àThe€rules€of€appellate€procedure€provide€courts€with€wideÏdiscretion€and€substantial€flexibility.€€òòHuskey€v.€Crispóó,€865€S.W.2d€451,Ï455€(Tenn.€1993).€€An€appellate€court,€"[f]or€good€cause,€including€theÏinterest€of€expediting€decision€upon€any€matter,€.€.€.€may€suspend€theÏrequirements€or€provisions€of€[the]€rules€in€a€particular€case€.€.€.€."€€Tenn.ÏR.€App.€P.€2.× ƒb ××  ×€€€The€rules€may€be€suspended€upon€motion€of€a€party,€orÏupon€the€motion€of€the€court,€in€its€own€discretion.€€€òòId.óó€€€€Moreover,€anÏappellate€court€may€grant€the€parties€any€"relief€on€the€law€and€facts€toÏwhich€[a]€party€is€entitled€or€the€proceeding€otherwise€requires"€unless€theÏrelief€would€contravene€the€ð ðprovince€of€the€trier€of€fact.ðð€€Tenn.€R.€App.ÏP.€36(a).€€ÌÌà àThus,€the€overall€intent€of€the€rules€is€to€allow€cases€to€beÏresolved€on€their€merits.€€A€courtððs€construction€and€application€of€theÍrules€should€further€that€intent€and€should€enhance,€€not€impede,€the€searchÏfor€justice.€€Tennessee€appellate€courts€must€give€thoughtful€considerationÏto€the€intent€of€the€rules€each€time€a€procedural€matter€is€resolved.€€ÌÌà àNotwithstanding€this€unquestionable€policy€behind€the€rules,Ïparties€who€wish€to€receive€a€full,€fair,€and€speedy€resolution€on€the€meritsÏof€the€cases€they€appeal€should€endeavor€to€comply€with€the€rulesððÏrequirements.€€An€appellate€court€cannot€review€an€empty€record€orÏaddress€a€poorly€articulated€issue.€€Thus,€the€rules€anticipate€that€both€theÏparties€and€the€courts€will€act€diligently€and€responsibly€to€assure€thatÏappeals€are€resolved€on€the€merits.ÌÌà àWithout€a€doubt,€œplaintiffsðð›€counsel€failed€to€follow€theÏprovisions€of€Rule€24.€€Rule€24€governs€the€contents€of€the€record€onÏappeal.€€It€requires€that€ð ðthe€appellant€shall€have€prepared€a€transcript€ofÏsuch€part€of€evidence€or€proceedings€as€is€necessary€to€convey€a€fair,Ïaccurate€and€complete€account€of€what€transpired€with€respect€to€thoseÏissues€that€are€the€bases€of€appeal.ðð€€Tenn.€R.€App.€P.€24(b).€€If€a€fullÏtranscript€is€not€required,€an€appellant€must€ð ðfile€with€the€clerk€of€the€trialÍcourt€and€serve€on€the€appellee€a€description€of€the€parts€of€the€transcriptÏ[the€appellant]€intends€to€include€in€the€record,€accompanied€by€a€short€andÏplain€declaration€of€the€issues€.€.€.€."€€Tenn.€R.€App.€P.€24(b).€€The€purposeÏof€this€provision€is€self„evident.€€Once€notified€that€less€than€a€completeÏtranscript€will€be€filed,€€appellee€may€consider€whether€the€portionsÏdesignated€are€sufficient€to€resolve€the€issues€raised€and,€if€not,€mayÏdesignate€additional€parts.× ƒc ××  ×€€òòIdóó.€€ÌÌà àPlaintiffsðð€counsel,€in€this€instance,€relied€upon€a€telephone€callÏto€the€trial€court€clerk€to€designate€portions€of€the€record.€€Counsel€servedÏno€notice€on€defendants.€€Moreover,€the€portion€of€the€transcript,€attachedÏto€the€motion€for€new€trial€included€in€the€technical€record,€was€not€aÏcertified€transcript€as€required€by€the€rules.€€Tenn.€R.€App.€P.€24(b).ÌÌà àWhen€the€allotted€time€period€for€filing€the€transcript€hadÏpassed,€defendants,€understandably€believing€that€plaintiffs€had€failed€toÏpursue€their€appeal,€moved€for€dismissal€under€Rule€26(b).€€€At€this€point,Íplaintiffs€attempted€to€rectify€their€failure€by€requesting€permission€to€fileÏthe€designation€late.€€The€Court€of€Appeals€denied€the€request.ÌÌà àUnder€the€unique€circumstances€of€this€case,€in€which€allÏparties€were€aware€of€the€basis€for€the€appeal€and€in€which€a€full€transcriptÏwas€not€necessary€to€convey€the€issue,€we€believe€the€motion€should€haveÏbeen€granted.€€A€suspension€of€the€rules€would€have€been€completelyÏconsonant€with€the€"just,€speedy,€and€inexpensive€determination"€of€thisÏcase€on€its€merits.€€A€late€designation€would€have€satisfied€the€purposes€ofÏRule€24(b).€€Defendants€would€have€had€the€opportunity€to€designateÏadditional€portions€of€the€transcript.€€The€appellate€court€would€have€hadÏbefore€it€a€full€and€fair€record€on€which€to€resolve€the€issue.€€The€volley€ofÏmotions€and€responses€that€resulted€from€the€denial€would€have€beenÏavoided.€€The€hearing€in€the€trial€court€may€not€have€been€necessary.€€ÌÌà àIn€addition€to€satisfying€the€overall€objectives€of€the€rules,€ourÏdetermination€that€this€appeal€should€not€have€been€dismissed€finds€supportÏin€specific€provisions€of€the€rules.€€Rule€26€grants€the€appellate€court€theÏdiscretion€to€rectify€error€rather€than€dismissing€the€appeal€by€providing:ÌÓÓà8 àIn€lieu€of€granting€the€motion€[to€dismiss]€or€ò òatÏany€time€on€its€own€motionó ó,€the€appellateÏcourt€may€order€filing€of€the€transcript€orÏstatement.€€ÌÌÓÓTenn.€R.€App.€P.€26(b)(emphasis€added).€€Furthermore,€Rule€24(e)€allows€Ïthe€modification€or€supplementation€of€the€record€with€any€matter€the€trialÏcourt€deems€properly€includable.€€Tenn.€R.€App.€P.€24(e).ÌÌà àWe€do€not€condone€the€negligence€of€counsel.€€The€provisionsÏof€Rule€24€regarding€the€designation,€preparation,€and€certification€of€theÏtranscript€are€clear€and€unambiguous.€€A€brief€review€of€the€rule€prior€toÏfiling€a€notice€of€appeal€will€provide€adequate€instruction€to€carefulÏcounsel.€€Nonetheless,€we€hold€that€in€this€case,€the€dismissal€of€this€appealÏwas€inconsistent€with€the€spirit€and€intent€of€the€rules.€€òòSeeóó€òòBradshaw€v.ÏDanielóó,€854€S.W.2d€at€868„869;€òòDavis€v.€Sadleróó,€612€S.W.2d€at€161.€ÏTherefore,€we€reverse€the€Court€of€Appeals€order€denying€plaintiffsððÏmotion€to€supplement€the€record€and€dismissing€the€appeal.€€ÌÌà àDefendants€contend€that€the€portion€of€the€transcriptÏsupplemented€by€the€trial€judge€is€insufficient€to€convey€the€issue€before€us.€ÏWe€disagree.€€The€transcript€contains€the€trial€judgeððs€final€instructions€toÏthe€jury€in€full€as€well€as€the€judgeððs€colloquy€with€counsel€and€the€jury.€ÍDefendants€do€not€question€the€accuracy€of€the€portion€of€the€transcriptÏcertified€by€the€trial€judge.€€They€have€not€attempted€to€designateÏadditional€portions€or€to€supplement€the€record.€€This€record€conveys€aÏ"fair,€accurate€and€complete€account€of€what€transpired"€with€respect€to€theÏsingle€issue€raised€in€this€appeal.€€Tenn.€R.€App.€P.€24(b).€€Accordingly,Ïrather€than€remand€this€case€for€consideration€by€the€Court€of€Appeals,€weÏwill€address€the€substantive€issue.€€Tenn.€R.€App.€P.€1,€2,€&€36(a).ÌÌà@ àAfter€more€than€twelve€hours€of€deliberations,€over€the€courseÏof€two€days,€the€trial€judge€received€a€note€from€the€foreperson.€€In€theÏpresence€of€counsel,€trial€judge€read€the€note€into€the€record:ÌÓÓà8 àWe€seem€to€have€reached€an€impasse.€€There€areÏsome€who€feel€that€we€have€gone€over€this€andÏthat€it€is€futile€to€continue,€that€to€„„€[I€donððt€knowÏwhat€that€word€is]€„„€that€to€quit,€I€canððt€take€itÏanymore,€I€have€got€to€get€out€of€here.€What€shallÏwe€do?€€Regretfully,€The€Foreman.ÌÌÌÌÓÓà àPlaintiffsðð€counsel€immediately€moved€for€a€mistrial.€€DefenseÏcounsel€suggested€that€the€judge€bring€the€jury€back€before€deciding€toÍdeclare€a€mistrial.€€The€judge€agreed€despite€a€previous€similar€indicationÏfrom€the€jury.× ƒf ××  ×ÌÌà àOnce€the€jury€was€assembled,€the€judge€asked€each€jurorÏindividually€if€further€deliberation€would€be€of€value.€€The€majority€ofÏjurors€stated,€without€hesitation,€that€the€jury€was€deadlocked;€two€gaveÏuncertain€responses;€and€one€indicated€that€further€deliberations€wouldÏproduce€a€verdict.€€The€judge€then€delivered€the€following€remarks:€€ÌÓÓà8 àà àWell,€I€donððt€want€any€of€you€to€surrenderÏyour€convictions,€beliefs€or€anything€of€thatÏnature.€€Let€me€tell€you€some€of€my€problems.ÌÌà8 àà àMy€problems€are€that€this€jurisdiction,€asÏwell€as€all€jurisdictions,€have€more€than€we€can€allÏsay€grace€over.€€I€have€tried€almost€1400€casesÏlast€year,€and€I€will€do€the€same€thing€this€year.€ÏHow€we€were€put€in€this€sort€of€standing,€Iððve€hadÏto€put€aside€other€work€to€try€this€case,€or€haveÏone€of€my€fellow€judges€to€try€this€case,€seven€orÏeight€days€or€what€have€you.€€ÌÌà8 àNow,€let€me€just€say€this€to€you.€€ContraryÏto€popular€belief,€we€spend€motion€days,€trialÏpreparation,€trial€management€conferences€and€allÏthose€things,€and€I€come€to€work€„„€Iððm€notÏbegging€for€sympathy€because€Iððm€paid€well€forÏmy€work,€but€I€come€to€work€no€later€than€7:30,Ïstay€here€until€5:00,€donððt€work€on€the€weekends.€ÏSo€these€lawyers€from€both€sides€prepare€like€theÏdickens.ÌÌà8 àIt€seems€to€me€that€without€surrenderingÏyour€convictions€or€what€have€you,€I€would€likeÏto€send€you€to€a€different€place€to€have€lunch,€andÏIððm€talking€about,€Iððm€thinking€about€Shoneyððs;Ïand€then€you€come€back€and€just€spend€a€littleÏmore€time€as€to€whether€you€can€give€anÏadvisory.€€Iððm€talking€about€an€advisory€to€meÏand€to€these€lawyers.€€Some€sort€of€answer€isÏbetter€than€nothing.ÌÌà8 àà àNow,€I€know€you€spent,€oh,€a€long,€longÏtime,€and€I€feel€badly€asking€you€to€do€this,€but€IÏwould€like,€I€would€like€to€just€send€you€downÏthere€and€let€you€order€whatever€you€please.€€IÏdonððt€think€they€serve€caviar,€and€thatððs€about€theÏcostliest€thing€that€I€think€you€could€ever€get,€butÏI€will€even€pay€for€the€tips€myself.€.€.€.€ÌÌà8 àà àSome€good€jurors€have€got€to€try€this€case,Ïand€thereððs€no€better€bunch€than€you.€€ÌÌÓÓA€second€juror€inquired€whether€the€jury€was€required€to€use€the€verdictÏform.€€The€judge€responded:ÌÓÓà8 àNo.€.€.€.You€could€write€to€your€œheartððs›€content.€ÏAnd€if€we€canððt€understand€it,€itððs€our€tough€luck.€ÏBut€some€sort€of€an€advisory€other€than€myÏsaying€goodby€to€you.ÌÌà àÌÓÓà àThe€trial€court€then€inquired€whether€the€jury€was€willing€toÏgo€to€lunch€and€then€give€an€advisory€opinion.€€Each€juror€agreed.€€OnceÏthe€jury€left€the€court€room,€the€trial€judge€explained€to€counsel:€"Let€themÏwrite€out€whatever€they€doggone€want€to,€and€then€I€will€let€you€allÏinterview€these€people,€what€have€you,€after€that.€€They€have€heard€all€ofÏthis€proof€and€so€forth,€and€if€thereððs€anything€I€despise,€itððs€a€jury€walkingÏout€and€just€giving€up."ÌÌà àPlaintiffsðð€counsel€again€moved€for€a€mistrial€noting€that€oneÏjuror€had€been€crying€for€two€days€and€questioned€the€instructions€to€issueÏan€"advisory."€€The€judge€explained:€€ÌÓÓà8 àI€donððt€know€what€they€are€thinking,€and€I€wouldÏlike€to€know€what€they€are€thinking.€€I€think€thatÏmight€be€helpful€to€the€two€of€you.€.€.€.€ÌÌà8 àà àWell,€my€friends,€Iððm€just€saying€that€inÏyour€negotiating,€if€we€had€one€of€our€juries€justÏfor€an€advisory€thing€and€you€were€stating€theÏevidence,€we€had€done€that€over€a€period€of€a€dayÏor€two,€thatððs€what€youððd€get€back.ÌÌÓÓÌà àApproximately€one€hour€after€they€returned€from€lunch,€theÏjury€sent€the€judge€the€following€note€written€on€the€back€of€the€specialÏverdict€form:ÌÓÓà8 àWe,€the€jury€believe€that€Dr.€William€E.€HardinÏhas€met€the€very€minimum€acceptable€standards€ofÏcare€according€to€the€law.€€However,€we€stronglyÏbelieve€that€the€minimum€acceptable€standardÏdesperately€needs€to€be€raised.€€Therefore,€weÏhave€no€choice€but€to€find€Dr.€W.€E.€Hardin€notÏguilty€of€malpractice.ÌÌÌÓÓà àWe€conclude€without€hesitation€that€the€judgeððs€remarks€in€thisÏcase€constitute€a€coercive€jury€instruction€contrary€to€the€rule€of€òòKersey€v.ÏStateóó,€525€S.W.2d€139€Ô€UÔ(Ô€VÔTenn.€1975).€€òòSeeóó€òòalsoóó€òòVanderbilt€University€v.ÏSteelyóó,€566€S.W.2d€853€(Tenn.€1978).€€In€òòKersey€v.€Stateóó,€we€concludedÏthat€"the€interests€of€justice€demand€the€rejection€of€the€ððdynamiteðð€charge"Ïadopted€in€òòSimmons€v.€Stateóó,€281€S.W.2d€487€(Tenn.€1955).€òòKersey€v.ÏStateóó,€525€S.W.2d€at€144.× ƒh ××  ×€€€We€recognized€that€the€right€to€trial€by€juryÏmust€not€be€impaired€or€encumbered,€and€that€"[a]ny€undue€intrusion€byÏthe€trial€judge€into€this€exclusive€province€of€the€jury,€is€an€error€of€theÍfirst€magnitude."€€òòIdóó.€€A€trial€judge€has€a€legitimate€interest€in€theÏadministration€of€justice€and€must€guide€the€juryððs€deliberation€byÏinstructing€it€on€the€governing€rules€of€law.€€However,€if€a€judgeððs€effort€toÏavoid€a€mistrial€ð ðreaches€the€point€[that]€a€single€juror€may€be€coerced€intoÏsurrendering€views€conscientiously€entertained,€the€juryððs€province€isÏinvaded€and€the€requirement€of€unanimity€is€diluted."€€òòId.óó€ÌÌà àThe€òòKerseyóó€Court€then€adopted€the€American€Bar€AssociationÏGuidelines€from€which€Tennessee€Pattern€Jury€Instruction€15.22€has€beenÏpatterned.× ƒi ××  ×€€The€Court€sanctioned€repeating€the€charge€if€a€deadlockÏdeveloped,€provided€it€had€been€included€in€the€main€charge.€€òòId.óó€at€145.€ÍThe€Court€emphasized€that€ð ð[s]trict€adherence€is€expected€and€variationsÏwill€not€be€permissible.ðð€€òòId.óó;€òòVanderbilt€University€v.€Steelyóó,€566€S.W.2dÏat€854;€€òòBass€v.€Barksdaleóó,€671€S.W.2d€476,€485„86€(Tenn.€App.),€òòperm.óó€òòtoóóÏòòappealóó€òòdeniedóó,€(Tenn.€1984).ÌÌà àThe€trial€courtððs€charge€did€not€admonish€the€jurors€to€ð ðlistenÏwith€a€disposition€to€be€convinced€to€each€others€arguments."€€òòSimmons€v.ÏStateóó,€281€S.W.2d€at€490.€€Nor€did€it€enjoin€a€dissenting€juror€to€evaluateÏhis€or€her€stand€in€light€of€the€decisions€of€"so€many€men,€equally€honest,Ïand€equally€intelligent€with€himself."€€òòAllen€v.€United€Statesóó,€164€U.S.€atÏ501.€€Nonetheless,€the€instruction€raised€the€specter€of€the€time,€effort,€andÏmoney€that€a€new€trial€would€entail.€€An€appeal€to€these€irrelevantÏconsiderations€is€error.€€òòVanderbilt€University€v.€Steelyóó,€566€S.W.2d€atÏ854.€€Like€the€charge€disapproved€in€òòSteelyóó,€the€charge€suggested€that€theÏjurors€had€a€duty€to€agree.€€òòId.óó€€"Nothing€should€be€done€or€said€to€a€jurorÏwhich€can€in€any€manner€be€taken€by€that€juror€to€indicate€that€he€or€sheÏshould€abandon€an€honestly€held€conviction€in€order€to€reach€a€verdict€soÏthat€time€and€money€will€be€saved."€€òòBass€v.€Barksdaleóó,€671€S.W.2d€at€486.€ÏAs€we€noted€in€òòKerseyóó:ÌÓÓà8 à[A]€mistrial€from€a€hung€jury€is€a€safeguard€toÏliberty.€€In€many€areas€it€is€the€sole€means€byÏwhich€one€or€a€few€may€stand€out€against€anÏoverwhelming€contemporary€public€sentiment.ÏNothing€should€interfere€with€its€exercise.ÌÌÓÓ525€S.W.2d€at€143€(quoting€òòHuffman€v.€United€óóStates,€297€F.2d€754,€759Ï(5th€Cir.€1962)(Brown,€J.,€dissenting)).€€ÌÌà àIt€is€clear€that€the€charge€given€in€this€case€did€not€complyÏwith€the€rule€set€out€in€òòKerseyóó.€€However,€an€error€in€the€jury€charge€isÏnot€necessarily€grounds€for€reversal.€€òòVanderbilt€University€v.€Steelyóó,€566ÏS.W.2d€at€854.€€We€must€determine€whether€the€charge€affected€theÏverdict.€€Given€the€nature€of€the€charge,€we€are€convinced€that€the€chargeÏwas€a€material€factor€in€producing€the€verdict.ÌÌà àIn€addition€to€running€afoul€of€the€mandates€of€òòKerseyóó,€theÏcharge€given€in€this€case€impermissibly€interfered€with€the€juryððs€decisionÏmaking€process.€€It€exhorted€the€jurors€to€consider€the€time€and€money€thatÏwould€be€wasted€by€their€failure€to€return€a€verdict.€€It€suggested€that€theirÏfailure€would€further€impose€on€busy€court€schedules.€€ÌÌà àAn€additional€factor€in€our€evaluation€of€the€effect€of€theÏmisguided€charge€is€the€judgeððs€characterization€of€the€desired€verdict€as€anÏð ðadvisory.ðð€€The€jurors€and€counsel€were€obviously€confused€as€to€theÏnature€of€an€advisory€verdict.€€Both€inquired€of€the€judge€as€to€what€heÏmeant.€€His€response,€to€counsel€at€least,€indicated€that€he€wanted€somethingÏfrom€the€jury€to€guide€counsel€in€future€negotiations.€€ÌÌà àWhile€advisory€verdicts€are€not€unknown€in€Tennessee€inÏequity€matters,€òòseeóó€òòSmith€County€Education€Association€v.€Andersonóó,€676ÏS.W.2d€2d€328€(Tenn.€1984),€once€a€jury€is€impaneled€to€render€a€verdict,Ïthat€determination€is€not€an€advisory€opinion,€but€a€final€verdict.€€Further,Ïthe€juryððs€findings€of€fact€are€binding€upon€the€judge.€€òòIdóó.€at€337„38.€€TheÍjudgeððs€request€for€an€"advisory"€was,€at€the€very€least,€€confusing€andÏinconsistent€with€Tennessee€law.€€Although€the€judge€polled€the€jury€toÏinquire€whether€the€finding€was€the€"verdict"€of€each€juror,€the€note,Ïwritten€on€the€back€of€the€jury€form,€may€represent€nothing€more€than€theÏjuryððs€inept€attempt€to€render€the€"advisory"€requested€by€the€trial€court.ÌÌò òà@ àConclusionó óÌà àBoth€the€charge€given€in€this€case€and€the€request€that€the€juryÏreturn€an€advisory€verdict€are€contradictory€to€well„established€law.€€WeÏcannot€find€that€the€juryððs€note€represents€an€uncoerced,€unanimousÏverdict.ÌThe€Court€of€Appealsðð€order€dismissing€this€appeal€is€reversed.€€The€trialÏcourtððs€entry€of€judgment€for€the€defendants€is€also€reversed.€€The€case€isÏremanded€for€a€new€trial.ÌÌÓÓà
