Accordingly,itisthejudgmentofthisCourtthatDannyKayeDockeryisadjudgedincontemptforviolatingtheorderofsuspensionbyfailingtocomplywithTenn.Sup.Ct.R.9,18.Mr.Dockeryisherebysentencedtofivedaysinjail,suspendedupontheconditionthatherefraininthefuturefromthetypeofconductsetforthinthecontemptpetitionandotherwisecomplieswiththerulesofthisCourtwithregardtohissuspension.` ` " X@  BACKGROUND  DannyKayeDockeryreceivedhislawlicenseintheStateofTennesseein1982.OnOctober14,1996,thisCourtrenderedanopinionsuspendingDockeryfromthepracticeoflawfortwoyearsbasedonfindingsmadebyadisciplinaryhearingpanelandadoptedbytheShelbyCountyChanceryCourtthathehadmismanagedfundsandfailedtopayaclientanamountshewasowed.ThisCourtsopinionsaid,inpart:8 8 8 ItisthefindingofthePanelthatinnumerousinstancesoveranextendedperiod[Dockery]comingledentrustedfundswithhispersonalfunds,thathemisappliedandmisappropriatedtohisownuseandbenefitthefundsentrustedtohim.Hefailedtopayhisclienttheamountshewasowedandfailedtomaintainhisrecordsinaprofessionalmannerthatwouldpermithimtodemonstratewhathehaddonewiththesettlementproceeds.Theproofdemonstratedapattern...ofmismanaginghisescrowaccount,hisescrowaccountrecordsandusinghisescrowaccountforpaymentofpersonalandofficeexpensesandshowingnoappreciationfortheimportanceofmaintaininghisrecordsaccurately....Dockeryv.BoardofProfessionalResponsibility,937S.W.2d863(Tenn.1996).ThisCourtaffirmedthetwoyearsuspensionandalsoconditionedDockeryseligibilityforfuturereinstatementuponcompletingthreehoursoflegalethicsandmakingfullrestitutiontohisformerclient. ` ` X OnApril30,1997,theBoardofProfessionalResponsibilityfiledapetitionforanorderofcontemptallegingthatDockeryviolatedtheordersofsuspensionbyfailingtocomplywithTenn.Sup.Ct.R.9,18,whichrequiressuspendedattorneystonotifyclientsofthesuspension,withdrawfromrepresentationinpendingcases,givenoticetoadverseattorneyswhenclientshavenotfoundsubstitutecounsel,refrainfromacceptingnewcases,andfileanaffidavitwiththeCourtandtheBoardstatingthattheattorneyhascompliedwiththeCourtsorder. ThepetitionforcontemptallegedsixinstancesinwhichDockerycontinuedtopracticelawand/orfailedtonotifyhisclientsofhissuspension,including: 0   DockeryrepresentedVivianFordandfiledthecompletionofherChapter7schedulesandstatementofaffairsonJuly10,1996.  0  0   DockerygavelegaladvicetoVivianFordandpreparedpetitionschedulesforher,whichhecopiedforheronSeptember25,1996.   0   DockeryrepresentedSammyWilliamsinaGeneralSessionsmatteronNovember8,1996,andsignedacertificateofmailingas attorneyforplaintiffonOctober24,1996.   0   DockeryneversentJoycelynBartonthecourtorderednoticeofhissuspensionandinnootherwaynotifiedherofhissuspension.   0   DockeryattemptedtorepresentAbronColemaninacriminalcaseonNovember12,1996.   0   Dockerypreparedthecomplaintforadivorcecaseandcharged$150forhisservicesinDecemberof1996.  ( 9%'*+, (Dockeryfiledaresponsedenyingtheallegations,askingtoreopentheinvestigationregardinghissuspension,andrequestingdamagesfromtheBoard. ThisCourtappointedJudgeWilliamAcreeasSpecialMastertodeterminethefactualissuesraisedbythepetitionandDockerysresponse.OnApril7,1998,theSpecialMasterfiledhisreportwiththisCourt,whichfound:8 8 Ineachofthefivecases,theundersignedfindsthat[Dockery]renderedservicestoothersthatcalledfortheprofessionaljudgmentofalawyerand,therefore,engagedinthepracticeoflawinviolationoftheorderofsuspension.Thereportalsofound inmitigationthatDockeryreceivedpaymentforonlyoneofthecasesandthathismotiveinassistingVivianFordandSammyWilliams wassolelyfortheirbenefitratherthanforhis. :   ׀ AfterconsiderationofthefindingsoftheSpecialMaster,thisCourtfindsthatDockerywillfullyviolatedtheorderofsuspensionpreviouslyenteredbythisCourtbyfailingtocomplywithTenn.Sup.Ct.R.9,18.SeeInreSaperstein,811S.W.2d900(Tenn.1991)(findingwillfulandcontemptuousviolationoforderofsuspension).Therefore,thisCourtholdsDannyKayeDockeryincontemptandsentenceshimtoafivedaysuspendedsentence,upontheconditionthatherefrainsinthefuturefromtheconductsetforthintheBoardscontemptpetitionandadherestothisCourtsrulesgoverningsuspensions.Tenn.CodeAnn.299102(3)(1980&Supp.1997). 4  d   CONCLUSION    X    HavingconsideredthepetitionfororderofcontemptagainstDannyKayeDockeryfiledbytheBoardofProfessionalResponsibility,Dockerysresponsetothatpetition,andthefindingsoftheSpecialMaster,weconcludethatDannyKayeDockeryviolatedthisCourtsorderofsuspensionbyfailingtocomplywithTenn.Sup.Ct.R.9,18.WethereforeholdDannyKayeDockeryincontemptofthisCourtandsentencehimtofivedaysimprisonment,suspendedupontheconditionthatherefrainsinthefuturefromtheconductsetforthintheBoardscontemptpetitionandcomplieswiththerulesofthisCourtregardinghissuspension.
