AftergrantingtheStatesapplication,wereleasedouropinioninStatev.Denton,򀀀S.W.2d򀀀,1996WL688350(Tenn.December2,1996).InDenton,weheldthatAnthonydidnotannounceanewconstitutionalrule:8 8 PriortoAnthony,thereweretwolowercourtopinionsthatappliedthesamerule.SeeBrownv.State,574S.W.2d57(Tenn.Crim.App.1978)andStatev.Rollins,605S.W.2d828(Tenn.Crim.App.1980).Further,althoughtherewasadearthofdirectTennesseecaselawontheissue,numerousotherjurisdictionshadaddressedtherelationshipbetweenkidnappingandotherfeloniesthatcharacteristicallyinvolvedsomedetentionofthevictim.Whilethecaselawfromotherstatejurisdictionsdoesnotconstitute precedentwithintheMeadows/Teaguerule,suchanalysesoftheissuewerewidespreadandrepresentedabodyofpersuasiveauthorityavailabletothepetitioner.Inlightofthepreviousintermediatecourtopinions,weholdthatAnthonydidnotannounceanewrule.Id.at*2.BecauseAnthonydidnotannounceanewconstitutionalrule,itdoesnotconstitutea laterarisinggroundforreliefunderSands.ConsiderationofMoorespetitionisbarredbythestatuteoflimitations.Tenn.CodeAnn.4030102(1990).
