8" 8" 0 ` A:8 ` $` $No,Sir. 8" 8" 0 ` Q:8 ` $` $Canyougripanythingwithyourhandsnow?  8" 8" 0 ` A:8 ` $` $No,Sir.0 8" 8"  ` Dr.Rayopinedthattheplaintiffhada40percentimpairmenttoeachhand.Dr.Gawopinedthatshehadatenpercentimpairmenttoeacharm,becauseofherinabilitytogriporsqueeze. ` Theaward,asstated,was35percentvocationaldisabilitytoeacharm. ` ThevideotapewasmadeonDecember6,1996.Whilethetrialjudgereferredtohertestimonyaboutherlimitationsas puffing,ourreviewofthetapeimpelstheconclusion,agreeablytotheargumentoftheappellant,thatthetrialjudgewasmerelybeingpolitetotheplaintiff,whowatchedthevideotapeconcurrentlywithhim. ` Theauthenticityofthevideotapeisnotquestioned.Theplaintiffisphotographedforaperiodofseveralhours,whilesheperformedvariousactivitiesoutsideherhome,suchasdecoratingherhomeforChristmasforoveronehour.Duringthisprocess,Ms.Crossettwasnotwearinganytypeofhandsplintsorbraces,nordidherhandsappeartobe drawnupwithoutuseofanysplintsorbraces.Thevideotapedepictsherhavingnodifficultymanipulatingherfingerstopickupsmallnailsandbracketsandusingahammerwithnodifficulty.SheappearsϜnottobeinanynodistressortohaveanynodifficultyingrippingandholdingontoitems.Sheisseeneasilypickingupandcarryingachildsbicycleandaladder,evidencingthatsheiscapableofgrippingevenheavyobjects. ` Insummary,thevideotapedirectlyanddramaticallycontradictshertestimonysupportingthecurtailmentofactivities.Italsocontradicts,inpreponderant measure,thetestimonyandopinionsofDrs.RayandGaw. 61/  ` Weagreewiththeappelleeantthatthereisnoescapingtheconclusionthatthe plaintiffmisrepresentedthenatureandextentofherclaimedinjuries,andthatthetrialjudgewascorrectinvacatingtheinitialjudgment.Therecordisrepletewithevidencethattheplaintiffwaslessthancandidwithherphysiciansandwiththecourt.Shemadeinconsistentstatementstothethreephysiciansregardingherworkdutiesandthedateofheronsetofsymptoms.Shealsomadeinconsistentstatementstothecourtinhertestimonyattheoriginaltrialinstatingthatshewasunabletoperformeventhesimplesttaskofbrushingherteetheffectively,andthatshenever  tookherbracesoff󀜀becauseherhandswoulddrawup.   ` EachofMs.CrossettstreatingphysiciansmadehisinitialdiagnosisfromhistoryprovidedbyMs.Crossettthatshewasdoinghighlyrepetitiveworkeighthoursaday,whichwasastretch,sinceshewasaprobationaryemployeeparticipatingintrainingandwasundernoproductionquotaatthetimethatshefirstallegedsymptoms.Therecordindicatesthatshespentalotoftimewatchingandlearningratherthanusingherhandsrepetitively. ` ThetrialcourtwasconfrontedwithconflictingmedicalevidencebasedondifferinghistoriesprovidedbyPlaintiff.Dr.Cushman,theauthorizedtreatingphysician,testifiedthatMs.CrossettsconditionpredatedheremploymentwithFaultlessandwasnotthetypeofcarpaltunnelthatresultsfromrepetitivework.Dr.RaytestifiedthatMs.CrossettsconditionwascausedoraggravatedbyherworkatFaultlessandrecommendedsurgery,basedonhersubjectivecomplaints.Dr.Gaw,alsohavingreceivedinaccurateinformationfromPlaintiff,originallythoughtthatPlaintiffsproblemswereworkrelated,butafterlearningofheractualconditionsofemployment,heconcededthathisopinionwouldbespeculativeifMs.Crossetthadnotprovidedhimanaccuratehistory. `  9 52 Ї ` Weaffirmthejudgmentatthecostsoftheappellant,andremandthecasetothetrialcourtforallappropriatepurposes.Thevideotape,ExhibitOnetotheRule60hearing,willbereturnedtotheclerkofthetrialcourt.Ӏ `     h     _______________________________ P   `     h     WilliamH.Inman,SeniorJudgeCONCUR:̜̜0 ` _______________________________FrankF.Drowota,III,Justice8 `  ` 8"` 8" _______________________________JoeC.Loser,Jr.,SpecialJudge8  08"8"`8"8"  ` %  Ԝ
