àò òòòBACKGROUNDó óóóÌà àIn€May€of€1962,€the€defendant,€William€D.€Carroll,€was€convicted€of€rapeÏand€sentenced€to€death,€which€was€then€an€available€punishment€for€theÏoffense.× ƒ3 ××  ×€€In€1964,€Governor€Frank€Clement€commuted€Carrollððs€sentence€to€aÏterm€of€life€imprisonment.€€In€November€of€1972,€Carrollððs€life€sentence€wasÏagain€commuted€by€Governor€Winfield€Dunn€to€a€term€of€ð ð22€years€to€life.ðð€€TheÏdefendant€was€released€on€parole€in€December€of€1972,€but€convicted€theÏfollowing€year€of€robbery€with€a€deadly€weapon.€€In€March€of€1974,€GovernorÏDunn€revoked€the€commuted€sentence€and€reinstated€a€term€of€lifeÏimprisonment.€€ÌÌà àIn€1992,€the€defendant,€who€was€then€incarcerated€at€Fort€Pillow€prison,€Ïfiled€a€petition€for€the€writ€of€habeas€corpus,€alleging€that€the€commutedÏsentence€of€ð ð22€years€to€lifeðð€had€expired€in€1973,€or€prior€to€the€governorððsÏpurported€revocation.× ƒ4 ××  ×€€Although€the€trial€court€initially€denied€relief,€the€Court€ofÏCriminal€Appeals€remanded€for€a€hearing€to€determine€whether€and€when€theÍcommuted€sentence€had€expired.€€òòCarroll€v.€Raneyóó,€868€S.W.2d€721€(Tenn.ÏCrim.€App.€1993).€€Ìà àOn€remand,€the€trial€court€found€that€the€commuted€sentence€wasÏunconditional€and€that,€applying€applicable€sentencing€credits,€the€defendantÏCarroll€had€served€a€22„year€sentence€prior€to€the€Governorððs€revocation.€€TheÏCourt€of€Criminal€Appeals€reversed,€holding€that€the€commutation€wasÏconditional€and€that€the€Governor€had€authority€to€revoke€the€sentence€at€anyÏtime€during€the€entire€term.€€We€then€granted€the€application€for€permission€toÏappeal.ÌÌà@ àThe€Governor€also€has€the€authority€to€attach€conditions€or€restrictions€toÏa€commuted€sentence€that€are€reasonable,€legal,€and€possible€for€theÏdefendant€to€perform.€€òòSeeóó,€òòe.g.óó,€òòMcCorkleóó,€40€S.W.2d€at€1016€(ð ðobey€the€law€inÏevery€way,€lead€the€life€of€a€good€citizen,€and€refrain€from€the€use,€sale,Ïmanufacture€or€possession€.€.€.€of€intoxicants.ðð);€òòRicks€v.€Stateóó,€882€S.W.2d€atÏ393€(ð ðparole€and/or€commutation€supervision€by€the€Bd.€of€Paroles€until€theÏexpiration€of€his€original€sentenceðð).€€Upon€a€finding€that€a€condition€has€beenÏviolated,€the€commuted€sentence€may€be€revoked€by€the€Governor,€providedÏthat€the€sentence€has€not€expired.€€òòSeeóóòòRowell€v.€Duttonóó,€688€S.W.2d€474,€477Ï(Tenn.€Crim.€App.€1985).ÌÌ€€€€€€€€€€In€this€case,€the€defendantððs€argument€is€two„fold.€€First,€he€argues€that€theÏcommuted€sentence€of€ð ð22€years€to€lifeðð€must€be€interpreted€as€a€22„yearÏdeterminate€sentence€because,€at€the€time€of€the€offense€and€at€the€time€of€theÍcommutation,€an€indeterminate€sentence€could€not€be€imposed€for€rape.€€òòSeeóóÏTenn.€Code€Ann.€ðð€40„2707€(1975);€òòFranks€v.€Stateóó,€187€Tenn.€174,€213€S.W.2dÏ105,€109€(1948).× ƒ6 ××  ×€€Second,€he€contends€that€the€unconditional€commutation€ofÏ22€years€expired€prior€to€the€Governorððs€revocation€of€it.€€The€trial€court€agreed.€ÏThe€Court€of€Criminal€Appeals,€however,€interpreted€the€commuted€sentence€asÏconditional,€while€conceding€that€the€ð ð22€years€to€lifeðð€was€an€indeterminateÏsentence.€€Specifically€relying€on€the€ð ðto€lifeðð€language,€the€court€concluded€thatÏthe€Governor€had€the€authority€to€revoke€the€commutation€of€the€defendantððsÏsentence€throughout€the€remainder€of€the€defendantððs€life.€€ÌÌà àWe€agree€with€this€result€but€not€the€reasoning.€€The€majority€view€withÏregard€to€conditional€pardons€is€that€ð ðthe€conditions,€to€be€operative,€mustÏappear€on€the€face€of€the€paper,€and€must€be€clear€and€specific.ðð€€€59€Am.€Jur.Ï2d,€òòPardon€and€Paroleóó,€ðð63€at€52€(2d€ed.€1987);€67A€C.J.S.,€òòPardon€and€Paroleóó,Íðð37€at€49€(1978€&€Supp.€1997);€òòseeóó€òòalsoóó€òòConnorsóó,€61€S.W.2d€at€473€(ð ðby€aptÏlanguage€in€the€instrument€itself,€the€Governor€.€.€.€can€stipulate€that€he€shallÏhave€exclusive€power€to€determine€whether€the€conditions€of€a€pardon€issuedÏhave€been€broken.ðð).€€The€trial€court€found,€and€both€parties€on€appeal€nowÏrecognize,€that€the€Governorððs€commutation€in€this€case€did€not€contain€anÏexpress€condition.€€Although€it€is€arguable€that€the€words€of€the€commutedÏsentence€ð ðto€lifeðð€imply€a€€condition,€we€believe€this€approach€is€less€persuasiveÏthan€the€rationale€we€have€chosen.€€òòCompareóóòòRicksóó,€882€S.W.2d€at€393,€n.€23Ï(defendant€ð ðwill€be€under€parole€and/or€commutation€supervision€by€the€BoardÏof€Paroles€until€the€expiration€of€his€original€sentence.ðð).ÌÌà àIn€our€view,€the€Governor€had€the€constitutional€authority€pursuant€toÏarticle€III,€ðð€6€of€the€Tennessee€Constitution€to€grant€a€commuted€sentence€ofÏð ð22€years€to€life,ðð€even€if€the€applicable€statutes€precluded€the€imposition€of€anÏindeterminate€sentence€for€the€offense€of€rape.€€For€example,€in€òòState€v.€Fieldsóó,Ï925€S.W.2d€561€(Tenn.€Crim.€App.€1996),€the€Governor€commuted€theÏdefendantððs€death€sentence€to€a€term€of€ninety„nine€years.€€The€defendant€laterÏsought€post„conviction€relief€on€the€basis€that€the€only€other€legally€effectiveÏsentence€for€first„degree€murder€at€the€time€of€his€offense€was€life€imprisonment,Íand€not€a€term€of€ninety„nine€years.€€The€Court€of€Criminal€Appeals€rejected€theÏassertion€that€the€commuted€sentence€was€illegal:ÌÓÓÌà8 à[T]he€only€sentence€that€could€legally€have€been€ordered€by€aÏjudge€or€jury€was€life€imprisonment.€€We€conclude,€however,€thatÏthese€cases€and€the€law€set€forth€therein€do€not€and€cannot€restrictÏthe€constitutional€authority€of€the€Governor€to€commute€aÏdefendantððs€sentence€to€a€term€less€than€life.€.€.€.ÌÌÌÓÓòòIdóó.€at€563.ÌÌà àOther€state€courts€have€reached€similar€conclusions.€€The€MaineÏSupreme€Court€did€so€in€òòBaston€v.€Robbinsóó,€135€A.2d€279€(Me.€1957).€€There,Ïthe€Governor€commuted€the€defendantððs€eight„year€sentence€for€rape€to€a€termÏfrom€€four€to€eight€years.€€The€defendant€was€paroled,€but€when€he€violated€aÏcondition€of€parole,€he€was€ordered€to€complete€his€commuted€sentence.€€HeÏsought€habeas€corpus€relief,€alleging€that€the€commutation€was€anÏindeterminate€sentence€in€violation€of€Maineððs€statutory€sentencing€law.€€TheÏMaine€Supreme€Court,€after€first€noting€that€the€commuted€term€was€a€reductionÏof€the€original€sentence,€held:ÓÓÌÌÌà8 à[A]uthority€of€the€Governor€and€Council€is€derived€from€theÏConstitution€and€it€may€commute€the€sentence€with€suchÍrestrictions€as€may€be€deemed€proper.€€If€the€restrictions€andÏlimitations€imposed€are€in€conflict€with€the€provisions€of€anyÏstatute,€then€such€statute€does€not€control€.€.€.€.ÌÌÌòòÓÓIdóó.€at€281.€€Likewise,€in€òòGreen€v.€Gordonóó,€246€P.2d€38€(Cal.),€òòcertóó.€òòdeniedóó,€344ÏU.S.€886€(1952),€the€defendant€argued€that€the€Governor€could€not€commute€hisÏdeath€sentence€to€life€without€the€possibility€of€parole€because€the€onlyÏpunishments€established€for€the€offense€of€first„degree€murder€by€the€legislatureÏwere€death€and€life€with€the€possibility€of€parole.€€The€California€Supreme€CourtÏresponded€that:ÌÓÓÌà8
