XT-##XXX&XԀsuchaslifting,driving,andwriting. -@),  ` McIlvainbeganworkingforDefendantRussellStoverCandies,Inc.( RussellStover)onMay2,1994.Herworkinvolvedpackingcandyorworkinginthe ` TherecordreflectsthatMcIlvainhasnofamilyhistoryforcarpaltunnel  syndrome,andthatshehadneverexperiencedanyproblemswithherhandsbeforeworkingforRussellStover.McIlvaintestifiedthat##hersymptomsfirstarosearound##Julyof1996while##U#shewasU#working##forRussell##StoverV#,V###W#.W#####X#Atthattime,X#she##begantoexperiencepain,tingling,andnumbnessinherwristswhichhasdisruptedhersleep,##andhas##interferedwithherabilitytowork,driveacar,andperformchoressuchasvacuuming,washingdishes,dusting,sewingortighteningthecapson##jarsY#,Y#]#]#Z#.AsZ#[#Z#aaZ#[#\#aresult,\#]#]###^#Mc^#_#^#i^#_#`#I`#a#`#l`#a#c#b#ib#c#d#lvaind#^#^#]#sothatshe]###oftenrequiresherhusbandsassistance.Attheonsetofthesesymptoms,McIlvainwas61yearsold. ` McIlvainshusbandtestifiedthathehastakenoverthechoresathomeandtheantiquestorewhichheownsandoperateswithhiswife,thathehasobservedhiswifespainanddifficultywhendrivingacar,andthathenowmendshisownclothes,hastohelphiswifewithbuttonsandsnapsonherclothing,andoftenhastosleepinaseparateroomsinceMcIlvainsrestlessnessdisturbshissleep.HefurthertestifiedthathiswifeneverhadtheseproblemspriortoherworkatRussellStover,andthatheobservesherconditionascontinuallygettingworse.̀ ` Allmedicalproofintherecordwasenteredthroughdepositionandconsistsoftheopinionsfromfourdifferentphysicians.RussellStoverfirstsentMcIlvaintoDr.KennethColburn,afamilypractitioner.AfteronevisitwithMcIlvain,Dr.ColburndiagnosedherashavingaclassiccaseofbilateralcarpaltunnelsyndromeandtemporarilyrestrictedMcIlvainfromreturningtowork. ` AfterDr.ColburnrestrictedMcIlvainfromwork,RussellStoversentMcIlvaintoseeDr.##e#Johne#Clough.##AccordingtoDr.Cloughsofficenotes,Dr.CloughdiagnosedMcIlvainassufferingfromtenosynovitisandpossiblyearlycarpaltunnelsyndrome.ThoughDr.CloughrestrictedMcIlvainfromrepetitivemotion,hefeltthatshecouldbeginperforminglightdutyworkforRussellStover.Consequently,McIlvainreturnedtowork,butsherequestedasecondopinionregardingwhethershehadcarpaltunnel 84: ##syndromef#,andf#g#.g###RussellStoverreferredhertoDr.ToneyHudson,apractitionerofoccupationalmedicineandpreventativehealth.̀ ` Dr.HudsonsawMcIlvaininhisofficeatotalofeighttimes.Dr.HudsontestifiedthatheultimatelydiagnosedMcIlvainwith bilateralcarpaltunnelsyndromethathadimproved.AccordingtoDr.Hudson,thecauseofthecarpaltunnelsyndromewas multifactorial,stemmingfromMcIlvainspresentwork,herpastwork,andherage.ThoughDr.HudsonopinedthatMcIlvainwouldretainazeropercentimpairment,herestrictedherfromworkingatRussellStover,explainingthatshecouldstillperforminthelabormarketifsheavoidshighlyrepetitivework. ` ThelastdepositionenteredasmedicalproofwasthatofDr.RichardFishbein,anorthopaedicsurgeon.Dr.FishbeinopinedthatMcIlvainhada5percentimpairmenttobotharmscausedbycarpaltunneldiseasewhichwasmoreprobablythannotcausedbyworkingatRussellStover.Dr.FishbeinplacedrestrictionsonMcIlvainsactivities,especiallyrecommendingthatMcIlvainavoidrepetitivehandandwristmovements. `  ` TheonlywitnessotherthanMcIlvainandherhusbandtotestifyattrialwasBill##Pattersonh#h###h#( Patterson)h#,##aprivateinvestigatorRussellStoverhiredtocovertlyvideotapeMcIlvain.PattersondiscoveredthatMcIlvainworkedparttimeinanantiquestore.HetestifiedthathewenttotheantiquestoreandsecretlyvideotapedMcIlvainflippingthroughtheyellowpages,dialingapushbuttonphone,carryingitemsfromherminivantothestore,andcarryingasigntoputoutsidethestore.PattersontestifiedMcIlvainexhibitednodifficultyinanyoftheseactivities. ` McIlvainconcededthatsheandherhusbandhadownedandoperatedtheantiquestoreforaboutfiveyearsandthatshehadnotmentionedthestoretoeitherDr.HudsonorDr.Fishbein;however,shefurthertestifiedthat##i#thei#her##workattheantiquestore requirednorepetitivehandmovementsandthatherhusbandperformedanywork 7P28 whichwouldotherwisecausediscomforttoherhandsandwrists.Therewasalsoevidencethatsuchworkwasnotgainfulemployment.  ` RussellStoverarguedbeforethetrialcourtthattheagebasedclassificationcontainedinTenn.CodeAnn.506207(4)(A)(i)shouldapplytoreduceMcIlvainsawardbyoffsettingSocialSecurityretirementbenefitsshereceived.OverthesustainedobjectionofMcIlvainscounsel,RussellStoverenteredintotherecordproofthatMcIlvainhasbeenreceivingSocialSecurityretirementinsurancebenefits.̀ ` Afterthepresentationofalltheproof,thetrialjudgefoundthatMcIlvainsufferedfrombilateralcarpaltunnelsyndromewhicharoseoutofandinthecourseofheremploymentwithRussellStover.Thetrialjudgenotedthatallofthemedicaldepositionssupportedthisfindingandstatedthat theresnoevidencethatshedidanyrepetitivemanipulationwithherhandsintheantiqueshopthatbroughtaboutthiscondition.ThetrialjudgeconsideredDr.FishbeinsdepositiontestimonytobemorepersuasivethanDr.Hudsonstestimonybasedonthefactthat Dr.Hudson,eventhoughhedidntfeellikethattherewasanymedicaldisability,...didfeellike...sheshouldchangecareers. ` ThetrialcourtrejectedRussellStoversargumentthattheagebasedclassificationcontainedinTenn.CodeAnn.506207(4)(A)(i)shouldapplytoreduceMcIlvainsawardbyoffsettingSocialSecurityretirementbenefitsshereceived,reasoningthatourholdinginVogelv.WellsFargoGuardServ.,937S.W.2d856(Tenn. Withtheseprinciplesinmind,wereviewtherecordtodeterminewhethertheevidencepreponderatesagainstthetrialcourtsfindingof40percentpermanentpartialdisabilitytoeacharm.Therecordrevealsseveralfactorswhichsupportthetrialcourtsdecisiononvocationaldisability.BothMcIlvainandherhusbandtestifiedthatsheisnolongerabletodohouseholdchores,shehasdifficultyandpainwhendrivingorwriting,andshehasdisruptedsleep.Mr.McIlvaintestifiedthathehashadtotakeoverchoresathomeandtheantiquestore,andhastohelphiswifeperformsimpletaskslikebuttoningandsnappingclothingortighteningjarlids. WithrespecttoMcIlvainsjobskillsandtraining,theproofreflectsthateveryemploymentMcIlvainhashadwhichmightallowhertoobtainanothersimilarjobinTennesseehasrequiredMcIlvaintomakerepetitiveuseofherhandsand##wrists}#,,#,#}#~#.~###!##,###"#
