Dr.Landsbergnotedthatatthe 7639 timehesawplaintifftheleftshoulderwasworsethantherightwithanylifting 95; althoughhehadminimaluseofeithershoulder.Dr.Landsbergtestifiedthathis ~;6= findingswereconsistentwithplaintiffsclaimsoftryingtoovercompensatewith  theleftarmfortherightarminjuryandwithDr.Snyderslastofficenoteof | January6,1997whereinDr.Snyderindicatedthat whenMr.Greenworkswith H hisshoulderstheygetpainfulagain.Dr.Landsbergspermanentpartial  d impairmentratingsareasfollows:5%fortherightupperextremityand8%for  0 theleftupperextremitywhichconvertsto3%and5%respectivelywholebody    impairment,i.e.forbothrightandleftupperextremitiesacombinedpermanent x  partialimpairmentratingof8%tothebodyasawhole. D   ` Followinghisrightshouldersurgery,plaintiffreturnedtoworkatthesame ` rateofpaycuttingmetalbandsonamachineeventhoughthebandcuttingjob , waslightduty,itwasextremelypainfultohisshouldersandtherepetitivenature  ofthebandcuttingjobwasaproblemforhimduetohisshoulderinjuries. t Althoughthejobwas closetoafulltimejobwhenthefactorywasassembling @ singlewidemobilehomes,therewerenometalbandstocutwhenthefactory  \ wasproducingdoublewidemobilehomes.Oneofthoseotherjobswasrolling ( aroundundertrailersonacreeper,patchingtheboardonthetrailerbottoms.  Theoverheadworkrequiredbythejobcausedhimdifficultywithbothshoulders. p!  Anotherjobhewasaskedtoperformafterhisoperationwastosweepthe <#" insidesofmobilehomes.Plaintifftestified myshouldersgotsobadthen,ithurt %X $ metodoanything.Anotherjobplaintiffwasrequiredtoperformafterreturning &$"& fromthesurgerywastoputbacksplashtilesaroundthebackofcabinets.He (#( wasunabletoperformthisjobbecauseitrequiredhimtocarryfivegallon l*%* bucketsofglue.InJune1997plaintiff 8,',   5 .T).   determinedthathesimplywasunabletoperformhisworkatFleetwoodany / +0 longerandheresigned.HenotifiedFleetwoodhewasgoingtohaveto quit 1,2 becausemyshoulderswasgettingsobad.Beforeresigningplaintiffaskedthe h3.4 productionmanageratFleetwoodithecouldattempttodoaninspectionor 4506 qualitycontroljob,butwastoldthattherewerenoopeningsineitherofthose 7P28 jobs.Plaintiffwasneverofferedajobinqualitycontrolorinspection.Plaintiff 84: testifiedthathedidnotknowwhetherornothecoulddosuchjobs,butstatedhe :5< wouldhavetriedifsuchjobshadbeenofferedtohim.Plaintifftestifiedthathe  wasplanningtoseeksomeworkhecoulddo,butsaid everythingIknowhowto | do,Icantdo.Hetestifiedthathelikedtowork,wishedhecouldcontinue H workingatFleetwoodanddidnotwanttohavetoresign.  d  ` BeforeworkingatFleetwood,plaintiffatsometimedidfarmworkwithhis  0 fatherandhadbuilthisownhouse.Hehadworkedsweepingthefloor,putting    upstock,andunloadingtrucksatadepartmentstore,andhadinstallednewtires x  onvehiclesatatirecenter.However,hetestifiedhewouldbeunabletoperform D  therequirementsofthesejobsduetotheproblemswithhisshoulders.Athome ` plaintiffsshoulderinjurieshadcausedhimtostopusingaweedeaterandapush , mowerandhenolongerservicedhisowncar.   ` Plaintiffofferedattrialanumberofwitnessesincludingthreeofhis t supervisorsatFleetwood,theproductionmanagerandanumberofcoworkers, @ allofwhomtestifiedthatplaintiffwashonestandagoodworkerandsomeof  \ whomcorroboratedplaintiffstestimonyastohavingtroublewithbothshoulders ( whenhereturnedtoworkaftertherightshouldersurgery.   ` Defendantsinsistedattrialandherethatthereisanirreconcilableconflict p!  betweenthetestimonyofplaintiffandthatofDr.Panganiastotheleftshoulder <#" causationissue.DefendantsargumentisthatplaintiffsdenialofmakingtoDr. %X $ Pagnanithehonestconfessionastolackofcausationoftheleftshoulderinjury &$"& revealsthatsincethatconfessionplaintiffhasbecomeamalingererandpursuer (#( ofafraudulentclaimforworkerscompensation l*%*   6 8,',   benefits.WehavecarefullyreviewedalloftheevidencerelatingtoDr.Pagnanis .T). paraphraseofplaintiffsassertedstatement.Weconcludethatthisasserted / +0 credibilityissue,aswellasthedenialbydefendantsofplaintiffsleftshoulder 1,2 claimwasprobablytheresultofabizarrebreakdownincommunicationsamong h3.4 Dr.Pagnani,hisassociateDr.Snyderandtheclaimsdepartmentofdefendant 4506 LumbermensAlliance. 7P28  `  Thetrialjudge,attheconclusionofthetrial,ruledfromthebench 84: thatthe2timesmedicalimpairmentlimitationunderTenn.CodeAnn.506 :5< 241(a)(1)doesnotapplyandfurtherruledthatboththeleftandrightshoulder  injurieswerecompensable.Hethenfoundplaintiffsvocationaldisabilitytobe | 60%tothebodyasawhole.
