Thereafter,thepetitionerfiledapetitionforpostconvictionreliefallegingasgroundsthathiscounselhadperformedineffectively.Thetrialcourtdeniedtheclaimand,ondirectappeal,thiscourtaffirmed.KeithDouglasWootenv.State,No.01C019303CR00078(Tenn.Crim.App.,atNashville,July22,1993).Afterareviewoftherecord,thiscourtconcludedthatthepetitioner,whowas"nostrangertothecriminaljusticesystem,"hadashis"motivationtopleadguilty...hisfearofconsecutivesentences."Id.,slipop.at4.Thedeterminationofthecourtwasthatthepetitioner"appreciatedthefactthathisconvictionswouldnotincreasethetotalamountoftimehewouldserve"duetosentencesforothercrimes.Id. OnOctober18,1994,thepetitionerfiledapetitionforwritofhabeascorpusintheUnitedStatesDistrictCourtfortheMiddleDistrict.Ourstateattorneygeneralsoughtadismissalonthebasisthatthepetitionerhadnotexhaustedhisstateremedy.ThestatecontendedthatthepetitionerwouldbeentitledtoadelayedappealbecausehehadbeendeniedtheopportunityofsecondtierreviewintheTennesseeSupremeCourt.TheDistrictCourtdismissedthepetitiononthatbasis.  OnOctober11,1995,thepetitionerfiledthispetitionforpostconvictionreliefseekingsecondtierreviewofourJuly22,1993,opinion.ThetrialϜcourtruledthatitwaswithoutauthoritytograntthereliefanddismissedthepetition.Additionalpleadingsseekingrelieffromtheorderofdismissalwereunsuccessfulandthisappealfollowed.
