TheChancellorheld ...reallyallIcandoisfindthatthemedicalproofdoesnotbearoutafindingofpermanentdisability,andthisactionforworkerscompensationbenefitswasthereupondismissed,theproprietyofwhichispresentedforourreview,whichisdenovoontherecordaccompaniedbyapresumptionthatthefindingsoffactofthetrialcourtarecorrectunlesstheevidenceotherwisepreponderates.Tenn.CodeAnn.506225(e)(2).Weaffirm. TheplaintiffsustainedanaccidentaljobrelatedinjurytohisbackonNovember1,1992whilecarryinga walkingboardfromastepladdertoatruck.Later,inMay1993,whileburningtrashathome,hesufferedanotherbackinjury,nonworkrelated,resultingin severeexacerbationofincreasedlowbackpainandpaingoingdownbothlegs.Dr.DavidHauge,orthopedicspecialist,examinedtheplaintiffonApril27,1993.HetestifiedthattheplaintiffhaddegenerativediscdiseasewithassociatedcongenitallumbarstenosisatL23andL34,togetherwithabilateraldiscprotrusionatL45ontheleft,andadvisedtherapywithprobablesurgerywhichwaslaterperformedbyanothersurgeon.OnMay11,theplaintiffreturnedtoDr.Hauge,statingthathehadreinjuredhisbackwhileburningtrashathishome. BecauseDr.Haugehadnotseentheplaintiffinfifteenmonths,hehadnoindependentrecollectionofhimand,therefore,basedhisopinionsonofficenotes,whichinitiallydidnotrefreshhisrecollection.Heindulgedvariouspresumptionsandspeculatedatlengthaboutphysicalimpairmentinresponsetoquestionspropoundedtohim;withrespecttodegenerativediscdiseaseandlumbarstresses,hetestifiedthat theymightbeworkexacerbated.Theywouldnotbeworkrelated.Hewentontosaythatthedischerniationwasnotworkrelatedanddeclinedtoapportionanyimpairmentbetweenthesuccessiveinjuries. Dr.FredA.Killeffer,neurosurgeon,examinedtheplaintiffonNovember5,1993.Apartfromhisexamination,heutilizedthevariousmedicalrecordsamassedbyothertreatingphysicians,viz,Drs.Fardon,Bishop,Bailey,Hauge,Burrell,CohnandthemedicalrecordsfromFortSandersParkWestandLaFolletteMedicalCenter.Hetestifiedthat,inhisopinion,theplaintiffhadnoimpairmentresultingfromtheNovember1992injury.Nootherexperttestified. Exceptingunusualinstances,causationandpermanencyofaworkrelatedinjurymustbeprovedbyexpertevidence,whichcannotrestonspeculationorsupposition,TindallV.WaringParkAssn,725S.W.2d935,937(Tenn.1987). WesharetheChancellorsfrustration;wecannotdetermine,inaccordancewithestablishedprinciples,whethertheplaintiffsufferedanypermanentimpairmentfollowingthejobrelatedaccidentandarenotatlibertytospeculateorsubstituteourjudgmentforthatoftheChancellor.Inanyevent,wecannotfindthattheevidencepreponderatesagainstthejudgmentwhichisaffirmedatthecostoftheappellant.      򀀀      WilliamH.Inman,SeniorJudgeCONCUR:򀀀PennyJ.White,Justice򀀀JoeC.Loser,Judge
