AllmembersoftheCourtagreethatconsiderationofthefelonymurdercircumstancewaserrorunderStatev.Middlebrooks,840S.W.2d317(Tenn.1992),cert.dismissed510U.S.124,114S.Ct.48(1993).Consequently,theonlyvalidaggravatingcircumstanceisthedefendant'spreviousconvictionsoffeloniesinvolvingtheuseoforthreatofviolencetotheperson,underTenn.CodeAnn.3913204(i)(2).Insupportofthisaggravatingcircumstance,theStatepresentedevidenceoffourpreviousconvictions:twoattemptedseconddegreemurders,oneaggravatedrobbery,andoneseconddegreeburglary.Despitethenumberofoffenses,thisisnotastrongcircumstancebecausetheattemptedseconddegreemurderconvictionsandtheaggravatedrobberyconvictionallarosefromasingleincidentoccurringonthesamedate.ThisaggravatingcircumstanceisfurthertaintedbecausetheStateimproperlyreliedupontheseconddegreeburglaryconviction,whichdidnotinvolvetheuseorthreatofviolenceasrequiredbythestatute,andthus,asacknowledgedbythemajority,wasnotadmissible.TheStatehasnotcarriedtheburdenofshowingthat,beyondareasonabledoubt,theMiddlebrookserrordidnotaffectthejurysdecisiontoimposeasentencedeath. Inmyview,thesentenceofdeathisdisproportionate.Thevictiminthiscasesurprisedtwoburglarsinherhome.Shewaskilledinstantlywithasinglegunshotwoundtothehead.Anymurderistragicanddestructiveinitsownright.Nevertheless,understateandfederallawthedeathpenaltyisreservedforthemostculpableoffenders.Consideringthecharacterofthedefendantandthecircumstancesofthecrime,thiscrimewasnot amongtheworstofthebadforwhomthedeathpenaltyisreserved.Statev.Nichols,877S.W.2d722,744(Tenn.1994),Reid,J.,dissenting.Iwouldholdthatthesentenceofdeathunderthefactsofthiscaseisexcessiveanddisproportionateandreducethesentencetolifeimprisonment.      ____________________________      Reid,J.
