisproofofthedeterrenteffectwithinthejurisdictionwilldenialbeupheld.Statev.Ashby,823S.W.2d166,,1170(Tenn.1991)at170.񀀀#XVoXXXo #XoXXXVo   Iagreewiththetrialcourtthatthetheftofgunsisaseriousoffenseandthatconfinementwouldprovidesomedeterrenteffect.Also,Iagreethatsomeperiodofconfinementisnecessarytoavoiddepreciatingtheseriousnessoftheoffense.Whattheappellantandhercodefendantsdidwasclearlywrong.However,#XVoXXXo #XoXXXVoԀaccordingtothepresentencereport,theappellantscodefendants, p!  StevenWisdom,andhisfriend,GlennAxley,received250daysofcontinuousconfinementwiththebalanceoftheirsentencestobeservedonCommunityCorrections.Icannotreconcilehowtheappellantshouldreceivethefinesimposedbythejury,therestitutionimposedbythecourt,andgreatertimeinjailthanhercodefendantswhoweretheprincipalsinthecrimes,whoadmittedthattheyplannedthecrime,andwhobenefittedfromthecrimesasmuchormoresothanshedid.ShewastheonewhovoluntarilywenttotheauthoritiesinBentonCounty,confessedtoherinvolvement,implicatedhercodefendants,andworkedwithlawenforcementauthoritiestorecoverasmanyofMr.Futrellsgunsaspossible.OneofthewitnessestestifiedthattheappellantwasveryhelpfulingettingMr.Futrellsgunsreturned.Topunishmoreseverelysomeonewho confessedandwhotriedtocorrectherwrongsbyhelpingthepolicewouldlikely 7P28 deterothersinoursocietyfromcomingforward,admittingtheirwrongs,andworkingwithauthoritiestocorrecttheirmisdeeds.  Accordingly,Iconcludethatinthebestinterestofthepublicandtheappellant,theappellantssentenceshouldbemodified.Iwouldorderthatsheserve180daysinthecountyjailforheraggravatedburglaryconvictionand180daysinthecountyjailforhertheftconviction,withthebalancesofheroriginalsentencesofthreeyearsandtwoyears,respectively,tobeservedonCommunityCorrections.Iwouldorderthesesentencestorunconcurrentlywitheachotherforatotaleffectivesentenceof180daysinthelocaljail,withthebalanceofhersentencestobeservedonCommunityCorrections.
