Followingahearingtoaddresstheallegationsinthepetition,thisCourtappointedtheHonorableJohnK.ByerstoserveasSpecialMasterandtoresolveanyandallfactualissuesraisedbytheparties.OnApril13,1998,afterconductinganevidentiaryhearingandconsideringstipulationsofferedbytheparties,theSpecialMasterfiledareportoffactualfindingsindicatingthattheBoardsallegationsweresupportedbysufficientevidenceandthatHancockhadheldhimselfouttothepublicasanattorneyafterhislicensehadbeensuspended.̀ Accordingly,afterconsiderationoftherecord,argumentoftheparties,andthefindingsoftheSpecialMaster,itisthejudgmentofthisCourtthatJohnMarkHancockisadjudgedincontemptforviolatingtheorderofsuspensionbyfailingtocomplywithTenn.Sup.Ct.R.9,18.JohnMarkHancockissentencedtofivedaysinjail,suspendedupontheconditionthatherefraininthefuturefromthetypeofconductsetforthinthecontemptpetitionandcomplieswiththerulesofthisCourtwithregardtohissuspension.@ BACKGROUND    X      TherecordshowsthatJohnMarkHancockreceivedhislawlicenseintheStateofTennesseein1981.OnJune15,1994,thisCourtsuspendedhislicensetopracticelawpursuanttoasettlementagreementbetweentheBoardandHancockregardingactsofmisrepresentation,misappropriation,andmisuseofclientfundsbyHancock.             9 u`  =   ThesuspensionofHancockslicensewasorderedtolastuntilatleastJanuary1,1996.Hancockhasnotappliedforreinstatement.     OnNovember18,1997,theBoardofProfessionalResponsibilityfiledapetitionfororderofcontemptallegingthatHancockhadviolatedtheorderofsuspensionbyfailingtocomplywithTenn.Sup.Ct.R.9,18,whichrequiressuspendedattorneystonotifyclientsofthesuspension,withdrawfromrepresentationinpendingcases,givenoticetoadverseattorneyswhenclientshavenotfoundsubstitutecounsel,refrainfromacceptingnewcases,andfileanaffidavitwiththeCourtandtheBoardstatingthattheattorneyhascompliedwiththeCourtsorder.ThepetitionallegednumerousinstancesinwhichHancockcontinuedtopracticelawand/orrepresentedhimselftomembersofthepublicasalicensedlawyer,including: 0   Hancockusedletterheadandstationerydesignatinghimselfas Esq.and/or ConsultantandCounselorand/oranyotherrelateddesignation.   0   Hancockidentifiedhimselfasanattorney,orheldhimselfoutasanattorney,forAlfredCrewstoAlfredRobinsonofAlfredRobinsonRealtyCompanyand/orRobertN.Bailey,attorneyforAlfredRobinson.   0   HancockfailedtoinformAlfredRobinsonorRobertBaileythathislicensetopracticelawhadbeensuspended.   0   HancockrepresentedtoMs.JennieAngelethathewas,atthetime,alicensedattorney.   0   HancockrepresentedtoMs.DorisHeaththathewas,atthetime,alicensedattorney.   0   Hancocksoughtstudentsfor JohnHancockUniversitybyusingletterheadorstationerydesignatinghimselfas Esq.and/or ConsultantandCounselorand/oranyotherrelatedterm.   0   Hancockusedletterheadorstationeryreferringtohimselfas AttorneyandCounseloratLawinsolicitingUniversityofTennesseefootballplayerstousehimasanagent.   0   HancocksubmittedaresumetoGenerationPowerCompanyindicatingthathewas,atthetime,anattorney.  ( >!"#$,./0 (` ` ,hX8  ` ` X   T       X      TheSpecialMaster,inhisreportfortheCourt,madethefollowingfindings: 0   Hancockusedletterheadorstationerydesignatinghimselfas Esq.and/or ConsultantandCounselorandthereisnofactualbasisforhisclaimthatthiswasinadvertent.   0   RobertM.Bailey,attorneyforAlfredRobinson,receivedlettersfromHancockwhichboretheletterheaddesignatingHancockas Esq.and ConsultantandCounselor.BaileyrespondedtothelettersandaddressedHancockasanattorney.HancocknevercorrectedBaileysreferencetohimasanattorney.ThereisnotsufficientevidencetofindthatHancockheldhimselfoutasanattorneytoAlfredRobinsonorAlfredCrews.   0   HancockneverinformedAlfredRobinsonorRobertBaileythathislicensetopracticelawhadbeensuspended.   0   HancockdidrepresenttoJennieAngelethathewasalicensedattorney.   0   HancockdidrepresenttoDorisHeaththathewasalicensedattorney.   0   Hancocksoughtstudentsfor JohnHancockUniversitybyusingletterheadorstationerydesignatinghimselfas Esq.and/or Consultant andCounselor.   0   Hancockusedletterheadreferringtohimselfas AttorneyandCounselor atLawinsolicitingUniversityofTennesseefootballplayerstousehimasanagent.   0   HancocksubmittedaresumetoGenerationPowerCompanyindicatingthathewasanattorney,buttheletterwasundatedandthereisnoevidencethatitwassentwhenHancockslicensewassuspended.   0   Hancockcontinuedtobelistedinthephonebookasanattorneyandtooknostepstohavethatlistingremoved.  TheSpecialMasterconcludedthatHancockhad heldhimselfouttothepublicasanattorneyafterhislicensetopracticelawwassuspendedandthatthiswasdonetogarnerfinancialreturnwhetherhereceivedremunerationinallinstancesornot. Inacaseinvolvingsimilarissuesbutmoreegregiousconduct,InreSaperstein,811S.W.2d900(Tenn.1991),theBoardofProfessionalResponsibilityfiledapetitionfororderofcontemptallegingthatSapersteinviolatedTenn.Sup.Ct.R.9,18bycontinuingtopracticelawandtoacceptnewcasesdespiteanorderofsuspension.SapersteinfailedtorespondtothechargesandalsofailedtoappearbeforethisCourtatthescheduledcontempthearing.Afterreviewingtherecordandthecharges,wefoundthatSapersteinsfailuretocomplywiththeCourtsorderofsuspensionandtheprovisionsofRule9,andhisfailuretorespondtothecontemptchargeseitherbypleadingorappearance,was willful,contumacious,andcontemptuous.WethereforeheldthatSapersteinwasguiltyof18countsofcontemptandimposedasentenceof10daysimprisonmentanda$50fineoneachcount. Inthiscase,afterconsiderationofthefindingsoftheSpecialMaster,thisCourtfindsthatHancockwillfullyviolatedtheorderofsuspensionpreviouslyenteredbythisCourtbyfailingtocomplywithTenn.Sup.Ct.R.9,18.Therefore,thisCourtholdsJohnMarkHancockincontemptandsentenceshimtoafivedaysentence,suspendedupontheconditionthatherefrainsinthefuturefromthetypeofconductsetforthintheBoardscontemptpetitionandadherestothisCourtsruleswithrespecttosuspension.Tenn.CodeAnn.299102(3)(1980&Supp.1997). ?   0 4  d       &    CONCLUSION     X   '  Ԝ HavingconsideredthepetitionfororderofcontemptagainstJohnMarkHancockfiledbytheBoardofProfessionalResponsibility,Hancocksresponsetothatpetition,argumentsoftheparties,andthefindingsoftheSpecialMaster,weconcludethatJohnMarkHancockviolatedthisCourtsorderofsuspensionbyfailingtocomplywithTenn.Sup.Ct.R.9,18.WethereforeholdJohnMarkHancockincontemptofthisCourtandsentencehimtofivedaysimprisonment,suspendedupontheconditionthatherefrainsinthefuturefromthetypeofconductsetforthintheBoardscontemptpetitionandfullycomplieswiththerulesofthisCourtregardinghissuspension.
