FACTUALBACKGROUND    Thedefendant,KristinaSchindler,wasconvictedofaggravatedburglary.In1994,Schindlerlearnedthatherboyfriendoftwoyearswasleavingherforthevictim.Schindlersearchedthroughherboyfriend'smailandfoundthevictim'saddressinKnoxville.SchindlerthendrovefromTexastoKnoxville,foundthevictim'sresidence,retrievedaneighteeninchaxehandlefromthetruck,andapproachedthevictim'sapartment.Schindlerstatedthatshefoundakeyunderthevictim'sdoormatandenteredtheapartment.Schindlerconfrontedthevictimandinstructedhernottoscream.Thevictimapparentlycalledforhelp.Schindlerthenrepeatedlystruckthevictimwiththeaxehandle. Schindlerwaschargedwithespeciallyaggravatedburglarybutwasconvictedofthelesserincludedoffenseofaggravatedburglary.Schindlerrequestedposttrialdiversion.HerpresentencereportindicatedthatshehadapriorconvictionforshopliftinginTexasandhadpreviouslypledguiltytocharges 706 oftelephoneharassmentinKansas.Shefurtheracknowledgedthesepriorconvictionsinherposttrialdiversionapplication.Accordingtothedefendant,shewasgranteddiversioninbothcasesandherrecordswereexpungedfollowingsuccessfulcompletionofdiversionprograms. Thetrialcourtdeniedthedefendant'srequestforposttrialdiversion.Thetrialcourt'sorderstated:8 Astojudicialdiversionwhichis,fortherecord,stronglyopposedbytheStatetherehavebeentwootherdiversions.Ms.Hendrickshascitedmesomecases,whichtheCourtisfamiliarwith.Intermsofevidentiaryrulingsandastoevidenceinadmissionsofguiltinthosetypesofcases,whichiswhatthoseinvolved,diversionmightotherwisenotbeadmissible.Inthiscase,whethertherehasbeenpreviousdiversionisadmissibleindeterminingwhetherornotjudicialdiversionisappropriate.Anindividualcan'tjustkeephavingdiversionandexpungingrecordsandkeepgoing,andwearenowdealingwiththethirdstateinvolved.  ! ! 8 TheotherthingthattheCourtisveryconcernedabout,asfarasjudicialdiversionisthatthisCourttakesthistypeofoffenseextremelyseriouslyinitsseriousness.IamtryingtousetherightwordinanefforttosupporthowserioustheCourttakesthisoffenseandnottomitigateitseffect,theCourtdoesnotfeelthatMs.Schindleriseligibleforjudicialdiversion,baseduponthetwootherdiversionsandthenatureoftheoffense.  ! ! TheCourtofCriminalAppealsaffirmedthetrialcourt'sdenialofdiversion.    STATUTORYBACKGROUND  X/P(+ ] Judicialdiversionislegislativelargesswherebyadefendantadjudicatedguiltymay,uponsuccessfulcompletionofadiversionprogram,receiveanexpungementfromall"officialrecords"anyrecordationrelatingto"arrest,indictmentorinformation,trial,findingofguilty,anddismissalanddischarge" 815 pursuanttothediversionstatute.Tenn.CodeAnn.4035313(b).Theeffectofdischargeanddismissalunderthediversionstatute"istorestoretheperson,inthecontemplationofthelaw,tothestatusthepersonoccupiedbeforesucharrestorindictmentorinformation."Id.Whengeneralinquiriesaremadeby   prospectiveemployersinnonrelatedcivilmattersorinothermattersnotprecludedbystatute,acriminaldefendantgrantedexpungementpursuanttothediversionstatutemaydenyorrefusetoacknowledgebeingarrested,tried,orconvicted.SeegenerallyTenn.CodeAnn.4035313(b)(1)&(2). (   TheSentencingReformActof1989("Act")establishesthegeneralrequirementsforprogrameligibility.TheActprovidesinpertinentpart:8 IfanypersonwhohasnotpreviouslybeenconvictedofafelonyoraClassAmisdemeanorisfoundguiltyorpleadsguiltytoamisdemeanorwhichispunishablebyimprisonmentoraClassC,DorEfelony,thecourtmay,withoutenteringajudgmentofguiltyandwiththeconsentofsuchperson,deferfurtherproceedings....  ! ! Tenn.CodeAnn.4035313(a)(1)(A)(1997Repl.).Inaddition,certainstatutoryoffenseshavebeenexcludedfromprogrameligibilityandareenumeratedinTenn.CodeAnn.4035313(a)(1)(B).Adefendant,however,maybeplacedinajudicialdiversionprogramonlyonce.Tenn.CodeAnn.40-35-313(a)(2). TennesseecourtsmayretainrecordspertainingtocaseswheredischargeanddismissalisgrantedundertheTennesseediversionstatute.These"nonpublic"recordsareretainedforthepurposeofdeterminingwhether,insubsequentproceedings,anapplicantmeetsthegeneralprogrameligibilityrequirementssetforthin4035313(a)(1)(A).SeeTenn.CodeAnn. 815 40-35-313(a)(2)("butanonpublicrecordthereofisretained...solelyforthepurposeof...determining[programeligibility],orforthelimitedpurposesprovidedinsubsection(b).").Inthecasenowbeforeus,however,thedefendantwastwicegranteddiversioninstatesotherthanTennessee,andcourtrecordsarenotavailableinTennesseewhichreflectthepriorgrants.Accordingly,wemustdecidewhethertrialcourtscanconsiderexpungedrecordsofpreviousconvictionsoccurringinstatesotherthanTennesseewhendeterminingeligibilityunderTenn.CodeAnn.4035313(a)(1)(A).    ANALYSIS   % Expungementfollowingsuccessfulcompletionofajudicialdiversionprogramremovesfromcertainofficialrecordsrecordationrelatingtothedefendant'sarrest,indictment,trial,findingofguilt,anddismissalanddischarge.Tenn.CodeAnn.4035313.Expungementreturnsthepersontotheposition"occupiedbeforesucharrestorindictmentorinformation."Tenn.CodeAnn.4035313(b).Expungementdoesnotreturnapersontothepositionoccupiedpriortocommittingtheoffense.Defendantsobtainingexpungementmayhavecommittedcriminalactsresultinginlastingphysical,emotional,orfinancialinjuriestovictims.Inmanycases,theinjuredvictimscannotbereturnedtothestatusquo.Accordingly,thelawwouldblinditselftorealityifthelawrefusedtorecognizethesecriminalactsandaccordthemanylegalsignificancewhatsoever. Weholdthatthetestimonyandevidenceofthecriminalactsprecedingthearrestareadmissibleasevidenceofpriorbadactsorevidenceofsocialhistoryevenifexpungementislaterobtained.SeegenerallyStatev.Williams, 704 645S.W.2d258,260(Tenn.Crim.App.1982)(holdingdiversionactcannotbeusedtoshieldwitnessfromcredibilityattackwhenwitnessisaskedaboutpriorbadacts);seealsoStatev.Dishman,915S.W.2d458,46364(Tenn.Crim.App.   1995).Moreover,thejudicialdiversionstatutedoesnotprecludeconsiderationofsubsequentwitnessadmissionsorpublicrecordscompiledaftertheexpungementthatrevealthefactofapriorgrantofdiversion. Thedefendant'spresentencereportinthecasenowbeforeuswasnotapublicrecordsubjecttoapreviousexpungement.Accordingly,theinformationinthisreportwasadmissibleandproperlyconsideredbythetrialjudge.ThisreportindicatesthatthedefendantwasconvictedofshopliftinginTexasinthemid1980s.Shereceivedoneyearprobation.Theshopliftingoffensewaslaterexpungedfromherrecorduponhercompletionoftheprobationaryperiod.In1990or1991,shepledguiltytotelephoneharassmentinKansas.Shereceivedthreemonthsprobationandjudicialdiversion.Shestatedthatthisrecordhadalsobeenexpunged. OurlegislaturehasexplicitlystatedthatadefendantmaybeplacedonjudicialdiversiononlyonceunderTenn.CodeAnn.4035313.Thedefendant'spriorgrantsofdiversioninKansasandTexas,however,werenotpursuanttoTenn.CodeAnn.4035313.Accordingly,thedefendantisnotstatutorilyprecludedfrombeingplacedondiversionby4035313(a)(2)merelybyreasonofthepriorgrants.ThedefendantmuststillmeettheeligibilityrequirementspursuanttoTenn.CodeAnn.4035313ofnothavingbeenpreviouslyconvictedofafelonyoraClassAmisdemeanor.  5.2  Therecordbeforeusdoesnotindicatetheclassificationsofthe defendant'sprioroffenses,anditisimpossibletogradethoseoffensesbasedontheinformationbeforeus.Accordingly,thedefendantwasstatutorilyeligiblefordiversion.Evidenceofthedefendant'spriorbadactsandpriorgrantsofdiversion,however,supportthedenialofdiversion.Thisevidencewasdirectlyrelevantindetermining:(1)thedefendant'spotentialforrehabilitation;(2)thedeterrentvalueofdiversionuponthedefendant;and(3)thelikelihoodthatthedefendantwillbecomearepeatoffender.Thedecisionoftheappellatecourtaffirmingthetrialcourt'sdenialofdiversionisaffirmedasmodified.Costsofthisappealshallbetaxedtothedefendantforwhichexecutionshallissueifnecessary.   <      D T$T$MT$ H!@    <      D JANICEM.HOLDER,JUSTICE̜ Concurring:Panel:  %!
