àPetitioner,€Anthony€Washington,€appeals€the€trial€courtððs€denial€of€hisÏpetition€for€post„conviction€relief.€€Petitioner€was€charged€with€the€crimes€of€firstÏdegree€murder,€theft,€aggravated€robbery€(four€counts)€and€especiallyÏaggravated€robbery€(two€counts).€€He€pled€guilty€in€October€1995.€€PetitionerÏwas€sentenced€to€life€imprisonment€on€the€first€degree€murder€charge,€four€(4)Ïyears€incarceration€on€the€theft€charge,€four€(4)€sentences€of€twelve€(12)€yearsÏincarceration€on€the€aggravated€robbery€charges,€and€two€(2)€sentences€ofÏtwenty„five€(25)€years€incarceration€for€each€especially€aggravated€œrobberyÏconviction,›€with€all€sentences€to€run€concurrently.€€Petitioner€only€challenges€theÏconviction€for€first€degree€murder.€€He€argues€that€he€was€denied€his€SixthÏAmendment€right€to€the€effective€assistance€of€counsel.€€We€affirm€the€judgmentÏof€the€trial€court.ÌÌà ðIn€post„conviction€relief€proceedings€the€petitioner€has€the€burden€ofÏproving€the€allegations€in€his€petition€by€a€preponderance€of€the€evidence.ððÏòòMcBee€v.€Stateóó,€655€S.W.2d€191,€195€(Tenn.€Crim.€App.€1983).€€Furthermore,Ïthe€factual€findings€of€the€trial€court€in€hearings€ð ðare€conclusive€on€appeal€unlessÏthe€evidence€preponderates€against€the€judgment.ðð€€òòState€v.€Bufordóó,€666ÍS.W.2d€473,€475€(Tenn.€Crim.€App.€1983).€€In€reviewing€the€Sixth€AmendmentÏclaim€of€ineffective€assistance€of€counsel€by€Petitioner,€this€court€must€determineÏwhether€the€advice€given€or€services€rendered€by€the€attorney€are€within€theÏrange€of€competence€demanded€of€attorneys€in€criminal€cases.€€òòBaxter€v.€Roseóó,Ï523€S.W.2d€930,€936€(Tenn.€1975).€€To€prevail€on€a€claim€of€ineffectiveÏassistance€of€€counsel,€a€petitioner€ð ðmust€show€that€counselððs€representation€fellÏbelow€an€objective€standard€of€reasonablenessðð€and€that€this€performanceÏprejudiced€the€defense.€€To€satisfy€the€requirement€of€prejudice,€Petitioner€wouldÏhave€to€demonstrate€a€reasonable€probability€that,€but€for€counselððs€errors,€heÏwould€not€have€pled€guilty€and€would€have€insisted€on€going€to€trial.€€òòSeeóó€òòHill€v.ÏLockhartóó,€474€U.S.€52,€59€(1985);€òòBankston€v.€Stateóó,€815€S.W.2d€213,€215Ï(Tenn.€Crim.€App.€1991).ÌÌà àTwo€witnesses€testified€at€the€hearing€on€the€petition€for€post„convictionÏrelief.€€First,€the€Petitioner€testified€regarding€his€claims€of€trial€counselððsÏineffectiveness.€€He€stated€that€counsel€only€met€with€him€seven€times€prior€toÏtrial,€for€a€period€of€five€(5)€to€ten€(10)€minutes€per€visit.€€Due€to€the€short€natureÏof€the€œmeetings,›€in€which€Petitioner€felt€rushed,€he€did€not€have€time€toÏadequately€confer€with€his€counsel.€€Petitioner€then€testified€that€he€had€providedÏnames€of€potential€alibi€witnesses,€including€his€grandmother,€Bertha€Woods,Íand€an€unidentified€neighbor,€but€counsel€failed€to€interview€or€subpoena€themÏfor€trial.€€ÌÌà àPetitioner€further€testified€that€counsel€failed€to€provide€him€with€copies€ofÏany€discovery€information.€€Another€allegation€by€Petitioner€was€that€counselÏfailed€to€file€pre„trial€motions,€specifically€including€a€motion€to€suppressÏPetitionerððs€statement.€€Petitioner€stated€that€he€was€seventeen€(17)€years€oldÏat€the€time€he€was€questioned€by€the€police,€and€that€he€made€the€statementÏadmitting€the€above€acts€only€because€the€police€were€threatening€him.€€WhenÏPetitioner€questioned€counsel€regarding€the€motion€to€suppress,€he€told€PetitionerÏhe€was€ð ðputting€it€off€until€further€notice.ðð€€ÌÌà àOn€the€issue€of€his€plea€agreement,€Petitioner€stated€that€counsel€failed€toÏcorrectly€inform€him€of€the€consequences€of€that€plea€as€counsel€advised€himÏthat€he€would€only€serve€a€period€of€sixteen€(16)€and€one„half€(ðð)€yearsÏincarceration.€€When€Petitioner€told€counsel€he€did€not€want€to€plead€guilty€to€theÏmurder€charge,€but€only€to€the€remaining€charges,€counsel€informed€PetitionerÏthat€the€plea€was€ð ðall€or€nothing.ðð€€As€a€result€of€all€of€the€above,€PetitionerÏclaims€that€counsel€was€inadequately€prepared€for€trial€and€that€he€was,Ïtherefore,€forced€to€plead€guilty.€€Ìà àTrial€counsel€testified€for€the€State€regarding€his€representation€ofÏPetitioner.€€He€was€appointed€to€represent€Petitioner€and€worked€closely€withÏPetitionerððs€mother,€Jacqueline€Washington,€throughout€the€case.€€CounselÏstated€that€it€was€his€practice€to€confer€on€Sunday€afternoons€with€clients€whoÏwere€in€jail,€and€therefore€he€normally€met€with€Petitioner€on€that€particular€day€ofÏthe€week.€€He€also€met€with€Petitioner€on€various€œoccasions›€when€they€were€inÏcourt.€€Counsel€reported€that€in€his€claim€for€attorneyððs€fees,€he€was€reimbursedÏfor€12.7€hours€in€court€and€14.5€hours€of€time€spent€out€of€court€on€PetitionerððsÏcase.€€Also,€counsel€stated€that€any€short€meetings€between€himself€andÏPetitioner,€of€a€duration€less€than€half€an€hour,€were€not€recorded€on€this€sheetÏas€he€did€not€ask€for€compensation€for€that€amount€of€time.€€ÌÌà àCounsel€interviewed€the€only€alibi€witness€Petitioner€named,€BerthaÏWoods.€€Ms.€Woods,€Petitionerððs€grandmother,€was€in€poor€health€and€had€noÏspecific€recollection€of€the€events€that€took€place€on€the€day€in€question,Ïtherefore€counsel€was€not€able€to€use€her€as€an€alibi€witness.€€Counsel€recalledÏthat€Petitioner€told€him€œan›€upstairs€neighbor€would€also€serve€as€an€alibiÏwitness,€but€Petitioner€could€not€recall€that€neighborððs€name.€€The€attempts€ofÏcounsel€and€Petitionerððs€œmother›€to€locate€this€witness€were€to€no€avail.€€CounselÏrecollected€that€Petitioner€got€copies€of€all€of€the€discovery€information€which€wasÏavailable€to€him€prior€to€trial.ÌÌà àOn€the€issue€of€pre„trial€motions,€counsel€stated€that€he€filedÏapproximately€œten€(10)›€to€fifteen€œ(15)€motions›€prior€to€trial,€including€a€brief€motionÏto€suppress.€€The€prosecutor€informed€counsel€that€if€he€elected€to€argue€theÏmotion€to€suppress,€then€the€negotiated€plea€agreement€offer€would€be€revoked.€ÏBecause€trial€counsel€knew€that€he€could€defer€argument€on€the€motion€toÏsuppress€until€the€time€of€trial,€he€chose€not€to€argue€the€motion€at€that€time.€ÏRegarding€the€plea€bargain,€œcounsel›€did€not€recall€stating€that€Petitioner€wouldÏserve€only€sixteen€(16)€and€one„half€(ðð)€years,€but€standardly€advised€clientsÏthat€with€a€life€sentence€it€is€difficult€to€ascertain€how€long€the€actualÏincarceration€time€will€be.€€While€counsel€did€advise€Petitioner€that€he€wouldÏeither€have€to€take€the€Stateððs€offer€and€plead€guilty€to€all€charges€or€go€to€trialÏon€all€the€charges,€he€did€not€coerce€or€force€Petitioner€into€pleading€guilty.ÌÌà àUpon€review€of€the€record,€including€Petitionerððs€guilty€plea€hearing,€thisÏcourt€finds€that€the€Petitioner€was€not€denied€the€effective€assistance€of€counsel.€ÏThe€judge€chose€to€accredit€the€testimony€of€trial€counsel€over€that€of€PetitionerððsÏtestimony,€and€the€evidence€does€not€preponderate€against€these€findings.€ÏFrom€the€testimony€of€trial€counsel,€his€€preparation€was€more€than€sufficient€toÏprovide€Petitioner€with€effective€representation.€€In€addition€to€meeting€with€theÏPetitioner€€on€numerous€occasions,€counsel€interviewed€any€and€all€witnessesÍwhich€Petitioner€was€able€to€identify.€€The€complaint€regarding€the€ð ðunidentifiedððÏneighbor€is€completely€unjustified,€particularly€in€light€of€the€testimony€that€counselÏand€Petitionerððs€mother€attempted€to€locate€this€unnamed€alibi€witness.ÌOn€the€issue€of€alibi€witnesses,€a€petitioner€is€not€entitled€to€any€relief€ð ðunless€heÏcan€produce€a€material€witness€œwho€(a)›€could€have€been€found€by€aÏreasonable€investigation€and€(b)€would€have€testified€favorably€in€support€of€hisÏdefense€if€called.ðð€€òòBlack€v.€Stateóó,€794€S.W.2d€752,€758€(Tenn.€Crim.€App.Ï1990).€€This€court€may€not€speculate€on€whether€further€€investigation€wouldÏhave€revealed€a€material€witness€or€what€a€witnessððs€testimony€might€haveÏbeen,€and€it€was€Petitionerððs€duty€to€present€this€witness€at€the€evidentiaryÏhearing.€€òòIdóó.€at€757.€€ÌÌà àAnother€claim€by€Petitioner€which€was€not€proven€by€a€preponderance€ofÏthe€evidence€is€that€of€counselððs€failure€to€file€pre„trial€motions.€€€Counsel€testifiedÏthat€he€filed€ten€(10)€to€fifteen€(15)€pre„trial€motions,€including€a€brief€€motion€toÏsuppress€Petitionerððs€statement.€€When€questioned€as€to€why€he€chose€not€toÏargue€the€motion€to€suppress,€counsel€stated€that€he€was€advised€that€if€heÏargued€such€motion,€then€any€offers€for€a€plea€bargain€would€be€revoked€byÏthe€State.€€This€court€should€not€second„guess€trial€counselððs€tactical€andÏstrategic€choices€unless€those€choices€were€uninformed€because€of€inadequateÏpreparation.€€òòHellard€v.€Stateóó,€629€S.W.2d€4,€9€(Tenn.€1982).€€While€a€differentÍstrategy€might€have€been€employed€by€counsel,€counsel€may€not€be€deemedÏineffective€because€he€chose€not€to€argue€the€motion.€€òòSeeóó€òòWilliams€v.€Stateóó,Ï599€S.W.2d€276,€280€(Tenn.€Crim.€App.€1980).ÌÌà àPetitioner€has€failed€to€demonstrate€that€he€would€not€have€entered€aÏguilty€plea€were€it€not€for€the€ineffective€assistance€of€his€counsel.€€PetitionerÏwas€properly€advised€of€his€rights€by€trial€counsel€and€the€trial€judge€prior€toÏentering€a€plea€of€guilty,€which€he€did€voluntarily€and€knowingly.€€In€the€judgeððsÏfindings€of€fact,€he€correctly€reasoned€that€trial€counsel€recommended€the€plea€toÏPetitioner€after€extensive€consideration€of€all€factors€involved€and€lengthyÏnegotiations€with€the€State,€and€the€ð ðultimate€decisionðð€to€plead€guilty€was€madeÏby€Petitioner€after€conferring€with€his€mother€and€his€trial€counsel.€€ÌÌà
