Inthisactionfordamages,theplaintiff,ReginaDarleneHunter,allegedthatasachildshewassexuallyabusedbythedefendant,EdBrown,Jr.,butwasunabletofilethisactionpriorto1993becausesherepressedthememoryoftheabuse.Thetrialcourtfoundnoreasontotollthestatuteoflimitationsandgrantedthedefendantsmotionforsummaryjudgment.TheCourtofAppealsaffirmed. TheissuebeforeusiswhetherthediscoveryruleappliestoaffecttheaccrualofHuntersclaim.Weconclude,afterathoroughexaminationoftherecordandacarefulconsiderationofthearguments,thatunderthecircumstancesherepresented,thediscoveryruledoesnotapply.Consequently,Huntersclaimaccruedin1982,andheractionfiledJuly15,1993,isuntimely.Accordingly,theorderofsummaryjudgmentgrantedtothedefendantisaffirmed.@ I ReginaDarleneHunterwasbornonOctober13,1967,andshespentthegreaterportionofherchildhoodinfostercare.InJune1981,shewasplacedinthefosterhomeofMr.andMrs.EdBrown,Jr.AccordingtoHunter,EdBrown,Jr.,begansexuallyabusingherinJuly1981amonthafterherplacementintheBrownhome.Theabuseprogressedfromfondlingtofairlyfrequentsexualintercourse,andHunterbecamepregnantinthespringof1982. WhenPatriciaMartin,theDepartmentofHumanServicescaseworkerinchargeofHunterscase,learnedofthepregnancy,sheremovedHunterfromtheBrownhome.MartinthenarrangedforanabortionataKnoxvillefacility,andthepregnancywasterminatedinJune1982. InadditiontothephysicianwhodeterminedHunterwaspregnantandMartin,Huntertoldothersoftheabuse.Atthephysiciansinsistence,HuntertoldthedefendantswifethatBrownhadimpregnatedherthiswasdonewhiletheplaintiffandMrs.Brownwerestillinthephysiciansoffice.Inaddition,MartinandHuntertalkedwiththedistrictattorneygeneralabouttheabuse.Hunterhasnospecificrecollectionoftheconversationwiththedistrictattorneygeneral,andthereisnoindicationthatthecomplaintwaseverinvestigated.Aftertheabortion,HunterwasrelocatedtoagrouphomeinNashville,Tennessee.AccordingtoHunter,atatimesubsequenttothe1982abortion,sherepressedthememoryofit. Approximatelyeightyearslater,inAugust1990,Huntergavebirthtoadaughter.Themedicalrecordsassociatedwiththebirthcontainthefollowingreferencestothe1982rapeandabortion: 6/27/90Surgery:abortionKnoxage15;rapeddoesnotknowmuchaboutit, Abortionage15rapeddoesntremember,and PASTHISTORY:Positiveonlyforanabortionatanearlyage.Inanaffidavit,Hunterstates:Ӝ̛0 0 8 8 Idenyanymemoryofeverhavingtoldanyoneaboutmyabortionin1982whileunderDr.Footescarein1990oratHarrimanHospitalin1990.̛̜ In1992,Hunterbecamepregnantagain.ShedecidedtoϜabortandreturnedtothefacilitywherethe1982pregnancyhadbeenterminated.SheunderwentanabortionprocedureinJune1992.Asshewasrecoveringfromtheeffectsoftheanesthesia,Hunterbegantorememberthepriorabortion.Inheraffidavit,Hunterstatedthat untilI[went]totheReproductiveHealthCenterinJulyof1992,IhadcompletelyrepressedmyfirstvisittotheCenter.IonlyrememberedthedetailsoftheabuseandrapewhenIhadbeenintherapywithMs.Schwind. Inthemonthsfollowingthesecondabortion,HunterparticipatedintherapysessionswithErikaSchwind,alicensedclinicalsocialworker.WithSchwindsassistance,Hunterrecalled theextentandtypeofsexualandphysicalabusebyMr.Browncommitteduponme.... HunterfiledthisactiononJuly15,1993.ShesoughtcompensatoryandpunitivedamagesfromBrownforhisallegedsexualconducttowardher.Thedefendantmovedforajudgmentonthepleadingsandcontendedthatthesuitwasbarredbythestatuteoflimitations. /   ׀ ThetrialcourtheldthatHuntersstatementthatshedidnotremembersupplyingtheinformationfoundinthemedicalrecordswasinsufficienttoestablishagenuineissueofmaterialfactastowhetherin1990,Hunterrememberedtheincidentsthathadoccurredin1982.Thetrialcourtgrantedthedefendantsmotionanddismissedthecase.Theintermediatecourtaffirmed.̛@ II Thismattercomestousbywayofamotionforjudgmentonthepleadingsamotionthatthetrialcourtproperlytreatedasamotionforsummaryjudgment.Becauseitinvolvesonlyquestionsoflaw,nopresumptionofcorrectnessattachestothetrialcourtsdecisiontograntsummaryjudgment.Onappeal,wemustfreshlydeterminewhethertherequirementsofTenn.R.Civ.P.56havebeenmet.Gonzalesv.AlmanConstr.Co.,857S.W.2d42,4445(Tenn.App.1993)(citingHillv.CityofChattanooga,533S.W.2d311,312(Tenn.App.1975)).Indoingso,wemustconsiderthepleadingsandtheevidentiarymaterialsinthelightmostfavorabletothemovant'sopponent,andwemustdrawallreasonableinferencesintheopponent'sfavor.Byrdv.Hall,847S.W.2d208,21011(Tenn.1993). Asstated,HunterfiledthisactiononJuly15,1993.Actionstorecoverdamagesforpersonalinjuriesmustbecommenced withinone(1)yearafterthecauseofactionaccrued.Tenn.CodeAnn.283104(a)(Supp.1996).Thus,ifHunterscauseofactionaccruedonorbeforeJuly15,1992,herclaimisbarred. 0    Acauseofactiongenerallyaccrueswhenthetortiscompleteandinjurytotheplaintiffhasoccurred.SeeMcCroskeyv.BryantAirConditioningCo.,524S.W.2d487,48990(Tenn.1975)(citingcases).Incertaintortactions,however,theaccrualofthecauseofactionisdeferreduntiltheinjuryisdiscoveredorintheexerciseofreasonablecareanddiligence,theinjuryshouldhavebeendiscovered.QualityAutoPartsCo.,Inc.v.BluffCityBuickCo.,Inc.,876S.W.2d818,820(Tenn.1994)(decliningtoapplythediscoveryruletoslanderclaims). Underthediscoveryrule,thecauseofactionaccruesandthestatuteoflimitationsbeginstorunwhentheinjuryisdiscovered,orintheexerciseofduecareanddiligence,theplaintiff%  Ԁdiscoversthatheorshehasarightofaction.Pottsv.CelotexCorp.,796S.W.2d678,680(Tenn.1990);McCroskey,524S.W.2dat491.Thediscoveryruleappliesonly incaseswheretheplaintiffdoesnotdiscoverandreasonablycouldnotbeexpectedtodiscoverthat[she]hadarightofaction.Potts,796S.W.2dat680.Further,thelimitationsperiodistolledonlyduringtheperiodwhentheplaintiffhasnoknowledgeatallthatawronghasoccurredand,asareasonableperson,wasnotputoninquiry.Potts,796S.W.2dat68081;Hoffmanv.HospitalAffiliates,Inc.,652S.W.2d341,344(Tenn.1983). HunterinsiststhatshedidnotdiscoverherinjurynorcouldshereasonablyhavediscoveredituntilJuly1992,thetimeofthesecondabortion.However,itisnotdisputedthatHunterretainedhermemoryoftheeventsin1982forsomeperiodoftimebecauseshereportedtheabusetohersocialworkerwhotookhertospeaktothedistrictattorneygeneral.Althoughnoprosecutioneverfollowed,clearlyHunterknewshehadbeeninjuredandknewtheidentityoftheperpetrator.Thediscoveryrulesimplydelaystheaccrualofthecauseofactionuntiltheplaintiffisawareoftheinjury.Hunterwasawareoftheinjuryandthewrong,attheverylatest,whenshehadtheabortionin1982.Therefore,thefactsinthiscasedonotfairlyraisetheissueofrepressedmemory.Weholduntilanotherdaytheapplicabilityofthistheorytocasesofsexualabuse. Asstated,becauseHunterwasaminorwhenthecauseofactionaccrued,Tenn.CodeAnn.281106extendedtheperiodwithinwhichHuntercouldfileanactiontooneyearbeyondhereighteenthbirthday.BecausethisactionwasnotfileduntilapproximatelyeightyearsafterHunterseighteenthbirthday,itistimebarred.
