` (#` (# 8 ` (1)Intentionallyengagesinactionorcausesaresultthatwouldconstitute 5.4 anoffenseifthecircumstancessurroundingtheconductwereasthepersonbelievesthemtobe; ` (#` (#   r8j17 8 ` (2)Actswithintenttocausearesultthatisanelementoftheoffense,and  believestheconductwillcausetheresultwithoutfurtherconductonthepersonspart;or ` (#` (#  8 ` (3)Actswithintenttocompleteacourseofactionorcausearesultthat   wouldconstitutetheoffense,underthecircumstancessurroundingtheconductasthepersonbelievesthemtobe,andtheconductconstitutesasubstantialsteptowardthecommissionoftheoffense. ` (#` (# Tenn.CodeAnn.3912101(1997)(emphasisadded).UnderTennesseelaw,apersonactsintentionallywithrespecttothenatureoftheconductortoaresultoftheconductwhenitisthepersons consciousobjectiveordesiretoengageintheconductorcausetheresult.Tenn.CodeAnn.3911302(a)(1997). ` Incontrast,theoffenseoffelonymurderineffectatthetimeofMadkinscrimerequired [a]recklesskillingofanothercommittedintheperpetrationof,orattemptto  perpetrateanyfirstdegreemurder,arson,rape,robbery,burglary,theft,kidnappingoraircraftpiracy.Tenn.CodeAnn.3913202(a)(2)(1991).  #  1      כThus,recklessnessasa d\ mensreasufficedtosupportafelonymurderconvictionforadeathoccurringduring 0 ( oneoftheenumeratedfelonies. ` Afteranalyzingandcontrastingtheseelements,weobservedthatachargeofattemptedfelonymurderis inherentlyinconsistent,inthatitrequiresthattheactorhaveintendedtocommitwhatisdeemedanunintentionalact.Kimbrough,924 ,)$"& S.W.2dat890.Thus,likenearlyeveryjurisdictionthathasaddressedtheissue,weconcludedthattheoffenseofattemptedfelonymurderdoesnotexist:8 ` [I]tisillogicalthatsomeonecouldintendtocausesomeoneelsesdeaththroughnegligenceorevenrecklessness.Whileonemayreasonablyconcludethatadefendantintentionallybehavedinarecklessmannerandmayhaveintendedtokillthevictim,itdoesnotmakesensetosaythatadefendantintendedtokillthevictimbybeingreckless. ` (#` (# 8 `  Weconcludethatonecannotintendtoaccomplishtheunintended.Consequently,theoffenseofattemptedfelonymurderdoesnotexistinTennessee.6/5` (#` (# ЇId.at892.Accordingly,astheStateconcedes,Madkinsconvictionforattempted  felonymurderisreversedanddismissed. ` AlthoughnotspecificallyaddressedbythepartiesortheCourtofCriminalAppeals,wenowturntothequestionofwhethertheprosecutionmayproceedagainstthedefendantonothercharges.TherecordshowsthatMadkinswasindictedforattemptedpremeditatedmurderandattemptedfelonymurderandthatbothcountsweresubmittedtothejury.Theinstructionsrequiredthejurytobeginbyconsideringattemptedpremeditatedmurder;ifthejuryfoundthedefendantnotguiltyofattemptedpremeditatedmurder,itwastoacquithimofthatoffenseandnextconsiderattemptedfelonymurder.IfthejuryfoundMadkinsnotguiltyofattemptedfelonymurder,itwastoacquithimofthatchargeandconsiderthelesseroffenseofattemptedseconddegreemurder. ` Giventhesesequentialinstructions,thejurysconvictionforattemptedfelonymurderwasanimpliedacquittalofattemptedpremeditatedmurder# XXXXB##XXX X.Schirov.Farley, " 510U.S.222,236,114S.Ct.783,792,127L.Ed.2d47(1994);Greenv.United $!
