àOn€January18,€1995,€the€petitioner,€John€Jaco,€filed€aÏpetition€for€judicial€review€of€a€final€administrative€decision€by€theÏDepartment€of€Health,€Bureau€of€Medicaid€(the€Department),€denying€theÏpetitionerððs€application€for€medicaid€benefits.€€The€petition€wasÏfiled€58€days€after€the€date€on€which€the€administrative€decisionÏbecame€final.€€Copies€of€the€petition€were€mailed€to€and€received€byÏthe€Department€and€by€the€Attorney€General.€€On€March24,€1995,Ïcounsel€for€the€petitioner€caused€a€summons€to€be€issued€and€served€onÏthe€Department€and€the€Attorney€General.ÌÌà ðwithout€any€forced€or€subtleÏconstruction€extending€its€œimport.ððÌ›œÌ›ÌÌòòÓÓMcClain€v.€Henry€I.€Siegel€Coóó.,€834€S.W.2d€295,€296€(Tenn.€1992)Ï(quoting€òòWorrall€v.€Kroger€Co.óó,€545€S.W.2d€736,€738€(Tenn.€1977)).ÌÌà àThe€statute€by€its€terms€does€not€require€that€a€summons€beÏfiled€in€order€to€obtain€judicial€review.€€Subsection€(b)(l)€statesÏthat€ð ð[p]roceedings€for€review€are€instituted€by€filing€a€petition€forÏreview.ðð€€The€statute€then€states€that€ð ð[s]uch€petitionðð€shall€beÏfiled€within€60€days€after€the€entry€of€the€final€decision€in€the€caseÏto€be€reviewed.€€This€subsection€does€not€refer€directly€or€byÏreference€to€a€summons.€€ÌÌà àThe€next€subsection,€(b)(2),€sets€forth€the€procedure€to€beÍfollowed€if€the€petition€is€filed€in€an€inappropriate€court.€€Again,Ïit€refers€only€to€ð ða€petition€for€judicial€reviewðð€and€provides€thatÏthe€case€be€transferred€to€the€appropriate€court.€€The€Rules€of€CivilÏProcedure€are€mentioned€in€the€statute€only€in€reference€to€service€ofÏcopies€of€the€petition.€€Again,€only€the€petition€is€mentioned:€Ïð ðCopies€of€the€petition€shall€be€served€upon€the€agency€and€allÏparties€of€record,€including€the€attorney€general€and€reporter,€inÏaccordance€with€the€provisions€of€the€Tennessee€Rules€of€CivilÏProcedure€pertaining€to€service€of€process.ðð€€The€applicability€of€theÏrules€to€the€statutory€procedure€is€limited€to€the€rules€ð ðpertainingÏto€service€of€process.ðð€€Significantly,€the€statute€does€not€refer€toÏthe€rules€pertaining€to€the€commencement€of€an€action,€but€only€to€theÏrules€pertaining€to€the€service€of€process.€€In€addition,€theÏreference€in€the€statute€to€ð ðall€parties€of€recordðð€indicates€aÏcontinuing€proceeding€in€which€the€parties€have€been€determined€andÏare€òòof€recordóó.€€The€service€of€a€summons€on€ð ða€party€of€recordðð€wouldÏserve€no€useful€purpose€not€accomplished€by€the€service€of€a€copy€ofÏthe€petition.€€€ÌÌà àThe€Department€insists€that€Rule€4.04€requires€the€filingÏand€issuing€of€a€summons€in€every€case€of€judicial€review.€€Rule€4.04Ïprovides:ÌÌÓÓà8 àThe€plaintiff€shall€furnish€the€person€making€theÍservice€with€such€copies€of€the€summons€andÏcomplaint€as€are€necessary.€€Service€shall€be€madeÏas€follows:ÌÌà8 à€€€€€.€.€.ÌÌà8 à€€€€€(8)€Upon€the€state€of€Tennessee€or€any€agencyÏthereof,€by€delivering€a€copy€of€the€summons€andÏof€the€complaint€to€the€attorney€general€of€theÏstate€or€to€any€assistant€attorney€general.ÓÓÌÌTenn.€R.€Civ.€P.€4.04.ÌÌà àThis€rule€obviously€sets€forth€the€procedure€to€be€followedÏin€commencing€an€action€against€a€state€agency.€€However,€it€does€notÏfollow€that€the€applicable€provisions€of€Rule€4€regarding€€service€ofÏprocess€cannot€be€utilized€by€reference€in€the€AdministrativeÏProcedures€Act€without€incorporating€into€that€statutory€procedure€theÏinapplicable€provisions.€€The€ð ðprocessðð€served€in€an€original€civilÏaction€to€which€Rule€4€applies€are€the€complaint€and€summons,€Tenn.€R.ÏCiv.€P.€3,€while€the€ð ðprocessðð€in€a€proceeding€for€review€of€anÏadministrative€decision€is€a€petition€for€review.€€The€process€is€notÏthe€same,€but€since€the€method€and€means€of€service€set€forth€in€theÏrules€have€been€adopted€by€the€statute,€the€method€and€means€ofÏservice€are€the€same.€€ÌÌà àThe€Department€relies€upon€òòHRA,€Inc.€v.€Tenn.€Dept.€ofÏCommerce€and€Ins.óó,€914€S.W.2d€512,€513„14€(Tenn.€Ct.€App.€1995),€whichÍis€the€only€reported€decision€in€which€the€issue€before€the€Court€hasÏbeen€discussed.€€In€that€case,€the€final€administrative€decision€wasÏmade€by€the€Tennessee€Department€of€Commerce€and€Insurance.€€The€issueÏin€the€contested€case€was€the€ð ðexperience€modification€factorððÏapplicable€to€HRA€for€determining€the€premium€for€ð ðassigned€riskÏworkersðð€compensation€insurance.ðð€€That€factor€was€determined€by€theÏNational€Council€on€Compensation€Insurance€(NCCI)€subject€to€finalÏapproval€by€the€Department€of€Commerce€and€Insurance.€€HRA€filed€aÏpetition€for€judicial€review€of€the€administrative€decision.€€TheÏpetition€named€only€the€Department€of€Commerce€and€Insurance€as€aÏdefendant.€€A€copy€of€the€petition€was€served€on€the€Department,€and€aÏcopy€was€delivered€to€the€attorney€who€had€represented€NCCI€in€theÏadministrative€proceedings.ÌÌà àThe€Court€of€Appeals€held€that€the€petitioner€had€failed€toÏpreserve€its€right€of€review€against€NCCI,€the€only€party€againstÏwhich€the€petitioner€stated€a€ð ðviable€issue.ðð€€òòId.óó€at€516.€€AlthoughÏnot€essential€to€its€decision,€the€Court€of€Appeals€stated:€€ð
