àAppellate€review€is€de€novo€upon€the€record€of€the€trial€court,Ïaccompanied€by€a€presumption€of€the€correctness€of€the€findings€of€fact,€unlessÏthe€preponderance€of€the€evidence€is€otherwise.€€Tenn.€Code€Ann.€ðð50„6„225(e)(2).€€This€tribunal€is€required€to€conduct€an€independent€examination€ofÏthe€record€to€determine€where€the€preponderance€of€the€evidence€lies.€€òòWingertÏv.€Government€of€Sumner€Countyóó,€908€S.W.2d€921€(Tenn.€1995).ÌÌà@ àòòò òEMPLOYMENT€RELATIONSHIPóóó óÌà àIn€October€€1990,€J.€W.€Allen€(ð ðplaintiffðð)€was€engaged€in€work€throughÏBob€Jones€on€a€project€on€Flamingo€Street€in€Memphis,€Tennessee.€€TheÏFlamingo€project€was€not€a€partnership€job,€but€was€obtained€by€Jones€in€hisÏcapacity€as€a€sole€proprietor.€€Jones€was€working€as€a€subcontractor€for€WestÏTennessee.€€On€October€16,€1990,€plaintiff€slipped€from€the€roof,€fell€and€brokeÏhis€hip.€€He€ultimately€had€multiple€surgeries,€including€a€hip€replacement.€€AtÏthe€time€of€his€accident€plaintiff€was€an€insulin€dependent€diabetic,€a€pre„existing€condition€that€caused€multiple€physical€problems.€€Plaintiff€had€alsoÏreceived€a€prior€workersðð€compensation€award.ÌÌà àPlaintiff,€who€was€thirty€years€old€at€the€time€of€his€injury,€is€JonesððÏstepson.€€He€was€one€of€a€pool€of€ten€to€twelve€roofers€Jones€utilized€on€roofingÏsubcontracts.€€Jonesðð€method€of€operation€involved€his€obtaining€a€roofingÏsubcontract€and€then€hiring€roofers€to€complete€it,€subject€to€his€quality€control.€ÏEach€roofer€he€contacted€could€accept€or€reject€his€offer€for€work€on€a€particularÏproject.€€If€a€roofer€accepted€a€job,€Jones€required€that€he€stay€on€the€job€until€itÏwas€finished.€€Plaintiff€testified€that€he€was€not€free€to€accept€a€job€with€anyoneÏelse€during€the€Jonesðð€job.ÌÌà àAlthough€Jones€required€roofers€to€provide€their€own€small€tools,€heÏprovided€all€the€materials€for€a€roofing€job€and€also€larger€tools€such€as€powerÏsaws€and€ladders.€€Plaintiff€testified€that€he€never€hired€or€fired€any€helpers€onÏthe€job,€and€that€those€persons€were€engaged€by€Jones.€€Although€someÍdispute€existed€about€who€set€working€hours,€plaintiff€testified€that€Jones€set€theÏtime€at€which€employees€€were€to€report€to€work.€€The€workers€generally€metÏJones€at€his€home€or€at€a€coffee€shop€and€then€traveled€to€the€job€together.€€AtÏthat€point€Jones€would€go€over€an€explanation€of€the€work€that€needed€to€beÏdone.€€Jones€further€instructed€them€to€work€as€late€into€the€evening€hours€asÏpossible,€until€it€became€too€dark.€€Plaintiff€stated€that€if€he€did€not€have€a€goodÏreason€for€leaving€early€he€probably€would€have€been€fired.ÌÌà àJones€did€not€withhold€deductions€from€any€payments€to€the€roofers.€ÏPlaintiff,€like€other€roofers,€was€paid€by€the€ð ðsquareðð€installed.€€Jones€did€visit€theÏjob€site€from€time€to€time€to€inspect€the€work,€and€did€exercise€control€over€theÏquality€of€the€final€work.€€Jones€also€retained€the€right€to€fire€plaintiff€and,€in€fact,Ïhad€terminated€him€from€several€earlier€jobs€because€he€found€his€workÏunsatisfactory.ÌÌà àThe€basis€of€liability€under€the€Workersðð€Compensation€Act€is€theÏemployer„employee€relationship.€€If€a€worker€is€an€independent€contractor,€he€isÏnot€entitled€to€benefits€under€the€Act.€€òòStratton€v.€United€Inter„MountainÏTelephone€Companyóó,€695€S.W.2d€945,€950€(Tenn.€1985).€€In€determining€theÏnature€of€the€work€relationship,€several€factors€must€be€considered,€includingÏ(1)€the€right€to€control€the€conduct€of€the€work,€(2)€the€right€of€termination,€(3)€theÏmethod€of€payment,€(4)€the€freedom€to€select€and€hire€helpers,€(5)€the€furnishingÏof€tools€and€equipment€(6)€self„scheduling€of€work€hours,€and€(7)€being€free€toÍrender€services€to€other€entities.€€òòGalloway€v.€Memphis€Drum€Serviceóó,€822ÏS.W.2d€584,€586€(Tenn.€1991).€€While€no€single€factor€is€dispositive€of€theÏrelationship,€courts€emphasize€the€importance€of€the€right€to€control,€even€if€theÏright€is€not€exercised.€€òòId.óó€€Because€the€Act€is€liberally€construed€to€secureÏbenefits€to€those€workers€who€fall€within€its€coverage,€courts€will€resolve€doubtsÏin€favor€of€a€finding€that€a€worker€is€an€employee€rather€than€an€independentÏcontractor.€€òòId.óóÌÌà àThe€testimony€concerning€the€relationship€between€plaintiff€and€JonesÏwas€conflicting.€Our€review€of€the€record€convinces€us€that€the€evidence€doesÏnot€preponderate€against€the€trial€courtððs€finding€that€plaintiff€was€an€employeeÏof€Jones€rather€than€an€independent€contractor.€€The€trial€courtððs€judgment€onÏthis€issue€is€affirmed.ÌÌà@ àòòò òLIBERTY€MUTUAL€COVERAGEó óóóÌà àIn€late€1989,€Bob€Jones€and€W.€L.€Dotson€formed€a€partnership€to€doÏroofing€contract€work.€€The€partners€completed€an€application€for€workersððÏcompensation€insurance€for€their€partnership.€€The€partnership€application€wasÏrejected€by€two€workersðð€compensation€carriers€and€ultimately€was€sent€to€theÏNCCI€southern€division€for€assignment€of€a€carrier€through€the€assigned€riskÏpool.€€The€terms€of€the€application€indicated€that€the€name€of€the€employer€wasÏð ðW.€L.€Dotson€and€Bob€Jonesðð,€that€the€business€was€a€partnership,€and€thatÏDotson€and€Jones€were€partners.€€The€application€was€signed€by€both€partners.€ÍNCCI€assigned€the€coverage€to€Liberty€Mutual€.€€Liberty€Mutual€thereafterÏissued€a€policy€to€cover€ð ðW.L.€Dotson€and€Bob€Jonesðð.€€The€listed€address€forÏthe€partnership€was€Dotsonððs€home€address.€€Liberty€Mutual€also€madeÏappropriate€filings€with€the€State€of€Tennessee,€one€for€each€of€the€namedÏpartners.ÌÌà àAt€the€time€the€initial€policy€application€was€completed€Jones€asked€hisÏinsurance€agent€to€provide€a€certificate€of€insurance€to€West€Tennessee€toÏevidence€his€procurement€of€a€workersðð€compensation€policy.€€The€insuranceÏagency€issued€the€certificate€as€requested,€but€did€so€prior€to€the€actualÏissuance€of€a€policy€by€Liberty€Mutual.€€The€certificate€sent€to€West€TennesseeÏlisted€the€insured€as€ð ðW.€L.€Dotson€and€Bob€Jonesðð.€€It€did€not€list€a€company€orÏpolicy€number.€€David€McCabe,€president€of€West€Tennessee,€called€theÏagentððs€office€as€soon€as€he€received€the€certificate€and€verified€coverage.€ÏHowever,€he€did€not€ever€call€again€to€verify€an€assigned€insurance€company€orÏactual€policy€number.ÌÌÌà àThe€Liberty€Mutual€policy€extended€coverage€from€November€9,€1989€toÏNovember9,€1990.€€Jones€paid€the€initial€premium€for€the€coverage.€€HeÏintended€to€have€this€policy€cover€his€West€Tennessee€work.€€à àOnÏNovember€22,€1989,€Liberty€Mutual€submitted€proof€of€insurance€on€behalf€of€W.ÏL.€Dotson€and€Bob€Jones€to€the€Tennessee€Department€of€Labor€WorkersððÍCompensation€Division.ÌÌà àShortly€after€the€application€was€completed,€Dotson€and€Jones€decidedÏto€dissolve€their€partnership.€€On€December€8,€1989,€they€executed€a€documentÏto€that€effect.€€Jones€never€informed€West€Tennessee€that€the€partnership€listedÏon€the€certificate€had€been€dissolved€or€that€he€had€paid€insurance€premiumsÏfor€only€three€or€four€weeks.€€Therefore,€West€Tennessee€never€withheldÏworkersðð€compensation€premiums€from€Bob€Jonesðð€fees.€€Jones€did€not€obtain€aÏnew€policy€because€he€assumed€the€Liberty€Mutual€policy€covered€him€during€aÏgrace€period.€€He€never€received€a€refund€of€any€premiums€paid€nor€a€notice€ofÏcancellation€from€Liberty€Mutual.ÌÌà àFive€weeks€after€plaintiffððs€accident,€Liberty€Mutual€issued€aÏtermination/cancellation€notice€effective€November€11,€1990.€€The€State€ofÏTennessee,€Division€of€Workersðð€Compensation,€issued€its€notice€ofÏcancellation€for€Jones€on€November€21,€1990.ÌÌò òòòà àóóó óThe€trial€court€found€that€defendant€Liberty€Mutual€was€the€workersððÏcompensation€insurer€of€Bob€Jones€at€the€time€of€plaintiffððs€injury€and€that€aÏcertificate€of€insurance€was€still€on€file€with€the€workersðð€compensation€divisionÏwith€respect€to€Liberty€Mutualððs€coverage€of€Bob€Jones.€€The€evidence€does€notÏpreponderate€against€this€finding.ÌÌà àEvery€employer€subject€to€the€Workersðð€Compensation€Act€must€file€withÏthe€Division€of€Workersðð€Compensation€proof€of€insurance.€€T.C.A.€ðððð50„6„405„406.€€An€employer€remains€subject€to€the€workersðð€compensation€law€untilÏnotice€of€withdrawal€is€filed€with€the€Division€of€Workersðð€Compensation.€ÏòòKarstens€v.€Wheeler€Millwork,€Cabinet€&€Supply€Company,€Inc.óó,€614€S.W.2d€37,Ï40€(Tenn.€1981).€€Liberty€Mutual€did€not€file€a€withdrawal€notice€until€NovemberÏ21,€1990,€after€plaintiff€received€his€injuries.€€It€is€liable€for€coverage€for€plaintiffððsÏinjury.€€The€trial€courtððs€determination€on€this€issue€is€affirmed.ÌÌà@ àòòò òAWARD€OF€DISCRETIONARY€COSTS€TO€WEST€TENNESSEEóóó óÌà àThe€trial€court€awarded€West€Tennessee€$1,026.10€in€discretionary€costsÏto€be€paid€by€co„defendant€Liberty€Mutual.ÌÌà àRule€54.04(2)€of€the€Tennessee€Rules€of€Civil€Procedure€provides€thatÏcertain€costs€are€allowable€in€the€courtððs€discretion€upon€proper€application€byÏthe€ð ðprevailing€partyðð.€€A€reviewing€court€will€not€reverse€the€trial€courtððs€award€ofÏsuch€costs€unless€it€finds€a€clear€abuse€of€discretion€in€the€award€of€such€fees.€ÏòòSeeóó€òòPerdue€v.€Green€Branch€Mining€Companyóó,€837€S.W.2d€56,€60€(Tenn.Ï1992).ÌÌà àLiberty€Mutual€argues€that€Allen€was€the€ð ðprevailing€partyðð€in€this€matter,Ïand€that€West€Tennessee,€having€made€no€recovery€in€the€case€and€beingÏsimply€a€co„defendant,€cannot€be€awarded€discretionary€costs€against€it€underÍRule€54.€€Resolution€of€this€issue€requires€an€analysis€of€the€term€ð ðprevailingÏpartyðð€as€it€applies€to€this€case.ÌÌà àIn€Tennessee€a€prevailing€party€is€a€party€who€has€successfullyÏmaintained€a€claim€against€the€other€at€the€end€of€the€suit.€€òòMcReynolds€v.ÏCatesóó,€26€Tenn.€29,€7€Hump.€29€(Tenn.€1846).€€Other€courts€have€held€that€aÏparty€must€succeed€on€a€significant€issue€in€the€litigation€that€achieves€some€ofÏthe€benefit€the€party€sought€when€it€brought€the€suit.€€òòE.g.óó,€òòMcIntyre€v.ÏTraughberóó,€884€S.W.2d€134,€138€(Tenn.€App.€1994).ÌÌÌà àSome€courts€in€other€jurisdictions€have€held€that€a€prevailing€party€is€oneÏthat€receives€a€favorable€judgment€on€the€merits.€€òòSeeóó€òòNemeroff€v.€Abelsonóó,€469ÏF.Supp.€630,€641€(S.D.N.Y.€1979).€€Other€courts€have€held€that€if€a€defendant€isÏput€through€the€burden€of€defending€a€charge€until€it€is€abandoned,€it€becomesÏthe€prevailing€party€as€to€that€charge.€€òòId.óó€€In€each€case,€however,€the€issue€ofÏcost€assessment€arose€between€plaintiff(s)€and€defendant(s),€rather€than€amongÏco„defendants.ÌÌà àIn€this€case€both€West€Tennessee€and€Jones/Liberty€Mutual€€were€suedÏby€Allen€for€potential€liability.€€The€court€ultimately€determined€that€Jones,€andÏthus€Liberty€Mutual,€was€liable€to€pay€the€benefits€due.€€While€West€TennesseeÏmay€be€a€ð ðprevailing€partyðð€as€to€plaintiff,€that€issue€is€not€before€us€today.€€WestÍTennessee€is€not€a€ð ðprevailing€partyðð€as€to€Liberty€Mutual€or€Jones€because€noÏcross€action€was€ever€filed€by€West€Tennessee€against€those€co„defendants.€ÏThe€award€of€discretionary€costs€to€West€Tennessee€must€be€reversed.ÌÌà àThe€decree€of€the€trial€court€is€affirmed€in€part€and€reversed€in€part.€€ThisÏcase€is€remanded€to€the€trial€court€for€such€further€proceedings€as€may€beÏnecessary.€€Costs€of€this€appeal€are€taxed€to€appellant€Liberty€Mutual.ÌÌÓÓà
