Afterconsiderationoftherecordandtheargumentsoftheparties,weconcludethatDaviswillfullyandknowinglyviolatedtheorderoftemporarysuspensionononeoccasion.WethereforeholdDavisincontemptandimposeasentenceofconfinementforoneday,suspendedontheconditionthathefullycomplywiththerulesandordersofthisCourt.@ BACKGROUND  InOctoberof1996,GuyS.Davis,apracticingattorney,enteredaconditionalguiltypleatotwoactsofdisciplinarymisconduct 3   ׀inexchangeforaprivatereprimandfromtheBoardofProfessionalResponsibility.Theprivatereprimandcontainedseveralconditions:Ӝ̛8 1. ThatDavisreceiveanevaluationatCharterLakeside,comply8 8 8 withtreatmentandaftercareprogramsrecommendedbythetreatmentcenter,andprovideacopyofthetreatmentcentersreportandtreatmentplantotheBPR.8 2. ThatDavisenteracontractwithLawyersConcernedfor8 8 LawyersorLawyersHelpingLawyersfor18months,withthecontracttoprovideforreportstotheBPRandatleast12drugtests.8 3. ThatDavishaveamonitorwithLawyersConcernedforLawyers8 whoshallmakequarterlyreportstotheBPR.TheprivatereprimandstatedthatathirtydaytemporarysuspensionwouldbesoughtifDavisviolatedanyoftheconditions.  InAprilof1997,theBoardofProfessionalResponsibility,afterdeterminingthatDavishadviolatedtheseconditions,revokedtheprivatereprimandandrequestedthisCourttoenforcethethirtydaysuspension.ThisCourtenteredanorderonJanuary16,1998,whichstatedthat therespondentsconditionalguiltypleashallbeenforcedandtheRespondentshallreceiveathirty(30)daysuspension. Shortlyaftertheentryoftheorderoftemporarysuspension,DisciplinaryCounsellearnedthatDavisrepresentedclientsincourtincriminalcasesonJanuary16,20,23,and26.Whennotifiedoftheseallegations,DavisrespondedinwritingthathedidnotreceiveacopyofthesuspensionorderuntilJanuary23,1998.Whenhewasunabletoreachdisciplinarycounselbytelephonethatmorningtoaskabouttheeffectivedateofthesuspension,hemadeacourtappearancethatafternoon.Atapproximately4:00p.m.,DavisagaincalleddisciplinarycounselandthistimewasinformedtheeffectivedateofthesuspensionwasJanuary16,1998. DavissresponsetotheBoardconcededthathemadeanadditionalappearanceintheLakeCountyCircuitCourtonJanuary26,1998,despitethefacthehadlearnedfromdisciplinarycounselthathislicensehadbeentemporarilysuspended.Davisswrittenresponseexplained:8 8 therewasnotimetoadvisemyclientsnorarrangeforeitherofmytwoassistantstocoverthecourtasbothwerealreadyscheduledtoappearinothercourts.ItookthechanceIfeltIneededtotake,appearedandpracticed.LakeCountyCircuitcourtmeetsveryinfrequently.Acontinuanceandreassignmentofthecaseswouldhave,inmyopinion,causedmyclientsandthecourtmoreproblemsthantheproblemsIwouldhaveifmyappearancewasquestioned.Ididnotpracticeafterthemorningofthe26thuntilthesuspensionhadpassed.BasedontheforegoingeventsandDavissadmission,theBoardfiledapetitionaskingthatDavisbeheldincontemptforviolatingthetemporarysuspensionorder. OnMay18,1998,weenteredanorderrequiringDavistoappearbeforethisCourtandshowcausewhyheshouldnotbeheldincontempt.Davissresponsewasessentiallythesameascontainedinhislettertodisciplinarycounsel:thathehadnotreceivedacopyofthesuspensionorderpriortoappearingincourtonJanuary16and20,1998;thathewasuncertainastotheeffectivedateofthesuspensionpriortoappearingincourtonJanuary23,1998;andthatheknowinglyviolatedthesuspensionorderbyappearingincourtonJanuary26,1998,forthereasonssetforthinhisletter. Afterreviewingtherecordandresponsesoftheparties,weconcludethatthecourtappearancespriortoDavissreceiptofthesuspensionorderandknowledgeastoitseffectivedate,donotestablishknowingandwillfulviolationsofthesuspensionordersoastoamounttocontemptuousconduct.Incontrast,DavissadmissionsindicatethathiscourtappearanceonJanuary26,1998,constitutedaknowingandwillfulviolationoftheorderoftemporarysuspensionand,therefore,warrantafindingofcontempt.Tenn.CodeAnn.299102(3)(1980&Supp.1997).̜ Althoughnotprovidingadefenseforthisconduct,wearemindfulofandtakeintoconsiderationthecandordisplayedbyMr.DavisbothwithdisciplinarycounselandthisCourtinmakingtheseadmissionsandinexplainingthereasonsforhisviolationofthesuspensionorderonJanuary26,1998.HavingheldGuyS.DavisincontemptofthisCourt,wethereforesentencehimtoonedayofimprisonment,suspendedupontheconditionthathefullycomplieswiththerulesandordersofthisCourt.
