Ðto€get€some€things€from€the€house€in€order€to€sell€them€for€cash.€€He€told€LieutenantÏVastbinder€that€he€drank€some€tequila€and€played€with€Mr.€Blackleyððs€police€scanner.€ÏHe€said€that€he€collected€jewelry,€nickels€and€dimes€and€eighty„three€dollars€in€cashÏfrom€the€bedrooms.€€He€recounted€to€Lieutenant€Vastbinder€that€Ms.€WoodwardÏsurprised€him€when€she€arrived€home.€€He€admitted€that€he€displayed€the€.25€mm€pistolÏto€her€and€told€her€to€be€quiet.€€He€recalled€ordering€Ms.€Woodward€to€answer€theÏphone€when€someone€called€about€a€recent€car€purchase.€€He€told€LieutenantÏVastbinder€that€Mr.€Blackley€arrived€home€but€could€not€enter€in€the€front€door€becauseÏthe€chain€was€locked.€€He€recalled€that€he€ran€to€the€door,€pointed€the€gun€at€Mr.ÏBlackley€and€told€him€to€go€away.€€When€he€returned€to€the€bedroom,€Ms.€WoodwardÏwas€loading€a€shotgun.€€He€stated€that€a€struggle€ensued€during€which€he€slapped€Ms.ÏWoodward€to€try€to€get€her€away€from€him.€€He€told€Lieutenant€Vastbinder€that€he€fledÏthe€residence€and€changed€from€Mr.€Blackleyððs€clothes€in€a€nearby€wooded€area.ÌÌà àLieutenant€Vastbinder€testified€that€all€of€the€stolen€property€wasÏrecovered.€€He€also€stated€that€the€defendant€admitted€to€the€theft€of€the€items.€€HeÏsaid€that€the€.25€mm€pistol€was€found€with€one€shell€in€its€chamber.€€On€cross„¼examination,€he€stated€that€Ms.€Woodward€told€him€that€she€tried€to€flee€but€wasÏscared€of€the€defendant.€€ÌÌà àBecky€Woodward€testified€that€she€arrived€home€on€July€6th€around€6:00Ïp.m.€and€entered€through€the€unlocked€back€door.€€She€said€that€she€saw€the€mess€inÏMr.€Blackleyððs€bedroom€and€walked€toward€the€room.€€She€said€that€the€defendantÏjumped€out€from€behind€the€door,€with€a€stocking€covering€his€face,€and€threatened€herÏwith€a€pistol.€€She€stated€that€the€defendant€ordered€her€to€answer€the€phone€and€heldÏthe€gun€to€her€chin€as€she€spoke.€€She€recalled€that€the€defendant€was€wearing€Mr.ÏBlackleyððs€clothes€but€had€on€his€own€shoes.€€She€also€recalled€that€the€defendantÏsmelled€very€bad€and€had€alcohol€on€his€breath.Ð àMs.€Woodward€stated€that€when€Mr.€Blackley€arrived€home€and€attemptedÏto€enter€through€the€chained€front€door,€she€screamed€for€help€and€warned€him€that€theÏdefendant€had€a€gun.€€She€said€that€she€was€afraid€to€run€behind€the€defendant€as€heÏwent€to€the€front€door€and,€instead,€went€to€a€bedroom€to€load€the€shotgun.€€She€saidÏthat€the€defendant€found€her€loading€the€shotgun€and€a€struggle€resulted€during€whichÏshe€was€struck€twice€on€the€head€with€the€pistol.€€She€said€that€she€finally€fell€to€theÏfloor€and€acted€as€if€she€was€unconscious.€€While€on€the€floor,€she€heard€the€defendantÏgather€items€from€the€room€and€leave€through€the€back€door.€€€€€ÌÌà àMs.€Woodward€described€her€injuries€as€bruises€to€her€shoulder€and€backÏand€a€knot€on€her€head.€€She€also€said€that€she€received€a€total€of€four€stitches€on€herÏhead€in€two€different€places.€€She€testified€that€getting€the€stitches€was€very€painful.€€OnÏcross„examination,€she€stated€that€she€did€not€try€to€run€from€the€house€because€sheÏfelt€that€the€defendant€would€shoot€her.€€She€also€admitted€that€she€had€sufferedÏneither€broken€bones€nor€a€concussion€and€that€she€had€not€experienced€any€problemsÏassociated€with€the€injuries€after€the€removal€of€the€stitches.€€ÌÌà
