Plaintiffsoughtbenefitsforanoccupationaldisease.ThetrialcourtgranteddefendantssummaryjudgmentbasedonTenn.CodeAnn.506306,findingthatplaintifffailedtofilehercomplaintwithintheoneyearstatuteoflimitations. Wereversethetrialcourtsdecisionandremandthecasetothetrialcourtforahearingonthemerits. Plaintiffisaregisterednursewhohasworkedfordefendantforovertwentyyears.Inthespringof1992,whileworkingasapostanesthesiacareunit(PACU)nurse,shebeganexperiencingsymptomsofwhatwasdiagnosedinthesummerof1992asasensitivitytolatex.Shewasrequiredtowearlatexglovesandworkaroundthemdaily,butbecauseshewantedtocontinuetowork,shetried,withthehelpofheremployer,toavoidlatexexposureatwork.Theseeffortswereunsuccessful,andshecontinuedtohaveallergicreactionswhenshewasnearlatex.Injuryreportswerefiledbyhersupervisoronseveraloccasions,includingJune30,1992,January26,1994andMarch31,1994,whenplaintiffhadtheseallergicreactionstolatexatwork. OnApril5,1994,plaintiffsphysiciantoldherthatshecouldnolongerworkasaPACUnursebecauseofherallergytolatex,whichwasbecomingmoresevere,andbecauseshecouldnotavoidexposurewiththatjob. InMay,1994,heremployerplacedherinanewpositionasadmissionassistantnurse,atthesamewage,whereshewouldnotbeincontactwithlatex.However,thispositionwaseliminatedInDecember,1994andshewasthenplacedinanadministrativepositionatalowerwage. PlaintifffiledhercomplaintonNovember14,1994.  Thetrialcourtheld:8 Specifically,theCourtfindsthattheundisputedfactsinthiscaseestablishthatthePlaintiffwastoldandknew,asearlyasJulyorAugust1992,thatshehaddevelopedanoccupationaldisease(latexhypersensitivity),thatthisoccupationaldiseasewasanincurablecondition,thattheoccupationaldiseasewascausedbyherexposuretolatexatCentennial,andthatherabilitytodocertainthingsatworkincertainpositionsinthefuturewouldforeverbeaffected.8 TheCourtisoftheopinionthatthisundisputedknowledgetriggeredtherunningofthestatuteoflimitationswithinTenn.CodeAnn.506306,thatthestatuteoflimitationswasnototherwisetolledorrevived[emphasisadded],andthatthePlaintiffsComplaintistimebarredunderthereasoningsetoutinAdamv.AmericanZincCo.,326S.W.2d425(Tenn.1959).Therefore,theCourtisoftheopinionthattherearenogenuineissuesofmaterialfact[emphasisadded],thatCentennialisentitledtoajudgmentasamatteroflaw,andthatCentennialsmotionshallbegranted. PlaintifftestifiedwhendeposedinJanuary,1995thatdefendant ...paidandarestillpayingformyAeroBidinhalerandthechamber,theAeroBidchamber,whichisaspaceryouhavetohavewiththis.Atoralargument,defendantdidnotdenythepayment. Tenn.CodeAnn.506203provides:8 ...ifwithintheone(1)yearperiodvoluntarypaymentsofcompensationarepaidtotheinjuredperson...anactiontorecoveranyunpaidportionofthecompensation...maybeinstitutedwithinone(1)yearfromthetimetheemployershallceasemakingsuchpayments... Aworkerscompensationappealfromasummaryjudgmentisnotcontrolledbythematerialevidencerule;itisgovernedbyRule56,T.R.C.P.Ifanymaterialevidenceindicatesthatagenuineissueofmaterialfactexists,summaryjudgmentisinappropriate.Blockerv.RegionalMedicalCenteratMemphis,722S.W.2d660(Tenn.1987).Particularlyincertainkindsofcasessummaryjudgmentshouldbeenteredcautiously,andthisCourthaspreviouslyemphasizedthat questionsinvolvingthecommencementofthestatuteoflimitationsinworkerscompensationcasesmostoftenarefactualinnature.McLerranv.MidSouthStone,Inc.,695S.W.2d181,182(Tenn.1985);Blocker,supra.Anydisputeovermaterialfactsorevenanuncertaintyastowhetheretherearedisputedmaterialfactswillrendergrantingasummaryudgmentimproper.Pricev.MercurySupplyCo.,Inc.,682S.W.2d924,929(Ct.App.1984).Theresponseoftheplaintifftothemotionforsummaryjudgmentallegesmaterialfacts,which,iftrue,wouldtolltherunningofthestatuteoflimitations. Weconcludethatagenuineissueofmaterialfactispresentedandthatthefactsneedtobemorefullydevelopedandconsideredbeforethiscasecanberesolved;thussummaryjudgmentwasnotappropriate.
