ThestatearguesthattheappellantdidnottimelyfilehisnoticeofappealinaccordancewithT.R.A.P.4(a).Therefore,thestatecontendsthisappealistimebarred.Weagreethattheappellantdidnottimelyfilehisnoticeofappeal.However,weseenoprejudiceaccruingtothestateinconsideringtheappellantsallegations.Therefore,intheinterestofjustice,wewaivetheappellantsuntimelyfiling.Statev.Mullins,767S.W.2d668(Tenn.Crim.App.1988). Theappellantallegesthathereceivedineffectiveassistanceofcounsel.Specifically,heclaimsthathistrialcounselcommunicatedtohimthroughhismother,failedtoinvestigateallegationsthathehadbeenbeatenbyjailofficials,andfailedtopursueclaimsofanillegalinvestigationofthecrimescene. Itiswellsettledthataclearbutpatentlynonmeritoriouspetitionmaybedismissedsummarily.Martucciv.State,872S.W.2d947(Tenn.Crim.App.1993).Apetitionwhichisuncleartotheextentthatitcannotbesodismissedrequirestheappointmentofcounsel.Id.at949.Iftheappointedcounseldeterminesthattheappellanthasavalidgroundtoproceed,heorsheshouldfileanamendedpetition.Id.Tenn.CodeAnn.4030206(f)statesthat: 8 Uponreceiptofapetitioninproperform,oruponreceiptofanamendedpetition,thecourtshallexaminetheallegationsoffactinthepetition.Ifthefactsalleged,takenastrue,failtoshowthatthepetitionerisentitledtorelieforfailtoshowthattheclaimsforreliefhavenotbeenwaivedorpreviouslydetermined,thepetitionshallbedismissed.Theorderofdismissalshallsetforththecourtsconclusionsoflaw.Tenn.CodeAnn.4030206(Supp.1996) Uponreviewofthepetition,wefindthattheappellantspetitionisartfullydrafted.Itallegesunambiguousclaimsaswellasthefactstosupporttheseclaims.Therefore,itisproperforsummarydispositionifthetrialcourtcorrectlydeterminesthattheclaimsdonotallegegroundsuponwhichreliefcanbegranted. Theappellantsallegationregardinghisallegedbeatingbyjailofficialsoccurredafterhistrialandconvictions.Thetrialcourtwascorrectinfindingthatthisallegationisirrelevantindeterminingwhethertheappellantreceivedeffectivetrialrepresentation.Theappellantalsoallegesthathistrialattorneycommunicatedwithhimthroughhismother.Hedoesnotallegethathisattorneyfailedtocommunicatewithhim;hesimplyobjectstotheattorneyschannelofcommunication.Thisclaimfailstoallegeanyharmorprejudicesufferedbythistypeofconsultation.Next,theappellantallegesthat althoughthesubject[theillegalinvestigationofthecrimescene]waspresentedattrial,counselrefusedtopursuethesubjectintheCourtofCriminalAppeals.Thisallegationclearlyillustratestheappellantsdislikeoftheoutcomeconcerningthisissue,butdoesnotprovethathereceivedineffectiveassistanceofcounsel. 2   ׀ Uponconsiderationoftheappellantsissues,thisCourtfindsthatthetrialcourtwascorrectinsummarilydisposingoftheappellantspetition.Noneoftheallegations,evenifproventrue,woulddemonstratethattheappellantreceivedineffectiveassistanceofcounsel.AFFIRMED      ________________________________      PAULG.SUMMERS,JudgeCONCUR:______________________________JOSEPHB.JONES,PresidingJudge______________________________J.CURWOODWITT,JR.,Judge
