Inthiscase,weconsiderwhetherTennesseelawaffordsabasisfortheChiefJusticeoftheSupremeCourtofTennesseetoappointSpecialSupremeCourtJustices.Thepetitioner,JohnJayHooker,hasfiledapetitiontorehearinthiscausepursuanttoT.R.A.P.39(a)(2).ThiscausewasoriginallyfiledbeforethisCourtbythepetitioneronMay19,1998pursuanttoT.R.A.P.11.ThepetitionerproceededtofileamotiononJune12,1998requestingthatallmembersofthisCourtrecusethemselvesduetoconflictofinterest.SuchmotionwasdeniedonJuly7,1998. D6,1w  OnAugust27,1998,thepetitionerfiledarenewedmotiontorecuse,specificallyrequestingthatChiefJusticeAnderson,andJusticesBirchandHolderrecusethemselvesduetoallegedconflictsofinterest.Inresponse,onSeptember16,1998,theChiefJusticefiledanorderdesignatingandassigningJudgeGaryR.WadeoftheCourtofCriminalAppealsandJudgeCharlesD.Susano,Jr.,oftheCourtofAppealstoactasSpecialJusticesoftheSupremeCourtforthepurposeofparticipatinginthereviewofthepetitionersRule11application.OnOctober5,1998,anOrderwasfileddenyingthepetitionersapplicationforpermissiontoappeal.ChiefJusticeAndersonandJusticeBirchdidnotparticipateinsaidorder,havingbeenreplacedbySpecialJusticesWadeandSusano.Thepetitionerhasproceededtofilethispetitiontorehear,contendingthatthereisnobasisinTennesseelawforSpecialJusticesoftheSupremeCourttobeappointedbytheChiefJustice.̀#XKXX X # !\  TherecusalofjudgesinthisStateisaddressedbyArticleVI,11oftheTennesseeConstitution,whichprovidesasfollows:8 NoJudgeoftheSupremeorInferiorCourtsshallpresideonthetrialofanycauseintheeventofwhichhemaybeinterested,orwhereeitherofthepartiesshallbeconnectedwithhimbyaffinityofconsanguinity,withinsuchdegreesasmaybeprescribedbylaw,orinwhichhemayhavebeenofcounsel,orinwhichhemayhavepresidedinanyinferiorCourt,exceptbyconsentofalltheparties.IncasealloranyoftheJudgesoftheSupremeCourtshallthusbedisqualifiedfrompresidingonthetrialofanycauseorcauses,theCourt,ortheJudgesthereof,shallcertifythesametotheGovernoroftheState,andheshallforthwithspeciallycommissiontherequisitenumberofmen,oflawknowledge,forthetrialanddeterminationthereof.TheLegislaturemaybygenerallawsmake d18'+ provisionthatspecialJudgesmaybeappointed,toholdanyCourtstheJudgeofwhichshallbeunableorfailtoattendorsit;ortohearanycauseinwhichtheJudgemaybeincompetent.44*. ! !  $5*/ Id.(emphasisadded).WeinterpretthislastsentencetoauthorizetheGeneral H4*. TheGeneralAssemblyhas,inturn,enactedstatutesconferringpowertotheChiefJusticeoftheSupremeCourttoappointreplacementjudges.TennesseeCodeAnnotated172110(a)(1994)providesasfollows:8 Whenanychancellororcircuit,criminalorappellatejudgeshall,for   anyreason,beunabletotrythedocketinanycourtofsuch   chancellor'sorjudge'sdivisionorcircuit,thechancellororjudgeshallcertifytothechiefjusticeofthesupremecourtthefactofsuchinability,witharequestthatthechiefjusticeshallassignsomeotherchancellor,circuit,criminalorappellatejudgetohearthecaseorcaseswhichthechancellororjudgeisunabletohearanddecide.  ! ! (emphasisadded).SeealsoTenn.CodeAnn.163201(d)(4);163401;163 tH 402(1994)(conferringgeneralpowerstotheSupremeCourttopromulgateinternaloperatingprocedures);Tenn.CodeAnn.163502(3)(1994)(authorizingtheSupremeCourttodesignateanadministrativeofficeofthecourtstosupporttheappointmentofinferiorcourtjudges).Weinterpretthereferenceto appellatejudge[s]inTenn.CodeAnn.172110(a)toincludejudgesoftheSupremeCourt.TennesseeCodeAnnotated163201(a)statesthatthejurisdictionoftheSupremeCourtis appellateonly.BecausethelanguageofTenn.CodeAnn.172110doesnotlimittheterm appellatetointermediateappellatejudges,itislogicaltoconstruetheprovisiontoapplytoallappellatejudges,includingjudgesoftheSupremeCourt. ThisconstructionofTenn.CodeAnn.172110isalsoconsistentwiththe 4h*. legislativehistoryoftheprovision.Originallyenactedin1919,thestatutedidnotapplytoappellatejudges.See1919Tenn.Pub.Actsch.166,1.Thestatute   wasamendedin1987toincludeappellatejudges.See1987Tenn.Pub.Actsch.   65,2.Thebillsummary,whichwasprovidedtoalllegislators,states:8 ThisbillwouldauthorizethechiefjusticeoftheSupremeCourttoassignaretiredorregularjudgetotheappellatecourtifthelitigationbecomestoocongestedorwhenanappellatejudgeisunabletotrythedocketinhisdivisionorcourt.Appellatejudgesassignedbythechiefjusticewouldbeauthorizedunderthisbilltoclaimexpensesinadditiontosalary.  ! ! Ӝ95thGeneralAssembly,LegislativeSummaryofSenateBill643andHouseBill456.ThereisnomentionanywhereinthelegislativehistorysuggestingthattheamendedstatuteshouldnotapplytoSupremeCourtJustices. ThepetitionercitesTenn.CodeAnn.172102(1994)forthepropositionthatonlytheGovernorhasthepowertoappointsubstituteSupremeCourtJustices.Thisstatuteprovidesthat:8 Thejudgesofthesupremecourt,withinthefirstweekofeachterm,orassoonthereafterasthefactshallcometotheirknowledge,shallcertifytothegovernorallcasesuponthedocketinwhicheitherofthemisincompetenttosit,uponthereceiptofwhichcertificate,thegovernorshallappointandcommissiontherequisitenumberofcompetentlawyerstodisposeofthecauses.  ! ! Id.;seealsoTenn.CodeAnn.172104(1994)(enablingtheGovernorto \+0!$ appointareplacementJusticeintheeventthatasittingJusticeisill).ThedefinitionofincompetenceissetforthinTenn.CodeAnn.172101(1994). Notwithstandingthestatutorylanguagesupportingthepetitionersproposition,wefinditdifficulttoreconcileTenn.CodeAnn.172102withthe 4h*. clearlanguagesetforthinTenn.CodeAnn.172110(a),whichenablestheChiefJusticetoappointareplacementjudgeintheeventthatajudgeisunabletositfor anyreason.(emphasisadded).Becausethislanguageisnotqualified,   weconstrue anyreasontoincludeincompetence.Id.Thebillsummaryof  Tenn.CodeAnn.172110referstoabroadinabilityofanappellatejudge totrythedocket.LegislativeSummary,supra.Certainly,incompetencewouldbe d8  includedasagroundforanappellatejudgesinability totry[hisorher]docket.Id.    Moreover,ourrulingisconsistentwiththetraditionalpracticeofthisCourt.WebelievethatTenn.CodeAnn.172102,172104,and172110(a)werepromulgatedwiththeintenttoempowerboththeGovernorandtheChiefJusticetodesignatetemporaryjudges.
