àóóAs€stated,€the€original€charge€against€the€defendant€wasÏaggravated€rape€committed€upon€his€six„year„old€stepdaughter,€RM.€ÏOn€October€7,€1990,€RM€was€left€in€the€defendantððs€care€while€herÏmother€took€RMððs€younger€brother€to€the€hospital€for€emergencyÏtreatment.€€While€her€mother€was€away,€the€defendant€lured€RM€intoÏhis€bedroom€and€undressed€her.€€He€penetrated€her€ð ðfront€privateÏpartðð€with€his€finger,€and€he€penetrated€her€with€his€ð ðfrontÏprivate€part€[while]€moving€up€and€down.ðð€€RM€testified€that€thisÏwas€painful€and€that€she€asked€the€defendant€to€stop.€€HeÏthreatened€to€kill€her€if€she€were€to€tell€anyone€what€hadÏoccurred.ÌÌà àIn€the€days€immediately€following€October€7,€1990,€RMððsÏmother€became€aware€of€RMððs€behavioral€problems€at€school€(i.e.,Ïlying,€physical€aggression,€and€stealing€from€her€classmates).€€AÏcounselor€told€her€that€RM€exhibited€ð ðclassic€symptoms€of€abuse.ððÏOn€October€10,€1990,€RMððs€mother€confronted€her€and€asked€whetherÏanyone€had€improperly€touched€her.€€RM€promptly€told€her€of€theÏevents€of€October€7,€1990.€€RMððs€mother€immediately€contactedÏlocal€authorities€and€was€referred€to€Sonia€Polansky,€anÏinvestigator€for€the€Department€of€Human€Services.€€PolanskyÏinterviewed€RM€and€referred€her€to€Jerry€Bradley,€M.D.,€for€aÏphysical€examination.ÌÌà àOn€October€12,€1990,€Bradley€examined€RM.€€According€toÏBradley,€the€purpose€of€the€examination€was€to€diagnose€any€injuryÏand€to€provide€any€necessary€treatment,€psychological€orÏotherwise.€In€giving€a€medical€history,€RM€related€the€details€ofÏthe€defendantððs€sexual€conduct€toward€her.€€Bradley€then€attemptedÏa€pelvic€examination.€€When€RM€vigorously€resisted€this€attempt,ÏBradley€determined€that€such€an€examination€at€that€time€wouldÏcause€undue€stress€and€emotional€trauma.€€He€referred€RM€toÏKristie€Lynn,€M.D.,€a€pediatric€gynecologist,€for€the€examination.€ÌÌà àOn€October€30,€1990,€Lynn€examined€RM.€€As€Bradley€hadÏdone,€she€obtained€a€medical€history€from€RM€before€performing€theÏphysical€examination.€€Lynn€testified€that€she€avoided€askingÏleading€questions€when€obtaining€the€history.€€RM€supplemented€herÏverbal€description€of€the€abuse€by€drawing€pictures.€€She€relatedÏthat€the€defendant€had€touched€her€with€his€penis€and€that€he€hadÏdigitally€penetrated€her€vaginal€and€anal€area.€€Lynnððs€findingsÏon€physical€examination€were€consistent€with€RMððs€description€ofÏthe€sexual€abuse.ÌÌà àIn€òòMcLeodóó,€we€found€that€if€the€declarant€is€a€child,Ïthe€court€must€look€to€all€the€circumstances€surrounding€theÏstatement€to€determine€whether€the€statement€was€made€for€theÏpurposes€of€diagnosis€and€treatment€and€is€thus€admissible.€€InÏother€words,€the€fact€that€the€declarant€is€a€child€does€notÏeliminate€the€rationale€underlying€the€hearsay€exception,€and€theÏtest€for€admission€is€the€same€as€that€applied€to€a€statement€madeÏby€an€adult€declarant.€€However,€we€emphasize€the€necessity€ofÏconsidering€all€the€circumstances€of€a€childððs€statement€becauseÏthe€childððs€ability€to€articulate€the€reason€for€the€statement€mayÏbe€affected€by€age€or€developmental€maturity.ÌÌà àThe€facts€in€the€instant€case€are€similar€to€those€inÏòòMcLeodóó,€and€the€dispositive€issues€identical.× ƒ3 ××  ×€€A€jury€found€McLeodÏguilty€of€the€aggravated€rape€of€his€daughter.€€McLeod€objected€toÏthe€admission€of€the€testimony€of€a€pediatric€resident€who€hadÏtaken€a€medical€history€from€the€victim€and€had€conducted€aÏphysical€examination.€€The€victim€identified€McLeod€as€theÏperpetrator.€€The€physician€testified€that€both€the€history€andÏthe€physical€examination€were€necessary€for€purposes€of€ð ðdiagnosisÏand€treatment.ðð€€òòId.óó€at€872.ÌÌà àIn€as€case€consolidated€with€òòMcLeodóó,€a€jury€found€JamesÏYoung€guilty€of€sexual€battery€for€fondling€his€stepdaughter.€ÏYoung€objected€to€the€testimony€of€a€pediatrician€who€took€aÏmedical€history€and€examined€the€victim€one€month€after€theÏallegations€surfaced.€€The€victim€identified€Young€as€the€abuserÏwhile€giving€her€medical€history.€€However,€in€contrast€to€theÏphysician€in€McLeodððs€case,€the€pediatrician€testified€that€sheÏconducted€the€examination€for€ð ðevaluativeðð€purposes.€€òòId.óó€at€873.ÌÌà àIn€resolving€each€case,€we€thoroughly€examined€all€ofÏthe€circumstances€surrounding€each€childððs€statement.€€WithÏrespect€to€defendant€McLeod,€this€examination€convinced€us€thatÏthe€trial€judge€did€not€abuse€his€discretion€in€admitting€theÏstatement€because€the€victim€had€clearly€made€it€for€the€purposesÏof€diagnosis€and€treatment.€€By€contrast,€the€circumstances€ofÏdefendant€Youngððs€case€strongly€indicated€that€the€victimððsÏstatement€had€not€been€made€for€the€purposes€of€diagnosis€andÏtreatment;€thus,€the€evidence€was€insufficient€to€support€itsÏadmission€under€Tenn.€R.€Evid.€803(4).× ƒ4 ××  ×€€òòId.óó€at€872„73.ÌÌà àCourts€should€not€presume€that€a€statement€made€by€aÏchild€to€a€medical€service€provider€is€inadmissible€merely€becauseÍthere€is€little€or€no€testimony€by€the€child€concerning€motivationÏfor€making€the€statement.€€Rather,€in€making€the€determinationÏunder€Tenn.€R.€Evid.€803(4),€courts€should€consider€the€totalityÏof€the€circumstances€to€determine€whether€a€particular€statementÏwas€made€for€the€purposes€of€diagnosis€and€treatment.€€A€statementÏimproperly€influenced€by€another,€one€made€in€response€toÏsuggestive€or€leading€questions,€or€inspired€by€a€custody€battleÏor€family€feud€deserves€especially€careful€scrutiny€because€suchÏstatement€may€have€been€made€for€purposes€other€than€diagnosis€andÏtreatment.€€òòId.óó€at€871.ÌÌà àWe€now€consider€the€circumstances€in€the€instant€case.ÏStinnett€contends€that€RMððs€statements€are€unreliable€andÏtherefore€inadmissable.€€We€find€the€following€circumstancesÏsurrounding€RMððs€statements€to€be€significant.€€At€the€time€theÏstatements€were€made,€RM€was€six„years„old€and€old€enough€toÏunderstand€that€the€physician€was€examining€her€to€determineÏwhether€there€was€injury€or€trauma€and€to€treat€her€for€such,€ifÏnecessary.€€She€used€child„like€terms€in€describing€body€parts€andÏthe€sexual€abuse€to€each€physician.€€In€addition,€her€statementsÏto€both€physicians€and€her€testimony€at€trial€were€internally€andÍcomparatively€consistent€in€all€pertinent€respects.€€Further,€sheÏwas€examined€immediately€after€the€allegations€were€made€andÏnearly€four€years€prior€to€trial.€€Moreover,€there€is€noÏindication€that€RM€was€motivated€to€be€untruthful€to€the€doctors.ÏAccordingly,€after€consideration€of€the€circumstances€surroundingÏthe€making€of€RMððs€statements,€we€conclude€that€the€statementsÏmade€by€RM€were€for€the€purposes€of€diagnosis€and€treatment€and,Ïtherefore,€satisfy€the€òòMcLeodóó€test€for€admissibility€under€Tenn.ÏR.€Evid.€803(4).ÌÌà àThe€defendant€insists€that€even€if€RMððs€statements€wereÏgenerally€admissible€under€Tenn.€R.€Evid.€803(4),€her€specificÏidentification€of€him€as€the€perpetrator€was€inadmissible€becauseÏthe€statement€was€pertinent€to€diagnosis€only.€€In€òòLivingstonóó,€weÏheld€that€ð ðstatements€made€to€a€physician€identifying€aÏperpetrator€who€is€a€member€of€the€childððs€household€may€beÏreasonably€pertinent€to€proper€diagnosis€and€treatment€ofÏemotional€and€psychological€injury.ðð× ƒ5 ××  ×€€In€the€instant€case,€eachÍphysician€testified€that€the€examination€was€for€the€purposes€ofÏdiagnosis€and€treatment.€€The€fact€that€the€perpetrator€was€RMððsÏstepfather,€who€resided€in€the€same€household,€was€pertinent€toÏthe€diagnosis€and€treatment€of€an€emotional€or€psychologicalÏinjury€suffered€as€a€result€of€the€abuse.€€This€issue€is€withoutÏmerit.ÌÌÌÌà àAccordingly,€the€victimððs€statements€were€properlyÏadmitted€under€Tenn.€R.€Evid.€803(4),€and€the€judgment€of€theÏintermediate€court€is€affirmed.€€Costs€of€this€cause€are€taxed€toÏStinnett€for€which€execution€may€issue€if€necessary.ÌÌÌÌÓÓà
