Attheevidentiaryhearing,thepetitionertestifiedthathistrialattorneyneverreadanyindictmenttohim.Hesaidhisattorneyneverexplainedtheelementsofanyofthecrimesforwhichhewascharged,nordidheexplaintheelementsofseconddegreemurder.Hesaidifhehadunderstoodtheelementsofseconddegreemurder,hewouldnothavepledguilty. Thepetitionertestifiedthathisattorneydiscussedapossibledefenseofinsanitybuttoldhimthetrialcourtwouldnotacceptadefenseoftemporaryinsanity.Hesaidhisattorneytoldhimhehadtobeinsaneatalltimes,andthepetitionersaidhedidnotwanttouseinsanityasadefensebecausehewasnotinsane.Hesaidthatifhehadknownthatinsanityanddiminishedcapacitywereavailableasdefenses,hewouldnothavepledguilty.Hesaidthathepledguiltybecausehethoughthewouldbereindictedforfelonymurderandthestatewouldseekthedeathpenalty.Healsosaidhisattorneyandthedistrictattorneytoldhimhewouldprobablybereleasedfromjailintentotwelveyears.Hesaidhethoughtthetrialjudgemayhaveexplainedtheelementsoftheoffensestohimattheguiltypleahearing,buthewasnotpositive.On  4-2 crossexamination,headmittedthatattheguiltypleahearing,hesaidhehadaweektoexaminethepleaagreement. Thepetitionerstrialattorneytestifiedthathetalkedwiththepetitionerandthepetitionerssisternumeroustimes.Hesaidapsychologicalevaluationrevealedthatthepetitionerwascompetentandsane.Hesaidhebelievedthepetitionerunderstoodeverythinghetoldhim.Hesaidheshowedthepetitionertheindictmentforfelonymurderanddiscusseditwithhim.Hesaidheexplainedalltheelementsthestatewouldhavetoprovetoconvictthepetitionerofpremeditatedandfelonymurder.Hesaidthepetitionerunderstoodhisoptions,andheacceptedthepleaagreementalmostimmediately.Hesaidhetoldthepetitionertothinkitoverforaweekbeforeagreeingtotheplea.Hesaidthepetitionerreadilyacceptedtheplea,andhedidnotcoerceorpersuadethepetitionertoacceptit.Hetestifiedthathenevertoldthepetitionerthathewouldprobablygetoutofjailintentotwelveyears. Thetrialcourtdeniedthepetitionerpostconvictionrelief.Itfoundthatthepetitionerfreely,voluntarily,andknowinglyenteredhispleaofguiltyandthathistrialϜattorneysperformancewaswithintherangeofcompetencedemandedofattorneysincriminalcases. Onappeal,thepetitionerchallengeshisconvictionbasedupontheclaimthathereceivedtheineffectiveassistanceofcounselthatcausedhimtoenteranunknowingandinvoluntaryguiltyplea.X-CXX X\Inhisbrief,thepetitionerpresentstwoseparate .', claims.First,hearguesthathispleawasinvoluntaryandunknowingbecausecounselfailedtoexplaintheelementsofseconddegreemurder,andsecond,hearguesthatcounselwasdeficientforfailingtoexplaintheelements.Becausethepetitionersessentialclaimisthathisattorneysdeficientperformanceresultedinaninvoluntaryandunknowingplea,weaddresshisclaimstogether.# X\XXX-C# 706  :   UndertheSixthAmendment,whenaclaimofineffectiveassistanceofcounselismade,theburdenisuponthepetitionertoshow(1)thatcounselsperformancewasdeficientand(2)thatthedeficiencywasprejudicialintermsofrenderingareasonableprobabilitythattheresultofthetrialwasunreliableortheproceedingsfundamentallyunfair.Stricklandv.Washington,466U.S.668,687,104S.
