WoodwasindictedinSeptember,1979,andchargedwithamurderthatallegedlyoccurredinJuly,1979.Theindictmentremainedsealedwhilenumerousaliascapiaseswereissued.InNovember,1983,theindictmentagainstWoodwas retiredhavingneverbeenserved. Whilesomewhatambiguous,therecordsindicatethat,asearlyasMarch,1984,theauthoritiesinTennesseeknewthatWoodwasincarceratedinAlabama.OnMarch14,1984,forexample,AlabamacorrectionsofficialsacknowledgereceiptofaTennesseedetainer.Nonetheless,nothingindicatescompliancewiththeinterstatecompactondetainers.Ineffect,neitherTennesseenorAlabamatookanyaction,atleastsofarastherecorddemonstrates,followingtheMarch1984acknowledgment. SometimethatyearWoodlearnedoftheTennesseedetainer.HewroteforinformationtotheSheriffsDepartmentinWilliamsonCountybutreceivednone. In1989,WoodwasofferedparolebyAlabamaofficialscontingentonhiswaivingextraditiontoTennessee.Nothingintherecorddisputeshistestimonythatheaskedforcounseltoassistinmakingthedecision.Infact,hislatertenacityseemstosupportthattestimony.Inanyevent,theAlabamaauthoritiesnotedhisrefusal,andhewasnotparoled.ItisthiseventonwhichthemajoritybasesitsconclusionsthatWoodacquiescedinthedelaythatultimatelyresultedinhistrialsomefouryearslater.Inmyopinion,thisconclusionrepresentsadeparturefromwellestablishedprecedent. AfterAlabamadeniedWoodparolein1989,heagainwroteWilliamsonCountyseekinginformationaboutthechargesandlegalassistance.HisMarch22,1990,lettertotheclerkofthecourtwasansweredbytheclerkonAugust13,1990.Intheresponse,theclerkreferredWoodtothedistrictattorney. WoodfiledaprosemotionforspeedytrialinSeptember,1990,whichwasheardinWoodsabsenceonSeptember10th.Thedocketentryforthathearingindicates detainerlifted. Twoyearslater,thedistrictattorneyissuedanaliascapiasforWood.HewasservedintheAlabamaprisononOctober29,1992,andtriedonFebruary9,1993,sometwentyninemonthsafterhisdemandforaspeedytrial.̀ Themajorityacknowledgesthatevaluationofaspeedytrialissuerequiresconsiderationoffourfactorswhichmustbebalanced.Barkerv.Wingo,407U.S.514(1972).Inanalyzingthesefactors,themajoritycorrectlyfindsthat(1)thelengthofthedelaywaspresumptivelyprejudicialandweighsinfavorofdefendant ,   כandthat(2)thedelaywascausedbythestatesnegligenceandweighsinfavorofdefendant. Inmyopinionthemajorityopinionerrs,however,when,onthethirdfactor,themajorityconcludesthatdefendantfailedtoasserthisrighttoaspeedytrial.Thisconclusion,basedonWoodsreactiontotheconditionalparoleopportunity,isfaultyinthreeregards.First,itfindsawavierofaspeedytrialrightbasedontheexerciseofanequallycognizableconstitutionalright,therighttocounselbeforemakingadecisionregardingextradition.Second,itelevatesthedemandfactoraboveallelseequatingalackofdemandwithawavieroftheright.Third,itmisconstruesthefactsintherecordbeforeus. Tennesseeauthoritiesknewin1984defendantswhereabouts.Althoughgivenlegalauthoritytoproceedagainsthim,Tenn.CodeAnn.4031101etseq.(1990Repl.),theydidnothinguntilhedemandedaspeedytrial.Themajoritysassertionthatdefendant didnothingfrom1984until1990isperplexing.Whatwasdefendanttodo?Hehadnotbeenservedwithanindictment,capias,warrant,orICDformrequestingfinaldisposition.Ineffect,therewasnoproceedingagainstWoodduringthatperiod.Themajoritysattempttocasttheburdento dosomethingonWood,withallduerespect,invertstheorderofthings. Moreimportantly,however,evenifWoodsfailuretotakeaffirmativestepsin1984wererelevant,itdoesnotjustifythemajoritysconclusion.ImmediatelyfollowingnotificationthatAlabama,atleast,thoughtTennesseestillhadaninterestinWood,Woodsoughtinformation.Herequestedcounsel.Hedemandedaspeedytrial.Yetthestatedelayedanothertwentyninemonthsbeforetryinghim.Ataminimum,IwouldbalancetheBarkerfactorsasfollows:  1.8 Thelengthofdelaywasprejudicialandweighsindefendantsfavor.  2.8 Thedelaywasunjustified,wascausedbythestatesnegligence,andweighsindefendantsfavor.  3.8 Thedefendantsdemandforaspeedytrialafterunsuccessfulrequestsforcounselandinformation,weighsindefendantsfavor. Thefourthfactorprejudicebythedelayismostdifficult.Courtshaverecognizedhowdifficultthisfactoristoestablishandhave,accordingly,allowedapresumptionofprejudicetoattachtoexcessivedelays.Thereisinthiscase,however,noproofofparticularizedprejudice.Nonetheless,ataminimum,thefactorshouldbetreatedneutrallyweighinginneitherpartysfavor. Balancingthefourfactors,then,itisabundantlyclearthatdefendantsconstitutionalspeedytrialrightshavebeenviolated,andIwouldsoholdpreferringthatunfortunateresulttotheoneIbelievethemajoritysopinionallows:aprosecutionfarbeyondthetimeperiodwehavedeemedreasonablebeforeinthefaceofaspeedytrialdemand.̜    ____________________________________    PennyJ.White,Justice
