Thiscasepresentsanappealfromaconditionofprobationimposedbythetrialcourtuponaguiltypleatoachargeofsexualbattery.ThejudgmentoftheCourtofCriminalAppealsremovingtheconditionisaffirmed,andthecaseisremandedtothetrialcourt. TheoffensewascommittedinDecember1992atthedefendant'sresidencewhilehewaswrestlingwiththe16yearoldvictim.Whenthevictimrefusedthedefendant'srequestthathetakehisclothesoff,thedefendantunzippedthevictim'strousersandfondledhim.Thedefendantofferedthevictimmoneytohaveoralsexwithhim.Instead,thevictimimmediatelywenthomeandreportedtheincidenttohisparentsandthepolice. Followingtheincident,thedefendanttriedunsuccessfullytocommitsuicide.Aftertreatmentatahospital,hewasreferredtoaprogramforchildmolestersatthesexualabuseclinicattheUniversityofTennessee.Atthetimeofthesentencinghearing,thedefendanthadattendedtheweeklytreatmentsessionsforfourmonths.Psychologicalreportsenteredintoevidenceatthesentencinghearingbystipulationcontainedadmissionsthatthedefendanthadabusedotherteenageboys,includinghisthreestepsons.Thedefendanttestifiedthatthechildmolesterprogramassistedhiminmanaginghisanxiety,identifyingriskfactors,andcopingwithhiscondition. Atthesentencinghearing,thevictim'sfatherwasallowedtoreadastatement,whichprovidedinpartasfollows:8 ...8 IhaveacoupleofoptionsIwouldlikefortheCourttoconsider.OptionOne:Twoyearsinjail,....8 Optiontwo:Placeafourfootbyeightfootsigninhisfrontyardwhereitwillstate:Warning,allchildren,WayneBurdinisanadmittedandconvictedchildmolester.Parentsbeware.Thissignmuststayinclearviewofalltoseeforsixmonths.AndWayneBurdinmustbeundernighttimehomearrestforthatsixmonths'periodundercourtorder.8 ... ThetrialcourtsentencedthedefendantasaRangeIstandardoffendertooneyearinthecorrectionalcenterandimposeda$500.00fine.Thecourtsuspendedthesentenceandplacedthedefendantontwoyears'probation.Theconditionsofprobationwerethatthedefendantcontinuetherapysessionsandthatheplaceintheyardoftheresidencewherehelivedwithhismotherafourbyeightfootsignwithblacklettersoverayellowbackgroundstating:"Warning,allchildren.WayneBurdinisanadmittedandconvictedchildmolester.Parentsbeware."Thecourtorderedthatthesignbemaintainedforaperiodofsixmonthsduringwhichthedefendantwouldbeunderhousearrest. ThedefendantcontendsthatrequiringthatheerectthesignathisresidenceasaconditionofprobationisnotapunishmentauthorizedbytheCriminalSentencingActof1989and,further,thatimpositionoftheconditionviolatestheEighthAmendmenttotheConstitutionoftheUnitedStatesandArticleI,Section16oftheConstitutionofTennessee. Section4035401oftheActsetsforththestandardsforreviewingthetrialcourt'sdecisiononprobation:8 Whenreviewingsentencingissues...includingthegrantingordenialofprobation...theappellatecourtsshallconductadenovoreview...withapresumptionthatthedeterminationsmadebythecourtfromwhichtheappealistakenarecorrect.8 However,thepresumptionofcorrectnesswhichaccompaniesthetrialcourt'sactionisconditionedupontheaffirmativeshowingintherecordthatthetrialcourtconsideredthesentencingprinciplesandallrelevantfactsandcircumstances.Statev.Ashby,823S.W.2d166,169(Tenn.1991).
