Wilsonfollowedthevehicleforapproximatelytwomilesandobserveditontwoorthreeoccasionsdriftbackandforthwithinitslane.Thevehiclealsocrossedthemarkedcenterlineoftheroadwayatleastonce.Wilsonsuspectedthatthedriverwasintoxicated.Hestoppedthevehicleandconversedwiththedriver,thedefendant.DeputyFreeman,alsooftheFayetteCountySheriffsDepartment,conversedwiththepassenger.ThedefendantstatedthatheandthepassengerwereenroutetoMississippitovisitthepassengersgirlfriend.ThepassengeradvisedFreemanthattheywereenroutetovisitamalefriend. h949 /VX  ќ Thedeputiescomparedtheseconversationsandnotedtheconflictingstatements.Boththedefendantandthepassengerconsentedwhenthedeputiesrequestedpermissiontosearchthevehicle.Wilsonstayedwiththetwosubjects,andFreemansearchedthevehicle.FreemanreturnedandadvisedWilsontoplacethetwosubjectsonthehoodofthecar.ThedefendantimmediatelyfledonfootandwasnotlocateduntilafterFreemanobtainedawarrantforthatsubjectsarrest.̜ Inthevehicle,Freemanhadfoundabagcontainingahandgun,approximatelyonehundredrocksofsuspectedcrackcocaine,andthirteenbagsofsuspectedmarijuana.Freemanobtainedthewarrantforthedefendantsarrest.NeitherFreemannorthedefendanttestifiedatthehearing. Thedefendantspassenger,whoactuallyownedthevehicle,testifiedatthehearinganddeniedthatthevehicleswervedwhilethedeputyfollowedthecar.Healsotestifiedthat,inthearea rightbeforethestop,thespeedlimitwasfortymilesperhourandthatthedefendantwasdrivingatapproximatelythirtyfivetofortymilesperhourinthatzone.
