TheplaintiffwasapoliceofficerfortheSpringfieldPoliceDepartmentandwasassignedtotheDrugTaskDivision.Theplaintiff'slastdayofworkwasonFriday,February16,1990.TheplaintiffwasawakenedbychestpainearlySundaymorning,February18,1990,andwasadmittedtoahospitalwithadiagnosisofaheartattack.Hewasreleasedapproximatelyeightdayslaterandsustainedanotherheartattackonhiswayhome.Hewasreadmittedtothehospitalandunderwentopenheartsurgery.HedidnotreturntohisjobasadrugtaskforceofficerfortheSpringfieldPoliceDepartment. Theplaintiff'streatingphysician,Dr.LoydaTacoque,testifiedbydepositionthattworiskfactorscontributedtotheplaintiff'sheartattack,smokingandstress.Dr.Tacoquestatedthattheplaintiff'scholesterolwasnotunusuallyhighandtherewasnofamilyhistoryofheartdisease.Priorexaminationhadnotrevealedanyevidenceofheartdisease.Dr.Tacoqueopinedthatstressrelatedtotheplaintiff'sjobasadrugtaskforceofficerlikelycontributedtotheplaintiff'sheartcondition. Theplaintifftestifiedconcerningworkrelatedstressandstressassociatedwithpendinglitigationarisingoutofalawsuitinvolvingaworkrelatedsearch.TheplaintiffwasservedwiththelawsuitinJanuaryof1990.Hestatedthatthefirsttimehehadeverexperiencedheartrelatedsymptomswasafewdayspriortohisheartattackwhilespeakingwithhisattorneyregardingthependinglawsuit. ThedefendantofferedthetestimonyofDr.TaylorWray,acardiologistwhoreviewedtheplaintiff'smedicalrecords.Dr.Wrayopinedthatplaintiff'sheartconditionwasnotjobrelated.Dr.Wrayattributedtheplaintiff'sheartconditionto"thefactthat[theplaintiff]smokedtwopacksadayofcigarettes."Dr.Wrayopinedthatstressrelatedtotheplaintiff'sworkasadrugtaskforceofficerdidnotcontribute"theleastlittlebit"totheplaintiff'sheartattacks. ThisCourtrecentlyheldinKrickv.CityofLawrenceburg,945S.W.2dϜ709(Tenn.1997),thatamedicalopinionprovidedbyacompetentmedicalexpertwassufficienttorebutthepresumptioninTenn.CodeAnn.751201.AccordingtoKrick,therebuttalofthestatutorypresumptionremovesanalysisofalawenforcementofficer'sdisabilityclaimfromthepurviewof751201.Krickthenheldthatalawenforcementofficer'sclaimshallbeanalyzedunderthegeneralstatutoryprovisiondefiningoccupationalinjuriesintheWorkers'CompensationAct.Tenn.CodeAnn.506102(a)(5),301;Id.at.713.Oncealawenforcementofficer'sclaimisoutsidethepurviewofthe"[l]awenforcementandfirefighters"statute,wemustfindtheheartattackwas"immediatelyprecipitatedbyaspecificacuteorsuddenstressfulevent."Id.at713714. Theplaintiffhasnotshownaspecificacuteorsuddenstressfuleventimmediatelyprecedinghisheartattack.Theplaintiff'smeetingwithanattorneyconcerningacivillawsuitseveraldayspriortotheheartattackwasneitheracutenorsudden.PursuanttoKrick,theworkers'compensationpanel'sdecisionaffirmingthetrialcourt'sfindingofcompensabilityisreversed.Costsofthisappealshallbetaxedagainsttheplaintiff,MarthaBenton,theadministratrixoftheestateofDavisRayBenton,forwhichexecutionmayissueifnecessary.
