#ÃÝòòÚ  Ú2Ú  ÚóóÝ  Ý×  ×€€Dr.€Walker€testified€thatÐ ˜ Ðpsychotherapy€offered€a€potential€benefit€to€the€plaintiff€during€the€early€acute€stagesÐ d\ Ðof€her€emotional€injury.€€The€record€reflects€that€the€plaintiff€went€to€two€psychotherapyÐ 0 ( Ðsessions€under€the€care€of€a€Dr.€Slaven×ƒÄ ×Ý ƒ #ÃÝòòÚ  Ú3Ú  ÚóóÝ  Ý×  ×€in€April€and€May€of€1996.€€The€plaintiffÐ ü!ô Ðdeclined€further€treatment€by€Dr.€Slaven€and€told€Dr.€Walker€that€the€sessions€with€Dr.Ð È#À  ÐSlaven€made€her€feel€stupid.€€Dr.€Walker€urged€the€plaintiff€to€obtain€psychotherapyÐ ”%Œ" Ðfrom€other€psychologists€and€recommended€that€she€see€Dr.€Denise€Tope.€€DespiteÐ `'X $ ÐDr.€Walkerððs€advice,€the€plaintiff€did€not€pursue€additional€psychotherapy.׃J ×Ý ƒ #ÃÝòòÚ  Ú4Ú  ÚóóÝ  Ý×  ×€€€€€Ð ,)$"& Їà Ø àThe€plaintiffððs€treatment€consisted€primarily€of€medicine€and€psychiatricÐ  Ðcounseling€from€Dr.€Walker.€€Dr.€Walker€prescribed€various€anti„depressant€and€anti„Ð ÔÌ Ðanxiety€medications€for€the€plaintiff€and€monitored€her€condition€during€their€meetings.€Ð   ˜ ÐAfter€several€months€of€evaluation,€Dr.€Walker€noted€that€the€plaintiffððs€symptomsÐ l d Ðwere€becoming€chronic.€€Those€symptoms€included€intense€paranoia€when€in€publicÐ 80 Ðareas,€fear€of€strangers€and€crowded€places,€difficulty€sleeping€and€relaxing,Ð ü  Ðoccasional€flashbacks€and€anxiety€attacks,€and€feelings€of€hopelessness€andÐ ÐÈ  Ðdepression.€€Dr.€Walker€opined€that€the€plaintiffððs€symptoms€were€all€related€to€theÐ œ”  Ðtrauma€that€she€experienced€from€the€robbery.€€Because€those€symptoms€persisted,Ð h` ÐDr.€Walker€ultimately€diagnosed€the€plaintiff€with€posttraumatic€stress€disorder.€€€€€€€€€Ð 4, ÐÌà Ø àDr.€Walker€testified€that€during€the€early€stages€of€the€plaintiffððs€disorder,€sheÐ ÌÄ Ðencouraged€the€plaintiff€to€return€to€some€type€of€gainful€employment.׃ F×Ý ƒ #ÃÝòòÚ  Ú5Ú  ÚóóÝ  Ý×  ×€€Dr.€WalkerÐ ˜ Ðopined€at€that€time€that€subsequent€employment€would€help€the€plaintiff€to€rebuild€herÐ d\ Ðself„esteem€and€would€instill€productivity€back€into€her€life.€€With€the€assistance€ofÐ 0 ( ÐJane€Colvin„Roberson,€a€case€manager€hired€by€the€defendant,€Dr.€Walker€discussedÐ ü!ô Ðoptions€for€the€plaintiffððs€gradual€return€to€the€work€force.€€The€defendant€offered€theÐ È#À  Ðplaintiff€several€employment€options€during€the€summer€and€fall€of€1996,€including€herÐ ”%Œ" Ðprevious€position€at€the€Bread€Box€Food€Store,€similar€positions€at€other€nearbyÐ `'X $ Ðconvenience€stores€owned€by€the€defendant,€and€a€position€with€one€of€theÐ ,)$"& Ðâ âdefendantððs€larger€grocery€stores.׃Š×Ý ƒ #ÃÝòòÚ  Ú6Ú  ÚóóÝ  Ý×  ×€€The€plaintiff€also€considered€working€in€maidÐ ø*ð#( Ðservice€for€a€motel€as€she€had€previously€done.€€Nevertheless,€she€did€not€return€toÐ  Ðany€form€of€employment€except€a€part„time€babysitting€job.€€€Ð ÔÌ Ðâ âÌà Ø àOn€January€16,€1997,€Dr.€Walker€reported€to€Ms.€Colvin„Roberson€that€theÐ l d Ðplaintiff€had€reached€maximum€medical€improvement.€€Dr.€Walker€opined€that€theÐ 80 Ðplaintiff€still€suffered€from€post€traumatic€stress€disorder€with€a€moderate€permanentÐ ü  Ðclinical€impairment.€€Due€to€the€plaintiffððs€chronic€anxiety€and€fear€of€public€places,€Dr.Ð ÐÈ  ÐWalker€changed€her€initial€opinion€concerning€the€plaintiffððs€ability€to€work.€€Dr.€WalkerÐ œ”  Ðtestified€that€based€upon€her€most€recent€evaluations€of€the€plaintiff€in€the€Fall€ofÐ h` Ð1997,€she€believed€that€the€plaintiff€would€not€be€able€to€sustain€meaningfulÐ 4, Ðemployment€outside€her€home.׃×Ý ƒ #ÃÝòòÚ  Ú7Ú  ÚóóÝ  Ý×  ×€€Ð ø ÐÌà Ø àDr.€Walkerððs€opinion€was€corroborated€by€Dr.€Jerry€B.€Lemler,׃F×Ý ƒ #ÃÝòòÚ  Ú8Ú  ÚóóÝ  Ý×  ×€who€examinedÐ ˜ Ðthe€plaintiff€at€the€request€of€plaintiffððs€counsel.€€Dr.€Lemler€conducted€a€ninety„minuteÐ d\ Ðinterview€of€the€plaintiff€on€April€15,€1997.€€Based€upon€his€evaluation€and€the€initialÐ 0 ( Ðpatient€report€from€Dr.€Walker,€Dr.€Lemler€diagnosed€the€plaintiff€with€post€traumaticÐ ü!ô Ðstress€disorder.€€He€characterized€her€condition€as€ð ðmoderateðð€under€the€fourth€editionÐ È#À  Ðof€the€American€Medical€Association€(AMA)€guidelines,€indicating€that€the€plaintiff€hasÐ ”%Œ" Ðsome,€but€not€all,€useful€functioning.€€Dr.€Lemler€testified€in€his€deposition€that€theÐ `'X $ Ðplaintiffððs€high€anxiety€level€inhibits€her€ability€to€focus€and€to€engage€in€meaningfulÐ ,)$"& Ðsocial€interaction.€€As€related€to€employment,€Dr.€Lemler€opined€that€the€plaintiff€wouldÐ ø*ð#( Ðâ âbe€unable€to€concentrate€for€any€sustained€periods€of€time€and€would€be€unable€toÐ Ä,¼%* Ðtolerate€ordinary€work€stresses€outside€of€her€home.€€He€concluded€that€the€plaintiffÐ  Ðcould€not€engage€in€gainful€employment€on€a€consistent€basis.Ð ÔÌ Ðâ âÌà Ø àOver€the€objection€of€the€defendantððs€counsel,€both€Dr.€Lemler€and€Dr.€WalkerÐ l d Ðassessed€the€plaintiffððs€mental€impairment€at€fifty€percent€to€the€body€as€a€whole.€€TheÐ 80 Ðimpairment€rating€came€from€an€outdated€second€edition€of€the€AMA€guidelines.€€BothÐ ü  Ðdoctors€acknowledged€that€under€the€current€fourth€edition€of€the€AMA€guidelines,Ð ÐÈ  Ðthere€is€no€scientifically€accepted€method€for€assigning€a€percentage€of€impairment€toÐ œ”  Ðemotional€injuries.€€The€fourth€edition€of€the€AMA€guidelines€cautions€that€the€use€ofÐ h` Ðpercentages€for€psychological€impairments€is€highly€subjective.€€Nevertheless,€bothÐ 4, Ðdoctors€relied€upon€the€second€edition€of€the€AMA€guidelines,€at€the€request€ofÐ ø Ðplaintiffððs€counsel,€to€assign€a€percentage€of€impairment.€€The€doctors€opined€that€theÐ ÌÄ Ðplaintiffððs€impairment€will€most€likely€persist€for€the€remainder€of€her€life.€€€Ð ˜ ÐÌà Ø àDr.€Norman€Hankins,€a€vocational€expert,€testified€by€deposition€that€heÐ 0 ( Ðevaluated€the€plaintiff€on€two€separate€occasions€to€assess€any€vocational€disability.€Ð ü!ô ÐDr.€Hankins€first€interviewed€the€plaintiff€on€March€26,€1997.€€He€examined€theÐ È#À  Ðplaintiffððs€emotional€condition,€employment€history,׃×Ý ƒ #ÃÝòòÚ  Ú9Ú  ÚóóÝ  Ý×  ×€and€the€initial€patient€report€fromÐ ”%Œ" ÐDr.€Walker.€€He€found€that€the€plaintiff€had€no€special€or€transferable€vocational€skillsÐ `'X $ Ðand€that€she€had€been€working€in€manual€labor€most€of€her€life.€€He€also€found€thatÐ ,)$"& Ðthe€plaintiff€had€quit€high€school€after€the€tenth€grade€and€had€never€obtained€a€GEDÐ ø*ð#( Ðor€further€education.€€Dr.€Hankins€testified€that€the€plaintiff€had€an€average€ability€toÐ Ä,¼%* Ðlearn€and€an€IQ€in€the€ð ðaverageðð€range;€however,€he€assessed€her€reading€andÐ .ˆ', Ðmathematical€skills€as€generally€poor€for€her€age.€€Based€upon€his€findings€from€theÐ \0T). Ì,Ä%* ÐÐ ˜.', Ðà Ø àRelying€on€those€definitions,€we€conclude€that€the€mental€faculties€scheduleÐ  Ðunder€section€207(3)(A)(ff)€was€intended€to€encompass€two€basic€types€of€injuries.€Ð ÔÌ ÐThe€first€type€involves€mental€impairment€that€results€from€physical€trauma€to€theÐ   ˜ Ðbrain.€€An€example€of€this€type€of€injury€is€where€an€employee€suffers€a€physical€blowÐ l d Ðto€the€head,€causing€a€brain€injury,€while€performing€a€work„related€task.€€With€theÐ 80 Ðassistance€of€expert€medical€and€psychological€testimony,€the€employee€canÐ ü  Ðdemonstrate€the€extent€of€brain€damage€and€how€that€damage€has€decreased€his€orÐ ÐÈ  Ðher€ability€to€think€and€to€perform€mental€operations.€€The€employeeððs€claim€forÐ œ”  Ðworkersðð€compensation€benefits€would€be€based,€at€least€in€part,€on€the€degree€ofÐ h` Ðimpaired€cognitive€functioning.€€Ð 4, ÐÌà Ø àThe€second€type€of€mental€faculties€injury€under€section€207(3)(A)(ff)€involves€aÐ ÌÄ Ðmental€or€emotional€disorder€that€results€from€a€non„physical€injury.€€As€this€Court€hasÐ ˜
