Defendantsareoftenconvictedoffirstdegreemurderafteratrialinwhichtheprosecution,forwhateverreason,didnotseekthedeathpenalty.Thepooldefinedbythemajoritywouldexcludesuchcases.However,casesinwhichthedeathpenaltyisnotsoughtareequallyrelevanttoproportionalityascasesinwhichthedeathpenaltyissought.Withoutallfirstdegreemurderconvictionsincludedinthepool,itwouldbe,inmyopinion,quitedifficulttoconducttheproportionalityreviewasrequiredbyTenn.CodeAnn.3913206(c)(1)(Supp.1996).Thus,becauseofmyviewthatthepoolofsimilarcasesasdescribedbythemajorityistoonarrow,Irespectfullydissentfromthatpartofthemajorityopinion.
