àThe€trial€court€heard€argument€on€the€reasonable€doubt€instruction€raised€by€theÏpetitioner.€€The€purpose€of€the€hearing€was€to€determine€whether€this€was€a€new€issueÏwhich€was€not€barred€by€the€statute€of€limitations.€€The€trial€court€properly€concludedÏthis€was€not€a€new€issue,€and,€furthermore,€the€petitioner€would€not€be€entitled€to€reliefÏif€the€issue€was€not€time€barred.Ìà àThe€petitioner€œclaims›€the€trial€court€should€have€given€him€an€opportunity€toÏexplain€why€the€petition€was€not€filed€timely.€€This€ground€was€not€brought€to€theÏattention€of€the€trial€court€until€after€the€jurisdiction€of€the€court€had€expired.€€Therefore,Ïthe€petitioner€was€not€entitled€to€a€hearing€on€this€ground.Ìà ðMotion€forÏReconsideration€of€Petition€for€Post€Conviction€Reliefðð€on€December€29,€1995.€ÏPetitionerððs€counsel€filed€a€pleading€entitled€ð ðMotion€for€Reconsideration€of€Petition€forÏPost„Conviction€Reliefðð€on€January€18,€1996.€€Counsel€also€filed€a€pleading€entitledÏð ðMotion€to€Withdraw€Notice€of€Appealðð€on€January€18,€1996.€€The€latter€motion€soughtÏto€withdraw€the€notice€of€appeal€previously€filed€without€prejudice.€€The€purpose€of€thisÏmotion€was€to€permit€the€petitioner€to€raise€additional€issues€and€have€a€hearing€onÍthese€issues.Ìà àThere€is€no€statute,€œrule,›€or€common€law€decision€which€permits€a€party€toÏwithdraw€a€notice€of€appeal€without€prejudice€so€the€party€may€litigate€additionalÍissues.€€Moreover,€such€a€rule€would€thaw€justice€because€a€party€could€file€andÏwithdraw€the€notice€of€appeal€with€impunity€and€present€additional€issues€to€litigate.€€ItÏwould€also€prevent€the€state€from€raising€issues€in€the€appellate€court.€€Ìà àThe€only€procedure€available€to€the€petitioner€was€the€dismissal€of€the€appealÏpursuant€to€Tenn.€R.€App.€P.€15(a).€€Obviously,€the€petitioner€did€not€want€to€dismiss€hisÏappeal.€€Nor€did€he€follow€the€procedure€mandated€by€this€rule.€€While€a€motion€wasÏfiled,€it€was€not€for€the€purpose€of€dismissing€the€appeal.€€Further,€this€motion€was€notÏbrought€to€the€attention€of€the€trial€court€until€the€hearing€and€no€order€was€everÏentered€regarding€the€disposition€of€the€motion.Ìà
