àOn€December€19,€1990,€Mary€Staggs€injured€her€back€in€the€course€ofÏher€employment€with€the€defendant,€National€Health€Corporation,€and€thereafterÍfiled€a€complaint€seeking€workers'€compensation€benefits.€€At€trial,€the€courtÏawarded€Staggs× ƒ1 ××  ×€permanent€partial€disability€benefits€and€temporary€totalÏbenefits.€€The€trial€court€also€ordered€National€Health€to€reimburse€Staggs€forÏmedical€expenses€she€had€paid€from€her€personal€funds€and€to€reimburseÏMetropolitan€Life€Insurance€Company,€Staggsðð€husbandððs€health€insuranceÏcompany,€for€all€medical€expenses€paid€by€them.€€Litigation€expenses€were€alsoÏawarded€as€discretionary€costs.€€The€trial€court€decision€was€appealed,€affirmedÏby€this€Court,€and€remanded.€ÌÌà àStaggs,€however,€argues€that€òòMontgomeryóó€is€inapposite€because€thisÏcase€is€governed€by€Tenn.€Code€Ann.€ðððð€47„14„121€and€122,€the€general€post„judgment€interest€statutes.€€We€disagree.ÌÌà àIn€òòMontgomeryóó,€we€held€that€an€employee€is€not€entitled€to€collect€post„judgment€interest€on€unaccrued€workersðð€compensation€benefits.€€We€statedÏthat€allowing€interest€on€unaccrued€benefits€"would€not€be€in€consonance€withÏthe€purpose€and€intent€of€the€Workers€Compensation€Act€and€would€result€inÏunjust€enrichment€to€the€employee."€€òòMontgomeryóó,€861€S.W.2d€at€232.€ÏAccordingly,€òòMontgomeryóó€stands€for€the€proposition€that€an€employee€may€notÏcollect€interest€unless€and€until€the€employee€becomes€entitled€to€receive€theÏòòmoneyóó€on€which€interest€is€sought€to€be€imposed.€€Applying€that€principle€to€theÏfacts€in€this€case,€it€is€clear€that€Staggs€claim€for€entitlement€to€post„judgmentÏinterest€on€the€money€reimbursed€to€Metropolitan€Life€must€fail.ÌÌà àAs€we€observed€in€òòMontgomeryóó,€an€employee€is€not€entitled€to€personallyÏreceive€payment€for€medical€expenses€unless€he€or€she€has€personally€paid€theÏmedical€expenses€and€is€due€reimbursement.€€Instead,€employers€must€pay€theÏproviders€of€medical€care€directly€for€incurred€medical€expenses.€€òòSeeóó€Tenn.ÏCode€Ann.€ðð€50„6„204.€€Here,€Staggs€was€never€entitled€to€receive€the€moneyÍon€which€she€now€seeks€to€collect€post„judgment€interest.€€National€HealthÏowed€that€money€to€Metropolitan€Life€directly€as€reimbursement€for€the€medicalÏbills€it€had€paid.€€Accordingly,€under€the€rationale€articulated€in€òòMontgomeryóó,ÏStaggs€is€not€entitled€to€collect€post„judgment€interest€on€the€reimbursedÏmedical€expenses.ÌÌà àAlthough€the€holding€in€òòMontgomeryóó€was€based€specifically€upon€theÏinterest€provision€of€the€workers'€compensation€statute,€Tenn.€Code€Ann.€ðð€50„6„225(h),€we€also€discussed€the€general€statutes€relating€to€post„judgmentÏinterest,€noting€that€while€they€provide€for€interest€on€every€judgment€ð ðfrom€theÏday€on€which€the€jury€or€the€court,€sitting€without€a€jury,€returned€the€verdictÏwithout€regard€to€a€motion€for€a€new€trial,ðð× ƒ2 ××  ×€they€do€not€ð ðmean€that€the€partyÍsecuring€the€judgment€may€have€interest€on€the€entire€judgment€òòunless€he€isÏentitled€to€have€the€use€of€the€proceeds€of€the€judgment€from€and€after€the€dateÏthe€judgment€was€entered.óó"€€òòIdóó.€(emphasis€added).€€Thus,€in€òòMontgomeryóó€weÏrecognized€that€the€Legislature€did€not€intend€for€a€party€to€litigation€to€beÏunjustly€enriched€through€the€payment€of€post„judgment€interest.€€òòSeeóó€òòalsoóóÏòòPrice€v.€Priceóó,€225€Tenn.€539,€472€S.W.2d€732€(1971)(interest€accrued€as€ofÏdate€party€entitled€to€money€judgment).ÌÌà àIn€this€case,€Staggs€was€never€entitled€to€have€the€use€of€that€portion€ofÏthe€judgment€reflecting€the€medical€bills€paid€by€Metropolitan€Life€on€her€behalf.€ÏThe€trial€court€merely€found€that€the€defendant€"is€liable€for€all€medical€billsÏincident€to€[the]€injury€which€have€been€paid€by€[Metropolitan€Life].€"€€StaggsÏnever€used€her€own€money€to€pay€for€these€medical€services,€and€therefore,€anÏaward€of€interest€would€amount€to€unjust€enrichment.€€Accordingly,€we€reverseÏthe€trial€court€judgment€and€hold€that€neither€Tenn.€Code€Ann.€ðð€50„6„225(h)Ïnor€Tenn.€Code€Ann.€ðððð€47„14„121€and€„122€authorize€the€payment€of€post„judgment€interest€to€an€employee€on€medical€expenses€initially€paid€by€a€third„party€health€insurance€carrier€and€reimbursed€to€that€carrier€by€the€employer.€€€€ÌÇà@ àWe€next€consider€whether€a€litigant€is€entitled€to€collect€post„judgmentÏinterest€on€an€award€of€discretionary€costs.€€In€this€case,€the€trial€court€orderedÏthe€defendant€to€pay€interest€in€the€amount€of€10€percent€per€year€on€the€awardÏof€discretionary€costs.€€The€Appeals€Panel,€however,€concluded€that€"[t]heÏdiscretionary€costs€were€an€award,€and€not€a€judgment€within€the€purview€ofÏTenn.€Code€Ann.€ðð€47„14„122."× ƒ3 ××  ×ÌÌà àArguing€that€the€Appeals€Panelððs€conclusion€is€correct,€National€HealthÏrelies€upon€òòGatewood€v.€Palmeróó,€29€Tenn.€466€(1850).€€In€that€case,€this€CourtÏinterpreted€a€predecessor€interest€statute€which€provided€that€"all€judgmentsÏentered€up€in€any€of€the€courts€of€record€in€this€State,€or€by€any€justices€of€theÏpeace,€shall€bear€interest€until€paid,ðð€and€concluded€that€it€did€not€authorize€theÏcollection€of€€interest€on€a€judgment€for€court€costs.€€òòIdóó.€at€469;€òòseeóó€1835€Tenn.ÏPub.€Acts,€ch.€50,€ðð€2;€òòseeóó€òòalsoóó€òòGreen„œRea›€Co.€v.€Holmanóó,€107€Tenn.€544,€546,Ï64€S.W.€889€(1901).ÌÌà àStaggs€argues€that€òòGatewoodóó€is€distinguishable€because€it€involvedÏcourt€costs,€not€discretionary€costs,€and€because€the€decision€in€òòGatewoodóó€wasÍrendered€long€before€the€Rules€of€Civil€Procedure€were€promulgated.€€StaggsÏcontends€that€since€she€did€not€receive€reimbursement€of€the€litigationÏexpenses€for€two€years,€she€is€entitled€to€post„judgment€interest.ÌÌà àWe€disagree.€€In€our€view,€there€is€no€distinction€between€an€award€ofÏcourt€costs€and€an€award€of€discretionary€costs€when€determining€whether€post„judgment€interest€should€be€payable.€€We,€therefore,€apply€and€reaffirm€the€ÏòòGatewoodóó€rule€that€an€òòawardóó€of€discretionary€costs€is€not€a€"judgment"€on€whichÏpost„judgment€interest€is€due€under€Tenn.€Code€Ann.€ðððð€47„14„121€and€„122.€€ÏThe€trial€court€judgment€is,€therefore,€reversed.ÌÌÌà
