Casesinvolvingthesexualabuseofminorsoftenpresenttroublingcredibilityissues:themostproblematicsituationisperhapsthatinwhichachildmakesunsupportedallegationsofsexualabuseagainsttheadultandthenrecantsorchangeshisorherstorywhenconfrontedbyaparent,teacherorlawenforcementofficialabouttheseallegations.Seee.g.,Statev.Bolin,___S.W.2d___(Tenn.1996);Statev.Ballard,855S.W.2d557(Tenn.1993);Statev.Anderson,880S.W.2d720(Tenn.Crim.App.1994).Whensuchchargesaredeniedbytheadult,judgesandjuriesareoftenputinaquandaryastowhichpartytobelieve;itisthistypeofsituationthatmakeschildsexualabusecasesamongthemostdifficultofresolution. Inmyopinion,however,thecasebeforeusdoesnotpresentanysuchproblems.Onthecontrary,thefourminorvictimsherenoneofwhomappearedtohaveanyreasontoharmthedefendantallrelatedremarkablysimilar,consistentstoriesofabusebythedefendantduringareasonablyspecifictimeframe.Notonlydidthevictimsstoriesstronglycorroborateoneanother,buttheywerealsofurtherbuttressedbytheadmissibleportionofT.J.stestimony,inwhichhestatedthatthedefendanttoldhimabouthavingsexwithseveralboys,includingtwoofthefourvictims.Furthermore,thedefendantadmittedhuggingandkissingtheboysinanoverlyaffectionatemanner,aswellasbuyingthemextravagantgifts;healsoadmittedmakingthemagazinesandvideotapesavailabletothem.Finally,althoughthedefendantdeniedengaginginsexualactivitywiththeboys,hedidnotsuggestanyreasonwhytheywouldfalselyaccusehim.GiventhestrengthandconsistencyofthevictimstestimonyandtheadmissibleportionofT.J.stestimony, (   כcoupledwiththeadmissionsmadebythedefendant,Ihavenodoubtthatthejurywouldhavereturnedaverdictofguiltyevenwithouttheerroneouslyadmittedevidence.SinceIbelievethattheevidentiaryerrorswereharmless,IwouldaffirmthejudgmentoftheCourtofCriminalAppealsandtrialcourt.                       ___________________________________________    FRANKF.DROWOTAIII    JUSTICE8
