InNovemberof1992,thepetitioner,HerbertS.Moncier,andasecondattorneywereappointedpursuanttoTenn.R.Evid.13torepresentHuskey.ϜTennesseeRulesoftheSupremeCourt,Rule131permitsappointmentoftwo  attorneysforonedefendantincapitalcases.Thepetitionersoughtadditionalreimbursementinthetrialcourtfortwoadditionalattorneys,forparalegalsandforvariousotherexpenses.Thetrialjudgeenteredanordergrantingreimbursementfortwoadditionalattorneysnottoexceed$10,000.00andforparalegalsat$15perhournottoexceed$5,000.00.Theorderwasenterednuncprotunctothedateofthepetitioner'sappointment. X P  InMayof1996,thepetitionersubmittedabilltotheAdministrativeOfficeoftheCourts("AOC")intheamountof$24,315.82.Thebillincludedbothincourtandoutofcourtcostsforthepetitioner'stime.Thepetitioner'sbillalsoincludedthetimespentbytwoadditionalattorneys,paralegalservices,meals,andFederalExpresscharges.TheAOCdeniedaportion($7,585.22)ofthepetitioner'sbillandpaidhim$16,730.00. InJulyof1996,thepetitionerfiledamotioninthetrialcourtforanorderauthorizingadditionalparalegalservicesat$25.00anhournottoexceedϜ$7,500.00.Thepetitionerfurthersoughtanordergrantinggeneralapprovalofongoingexpertservicesandoccasionalmeals.Thetrialcourtenteredanorderapprovingthepetitioner'srequests. 706 Ї InNovemberof1996,thepetitionerinquiredintotheadjustmentsmadebytheAOCtohisMay1996billandsubmittedanotherbilltotheAOCforϜ$43,745.55.Inthisbill,thepetitionersoughtreimbursementforlunchexpensesfromSam&Andy's,Calhouns,Kroger,Walmart,Ships,WheelCalbash,Pete'sandTakeoutTaxitotalingapproximately$706.13.TheAOCdeniedreimbursementformealexpensesonthebasisthatRule13doesnotpermitreimbursementofmealsinthecitywhereappointedcounselpractices.TheAOCissuedachecktothepetitionerfor$43,039.42. InDecemberof1996,thepetitionersubmittedtwobills.ThefirstbilltotheAOCtotaled$8,229.55.ThebillconsistedprimarilyofthepetitionerstimebutalsoincludedaFederalExpressbillof$127.75.TheAOCdeniedtheFederalExpresschargebecausenopriorapprovalwasobtainedpursuanttoRule13.TheAOCissuedachecktothepetitionerintheamountof$8,101.80.Thesecondbilltotaled$16,799.75.IncludedinthesecondbillwasachargeforϜ$13,427.25associatedwithparalegalservices.TheAOCdeniedtheparalegalchargesonthebasisthatnopriorapprovalwasobtainedandthatparalegalexpensesarenotanallowableexpenseunderRule13. ThepetitionerhassoughtourreviewoftheAOC'sdenialsofrequestforpayment.Therespondentarguesthatreviewofthefirstbillistimebarredbecausethepetitionersoughtreviewbeyondthe60daylimitationfoundinRule13.Wesuspendapplicationofthetimelimittoexpediteourconsiderationofthiscaseandresolvetheissuesontheirmerits.SeeTenn.R.App.P.2. 704 Ї TennesseeRulesoftheSupremeCourt,Rule13providesinpertinentpart:8 Inacapitalcasetwoattorneysmaybeappointedforonedefendantandeachiseligibleforcompensation.  ! ! 8 ...  ! ! 8 Cocounselorassociateattorneysappointedinnoncapitalcasesmaynotbecompensated.6  ! ! Tenn.R.Sup.Ct.13;seealsoRule13Compiler'sNotes("Inacapitalcasetwo 80  attorneysmaybeappointedforonedefendantandeachiseligibleforcompensation.").Rule13isunambiguous.Oneattorneymaybeappointedandreceivecompensationinnoncapitalcases.Twoattorneysmaybeappointedandreceivecompensationincapitalcases.Thelastsentenceoftheruledoesnotexpandthenumberofattorneyswhomayreceivecompensationinacapitalcaseadinfinitum.Thesentencemerelyreaffirmsthatonlyoneattorneymay xp receivecompensationinanoncapitalcase.Moreover,itisinappropriatetoattempttocircumventRule13'slimitationoftheappointmentoftwoattorneysinacapitalcasebyattemptingtobillanattorney'stimeunderanotherclassificationsuchas"expertfees"or"otherexpenses."Accordingly,theAOCdidnotabuseitsdiscretionindenyingcompensationforthetimeofanyattorneybeyondthetimeofthetwoattorneysappointedtorepresentthedefendantpursuanttoRule13.  Thepetitionerhasbilledthestateforparalegalservices.UponreviewoftheTenn.R.Sup.Ct.13,webelievethatthepetitioner'sclaimforparalegalexpensesshouldbedenied.Rule13doesnotprovideforreimbursementofparalegalexpenses.Theotherexpenseprovision,Tenn.R.Sup.Ct.13,2C(3),wasnotmeanttosubsidizeanattorney'sincomeorcovergeneraloffice 6/3 overhead.Accordingly,theAOCdidnotabuseitsdiscretionindenyingtheparalegalexpensesasbilled.̜  TheFederalExpresschargesintheamountof$127.75requiredpriorapprovalasan"other"expenses.Thepetitionerarguesthatanythingrequiringtheuseofovernightmailisnecessarilysourgentthatpriorapprovalisnotpractical.Thepetitioner,however,hasnotstatedtheneedfortheovernightmail  H@  atissueandhasofferednoexplanationastowhyhecouldnothaveobtainedpriorapprovalforthecharges. ThepetitionerhasbilledtheStateforapproximately$934.18formealsatrestaurantsinKnoxvillesuchasBistro,Chesapeakes,Litton's,theOrangery,etc.Rule13,however,doesnotpermitreimbursementofmealsinthecitywhereappointedcounselpractices.Reimbursementofmeals,mileageandothertravelexpensesmayoccurwhencertainconditionsaremetundertheTennesseeJudicialTravelRegulationsorundertheInternalRevenueCode162(a)(2).Theseconditionspermittingmealreimbursementhavenotbeenmet.TheAOC,therefore,didnotabuseitsdiscretionindenyingreimbursementformealexpenses.
