(   ׀ Theappellantspetitionforwritofhabeascorpuschallengesbothhisconvictionandresultingsentenceforthecrimeofopenrebellionbaseduponthefollowinggrounds:(1)hisconfinementconstitutesexpostfactopunishment;(2)hissentenceisviolativeofequalprotection;(3)incarcerationhasdeniedhimdueprocessoflaw;and(4)hissentenceconstitutescruelandunusualpunishment.OnJune23,1997,thetrialcourt,withoutconductingahearing,entereda MemorandumandOrderdismissingtheappellantspetition.Theappellantappealsthisruling.@ BACKGROUND  OnJuly11,1985,astateofopenrebellion,instigatedbytheappellantandtwootherinmates,existedattheFt.PillowStatePrisoninLauderdaleCounty.Duringtheconfrontationandmeleebetweeninmatesandcorrectionalofficers,threeofficerswereseverelyinjured.ThedisturbancewaseventuallyquashedbytheprisonsTACTteam.Itwaslaterdeterminedthattheappellantwasaleaderintheprisonriotandparticipatedintheassaults.Theappellantwassubsequentlyconvictedbyajuryofopenrebellion,aggravatedassault,andsimpleassault.Theseconvictionsandsentenceswereaffirmedbythiscourtondirectappeal.SeeStatev.Willis,C.C.A.No.3,(Tenn.Crim.App.,atJackson,Jan.21,1987),perm.toappealdenied,(Tenn.,1987).̛̜@ ANALYSIS  Theappellantarguesthat,underthecurrentcriminalcode,whichbecameeffectivein1989, thetermofthesentenceappliedtoOpenRebellion[in1985]wassignificantlyreducedfromlifeimprisonmenttoan8to30yearperiodofincarceration.Thus,hecontendsthatthedisparatepunishmentinthetwocriminalcodesviolateshisrightofequalprotection,imposescruelandinhumanpunishment,violatesdueprocessandconstitutesexpostfactopunishment. Theappellantassertsthatthetrialcourtsmemorandumorderaddressedonlytheissueof equalprotection.Therefore,hecontendsthat,becausethecourtfailedtoaddresstheissuesofexpostfactopunishment,violationofdueprocessandcruelandunusualpunishment,thecasemustberemandedforadeterminationoftheseissues. )   כForthefollowingreasons,wedisagree. First,astatewritofhabeascorpuswillissueonlyinthecaseofavoidjudgmentortofreeaprisonerheldincustodyafterhistermofimprisonmenthasexpired.Tenn.Const.Art.1,15;Tenn.CodeAnn.2921101et.seq.(1990).Apetitionercannotcollaterallyattackafaciallyvalidconvictioninahabeascorpusproceeding.Pottsv.State,833S.W.2d60,62(Tenn.1992).Unlessitappearsonthefaceofthejudgmentortherecordoftheproceedingsthattheconvictingcourtlackedjurisdictionorthatthedefendantssentencehasexpired,ahabeascorpusproceedingcannotbemaintained.SeeArcherv.State,851S.W.2d157,164(Tenn.1993).BecausetheCircuitCourtofLauderdaleCountyhadjurisdictiontotryanddecidethecaseandtherecordreflectsthatthesentenceimposedhasnotexpired,habeascorpusreliefisnotavailable.Moreover,iffromthefaceofthepetition,thereviewingcourtsfindsnothingtoindicatethattheappellantschallengedconvictionsmightbevoid,thecourtshalldismissthepetitionandrefusetheissuanceofthewrit.SeeTenn.CodeAnn.2921101;109. Again,theappellantargues thatwhentheTennesseeSentencingReformActof1989wasincorporatedintolaw,thetermofthesentenceappliedtoOpenRebellionwassignificantlyreducedfromlifeimprisonmenttoan8to30yearperiodofincarcerationconsistentwithitsclassificationasaClassBfelony.Thisargumentismisplaced.ThecrimeofOpenRebellionascodifiedatTenn.CodeAnn.395712(1982)wasrepealeduponenactmentofthe1989CriminalCode.Thereisnoequivalentorcorrespondingcrimefoundinourcurrentcriminalcodefortherepealedoffenseofopenrebellion.Anindictmentchargingtheconductpreviouslyproscribedforthecrimeofopenrebellionwouldrequirethechargingofmultipleoffensesunderourcurrentcriminalcode. +   ׀Thestatutoryprovisionreferredtobytheappellantsimplyprovidesthat, for...sentencingpurposesafterNovember1,1989,indeterminingtheclassificationofafelonycommittedpriortoNovember1,1989,i.e., [r]ebellionbyaconvictwiththeintenttokillorescapeshallbeclassifiedasaclassBfelonyinestablishingtheappropriatesentencerange.Tenn.CodeAnn.4035118(1990). Finally,theappellantattemptstoutilizehabeasproceduresasavehiclefordirectappeal.Indeed,intheappellantsdirectappealtothiscourt,hepresentedthesameissueasintheinstantpetition,i.e., [w]hethertheimpositionofalifesentence,pursuanttoTenn.CodeAnn.395712,isviolativeoftheappellantsEighthAmendmentrighttobefreefromcruelandunusualpunishment.Willis,C.C.A.No.3.Notonlyisthisissueinappropriateforconsideration,itisresjudicata.Similarlypresentedaretheissuesofdueprocessandexpostfactopunishment.Apetitionforhabeascorpusreliefisaninappropriateprocedureinwhichtoreviewpotentialerrorsofatrialcourt.Richmondv.Barksdale,688S.W.2d86,88(Tenn.Ct.App.1984)(quotingStateexrel.Anglinv.Mitchell,575S.W.2d284(Tenn.1979)).Moreover,wenotethatthefactualallegationsofthiscasedonotpermitinvocationofanexpostfactochallenge.
